Quasi-Judicial Hearing - Continued Consideration determination of Fine and/or Corrective Action - 610 North Bay Continuation of the quasi-judicial matter regarding the violation previously heard by the City Commission. Mayor Short requested approval to add Action Item 5c – Approval of a Change Order with Tangerine Group for protective matting related to the pier demolition and remediation project. Action: Added to the agenda with Consensus 1. PRESENTATIONS Representatives from AC Disaster Consulting (ACDC) presented an overview of the City's Emergency Management Program, including updates to the Emergency Operations Plan, disaster recovery procedures, and grant reimbursement coordination. The presentation highlighted the City's preparedness efforts, staff responsibilities during emergency events, and the importance of maintaining current plans, training, and documentation to support effective response and recovery. 2.GENERAL PUBLIC COMMENT Public comments were received regarding community support for the Anna Maria Island Community Center and parking and seating concerns from local business owners including representatives of The Donut Experiment and The Happy Manatee. 3.CONSENT AGENDA a. Tampa Bay Marine: Change Work Order Motion: Commissioner McMullen moved Commissioner Arendt seconded, and the motion carried 4-0 to approve the July 14, 2026, Consent Agenda items a. and d. 4. ACTION ITEMS a. After-the-Fact Fee Waiver Request Applicant James owner of Solid Rock Construction Group requested relief from an after- the-fact permit penalty associated with work performed before permit issuance. Commission reviewed the circumstances surrounding work that began prior to permit issuance, including the permit application process and applicable penalties. After discussion, the Commission found that the violation resulted from an administrative error rather than an intentional attempt to circumvent the permitting process and supported reducing the assessed penalty. Motion: Commissioner Arendt moved Commissioner Morgan-Johnson seconded and the motion carried 4-0 to approve the reduction of after-the-fact fees in the amount of $4,435.70 for permit activities associated with 521 Bayview Place. b. Quasi-Judicial Hearing - Grand Tree Removal Request- 610 N. Bay Boulevard City Attorney Pam Chicone opened the quasi-judicial hearing regarding the Grand Tree Removal Request for 610 North Bay Boulevard and provided an overview of quasi-judicial procedures. She explained that the Commission’s decision must be based on competent and substantial evidence presented through testimony and documentation. Attorney Chicone advised that all testimony must be factual, and expert testimony, written reports, and fact- based personal observations may be considered by the Commission. Attorney Chicone requested disclosure of any conflicts of interest or ex-parte communications. No conflicts of interest or ex-parte communications were disclosed by the Commission members or Mayor. All individuals providing testimony were sworn in by City Clerk Amber LaRowe Applicant Matthew Kempson, representing 610 North Bay LLC, provided testimony regarding the tree located at 610 North Bay Boulevard. Mr. Kempson stated that after purchasing the property, the owner identified a sea hibiscus tree growing into a power line and contacted Florida Power & Light (FPL) regarding the hazard. He stated that FPL trimmed the tree and later advised that the trimming caused significant damage and recommended removal. He stated that an ISA Certified Arborist was contacted and determined the tree posed an unacceptable risk and recommended removal. He advised that a contractor was scheduled to remove the tree; however, the City issued a stop work order because the contractor did not have the arborist documentation available onsite. July 14, 2026 Anna Maria City Commission Page 3 of 5 Mr. Kempson provided photographs showing the condition of the tree before FPL trimming, after FPL trimming, and its current condition. He stated that the tree was no longer providing meaningful shade, had been significantly damaged, and requested permission to remove the remaining portion of the tree. He also stated that the property owner was willing to install native landscaping and work with the City on replacement options. The Commission questioned the applicant regarding the timing of the arborist report, the removal process, and additional cuts visible on the tree Attorney Chicone advised that the hazardous tree exemption requires documentation supporting the hazard determination prior to removal work. She noted that the arborist report submitted was dated after photographs showing damage had already occurred. Mr. Kempson stated that an earlier arborist letter had been provided but required corrections and additional documentation. He acknowledged responsibility for ensuring the documentation was complete. Public Works Manager Dean Jones was sworn in and provided testimony regarding the condition of the tree. Mr. Jones stated that the tree had been a significant and attractive tree and that Public Works had recently performed maintenance in the area. He stated that, based on his observations, the tree damage appeared to have occurred from removal activity using equipment and was not caused solely by FPL trimming. The Commission discussed potential remedies, including: 1. Replacement of the removed Grand Tree with a comparable tree meeting City requirement; or 2. Payment into the City’s tree fund in an amount equivalent to the cost of replacement. Attorney Chicone explained that staff would need to provide a formal recommendation regarding replacement costs, including tree cost, staff time, and other associated expenses, before the Commission could make a final determination. Commission discussed the difficulty of replacing a 29-inch DBH tree with a comparable specimen and the associated costs. Mr. Jones estimated that a comparable native replacement tree could cost at least $5,000, while Commissioners noted that costs for larger mature trees could be significantly higher. Mr. Kempson stated that he would prefer consideration of younger native trees that could establish and grow over time but remained open to working with the City regarding the final landscaping solution Motion: Commissioner McMullen moved Commissioner Arendt seconded, and the motion carried 4-0 to continue consideration of mitigation/remedy requirements to the next City Commission meeting pending staff recommendations. Approval of a Change Order with Tangerine Group - added Mayor Short presented a change order for installation and later removal of protective matting along the pier walkway during demolition and remediation work. Motion: Commissioner McMullen moved Commissioner Morgan-Johnson seconded and the motion carried 4-0 to approve the Change Work Order with Tangerine Group for installation and later removal of protective matting along the pier walkway. 6. CAPITAL PROJECTS UPDATE – MAYOR/JONES Public Works Manager Dean Jones provided an update on several ongoing capital improvement projects. He reported that installation of the electrical panel platform at the City Pier is underway and that the electrical equipment has been relocated to the side of the structure to preserve public views. Protective fencing has been installed around the work area and a gate will be added as construction progresses. Mr. Jones also announced that the Tangerine Group completed construction of the new seawall the previous week. Final site restoration, including seeding of disturbed areas, is underway. He commended both Tangerine Group and Tampa Bay Marine for their quality of work and stated that the projects have progressed without significant issues. 7. MAYOR’S COMMENTS Mayor Short announced that the Fiscal Year budget kickoff workshop will be held on Thursday, July 16, 2026, at 2:00 p.m. in the Commission Chambers. He explained that the workshop will introduce the Commission and the public to the City's budget development process and establish the schedule for the upcoming budget season. Mayor Short also reported that the mandatory pre-bid meeting for the City Pier finishing work had been completed, with three contractors in attendance. ADJOURNMENT Chair Salem adjourned the meeting at 11:34 a.m. Minutes Approved: ____________________________________ City Clerk, Amber LaRowe City of Anna Maria Agenda Meeting Date: July 14, 2026 Subject: Manatee County Sheriffs Office 2027 Agreement Presenter: Mayor Short The City of Anna Maria contracts with the Manatee County Sheriff's Office (MCSO) to provide law enforcement services within the City. The current agreement expires September 30, 2026. The proposed agreement provides for continued law enforcement services from October 1, 2026, through September 30, 2027. Under the proposed agreement, MCSO will provide: • One (1) Sergeant and eight (8) full-time certified deputies assigned to the City. • Full-time law enforcement protection and enforcement of City, County, and State laws and ordinances. • Marked patrol vehicles, radios, computers, uniforms, and necessary law enforcement equipment. • Supervision, training, personnel management, and administrative support. • Monthly statistical reporting and law enforcement activity data upon request. • Availability of specialized resources, including Marine Patrol support when requested and available. The agreement requires MCSO to maintain a minimum complement of nine (9) full-time law enforcement officers assigned to the City throughout the term of the agreement. The total cost of the agreement for Fiscal Year 2026-2027 is $1,732,636.18, representing an increase of $110,895.92 (6.8%) over the prior fiscal year. The increase is primarily attributable to: • Personnel salary adjustments. • Increased Florida Retirement System (FRS) contribution rates. • Health insurance cost increases. • Adjustments related to personnel assignments. The agreement also authorizes reimbursement for special event overtime costs, not to exceed $4,200 during the fiscal year. Payments will be made in equal monthly installments beginning October 15, 2026. Bayfront Park is a significant regional attraction utilized by residents and visitors throughout Manatee County and receives a substantial number of visitors annually. The City of Anna Maria currently contracts with the Manatee County Sheriff’s Office for law enforcement services within the City limits. The proposed Interlocal Agreement between Manatee County and the City establishes the mutual responsibilities of both parties regarding the provision of additional law enforcement services at Bayfront Park. Agreement Summary Under the terms of the Interlocal Agreement, the City will continue utilizing uniformed Manatee County Sheriff’s Office deputies to provide law enforcement services and patrol Bayfront Park. Officers will enforce applicable federal, state, county, and municipal laws while providing a visible law enforcement presence within the park. The City will provide Manatee County with monthly incident reports received from the Manatee County Sheriff’s Office related to activity at Bayfront Park. In consideration of the City providing these services, Manatee County will provide funding assistance in the amount of $10,560.00 annually to offset the cost of law enforcement services. Payment will be made each fiscal year on December 1, subject to the City fulfilling its obligations under the Agreement and the County’s annual appropriation of funds. The Agreement will remain in effect through September 30, 2026, unless terminated in accordance with the Agreement, and may be renewed annually upon approval by both governing bodies. Fiscal Impact The City will receive $10,560.00 in funding assistance from Manatee County to support the cost of providing law enforcement services at Bayfront Park. The funding is subject to annual appropriation by the Manatee County Board of County Commissioners. ______________________________________ INTERLOCAL AGREEMENT regarding LAW ENFORCEMENT SERVICES FOR BAYFRONT PARK _______________________________________ MANATEE COUNTY, FLORIDA CITY OF ANNA MARIA, FLORIDA _______________________________________ Interlocal Agreement (“Interlocal Agreement” or “Agreement”) is made and entered into as of the ____ day of_______, 2026, by and between Manatee County, a political subdivision of the State of Florida, hereinafter referred to as the “County”, and the City of Anna Maria, a municipal corporation created and existing under the laws of the State of Florida, hereinafter referred to as the “City”. RECITALS WHEREAS, the City, an incorporated municipality within the County, has contracted with the Manatee County Sheriff’s Office providing law enforcement services within the corporate limits of the City; and WHEREAS, the County maintains and operates the beachfront park known as Bayfront Park (hereinafter the “Park”) within the corporate limits of City; and WHEREAS, the Park is a primary attraction for over two million tourists visiting the County each year, and the Park provides a recreation facility for all residents and visitors of the County; and WHEREAS, the Board of County Commissioners has determined that the provision of additional law enforcement services at the Park will enhance the tranquility of the Park, reduce crime, preserve the County’s primary tourist attraction and otherwise provide a real and substantial benefit to the entire County; and WHEREAS, Section 163.01, Florida Statutes, the “Florida Interlocal Cooperation Act”, permits the County and City to enter into this Interlocal Agreement to exercise the powers, privileges and authority which they share in common and which each might exercise separately, in order to make the most efficient use of their powers; and 1 WHEREAS, the County and the City wish to enter into this Interlocal Agreement to establish their mutual rights and obligations with respect to providing law enforcement services for the Park. NOW, THEREFORE, in consideration of the mutual covenants and conditions contained herein, the County and the City agree as follows: Article I AUTHORITY This Interlocal Agreement is entered into pursuant to the powers and authority granted to the parties hereto under the Constitution and laws of the State of Florida, including expressly (but not limited to) Sections 1 and 2 of Article VIII of the Constitution of the State of Florida, Chapters 125 and 166 of Florida Statutes and Section 163.01 of Florida Statutes. Article II LAW ENFORCEMENT SERVICES 2.1 Law Enforcement Services. Commencing October 1, 2025, the City shall contract with Manatee County Sheriff’s Office to provide uniformed law enforcement officers (the “Officer” or “Officers”) to patrol the Park in accordance the following conditions: A. The City covenants and represents to the County that it is providing sworn officers from Manatee County Sheriff’s Office to patrol Bayfront Park and shall enforce all federal, state, County and municipal laws. 2.2 Reports of the City. The City shall provide the County with the following reports during the fiscal year: Copies of Incident Reports from the Manatee County Sheriff’s Office, as provided to the City on a monthly basis. Reports shall be submitted electronically, via email address: danielle.salyer@mymanatee.org with copies to chet.brown@mymanatee.org and cheryl.thompson@mymanatee.org. 2.3 County Funding of Services. Subject to the City performing each of its obligations under this Interlocal Agreement, commencing October 1, 2025 the County shall provide funding to the City in the amount of ten thousand five hundred sixty dollars ($10,560.00) to assist with the cost of providing police law enforcement services to the Park in accordance with this Interlocal Agreement. Payment of such funds shall be made for each fiscal year on December 1. 2 2.4 Annual Appropriation. The County’s obligation under Section 2.3 beyond fiscal year 2025/2026 shall be contingent upon the County Commission’s annual budgeting and appropriation of legally available funds. 2.5 Indemnification, Legal Relationship and Third Parties. A. The City and County agree that each party will be liable for the negligent acts or omissions of its own employees only and will be responsible for worker's compensation coverage and claims only of its own employees. B. The parties are not partners, joint ventures or joint employers, and the employees of each party shall not be considered or treated as employees of the other for any purpose. C. Each party, as a political subdivision as defined by Florida Statute § 768.28, shall indemnify each other party, defend and hold it harmless as to any claim, judgment, or damage award whatsoever arising out of or related to that indemnifying party’s own negligent or wrongful acts or omissions, to the extent permitted by law. The parties understand that pursuant to Florida Statute § 768.28(19), no party is entitled to be indemnified or held harmless by another party for its own negligent or wrongful acts or omissions. Nothing herein is intended to serve as a waiver of sovereign immunity by any party to which sovereign immunity may be applicable, and each party claims all of the privileges and immunities and other benefits and protections afforded by Florida Statute § 163.01(9). The parties to this Agreement do not intend that this Agreement benefit any third party, and nothing herein should be construed as consent by a state agency or political subdivision of the State of Florida to be sued by third parties in any matter arising out of this Agreement. Article III TERM AND TERMINATION. 3.1 Effective Date. This Interlocal Agreement shall take effect in accordance with Section 5.10. 3.2 Termination. Unless terminated for cause in accordance with applicable law, or renewed pursuant to Section 3.3, this Interlocal Agreement shall terminate on September 30, 2026. 3.3 Renewal. Subject to the approval by the County’s Board of County Commissioners and the City’s City Council, the City and the County may renew this Interlocal Agreement for an additional one-year on an annual basis. 3 Article IV AMENDMENTS; ENFORCEMENT 4.1 Amendments Generally. This Interlocal Agreement may be amended, and its material provisions may be waived, only by written instrument expressly approved for the County by the Board of County Commissioners and for the City by the City Council, and only if properly executed by all the parties hereto. 4.2. Enforcement. The parties to this Interlocal Agreement shall have all legal and equitable remedies provided by Florida law for enforcement hereof. Article V MISCELLANEOUS PROVISIONS 5.1 Validity. After consultation with their respective legal counsel, the County and the City each represents and warrants to the other its respective authority and power under Florida law to enter into this Interlocal Agreement, acknowledges the validity and enforceability of this Interlocal Agreement, and waives any future right of defense based on claim of illegality, invalidity or unenforceability of any nature. The City and the County each hereby represents, warrants and covenants to and with the other (i) that this Interlocal Agreement has been validly approved by its respective governing body at a duly held public meeting, and (ii) that this Interlocal Agreement constitutes a legal, valid and binding contract enforceable against the respective party in accordance with the terms hereof (assuming the due authorization, execution and delivery hereof by the other party hereto). 5.2 No General Obligation. Notwithstanding any other provisions of this Interlocal Agreement, the obligations undertaken by the parties hereto shall not be construed to be or constitute general obligations, debts or liabilities of the City, the County or the State of Florida or any political subdivision thereof within the meaning of the Constitution and laws of the State of Florida, but shall be payable solely in the manner and to the extent provided in or contemplated by the respective authorizing instruments and this Interlocal Agreement. 5.3 Force Majeure. No party shall be liable for any failure to perform, or delay in the performance of, any obligation under this Interlocal Agreement if such failure is caused directly by hurricane, tornado, fire, earthquake, civil commotion or failure or disruption of utility services, or other like cause beyond the reasonable control of the party obliged to perform. 5.4 Ambiguities. Both parties have been allowed equal input regarding the terms and wording of this Interlocal Agreement and have had the benefit of consultation with legal counsel prior to its execution, such that all language herein shall be construed equally against the parties, and no language shall be construed strictly against its drafter. 4 5.5 Headings; Pronouns. The headings or captions of sections or paragraphs used in this Interlocal Agreement are for convenience of reference only and are not intended to define or limit their contents, nor are they to affect the construction of or to be taken into consideration in interpreting this Interlocal Agreement. All pronouns and any variations thereof shall be deemed to refer to the masculine, feminine and neuter, singular or plural, as the identities of the party or parties, personal representatives, subcontractors, successors or assigns may require. 5.6 Severability. The provisions of this Interlocal Agreement are declared by the parties to be severable. 5.7 Governing Law; Venue. This Interlocal Agreement shall be governed by and construed in accordance with laws of the State of Florida, and venue for any action arising out of or related to this Interlocal Agreement shall be in the Circuit Court for the Twelfth Judicial Circuit in Manatee County, Florida. 5.8 Full Agreement; Filing with Clerk of Circuit Court. This Interlocal Agreement contains the entire agreement of the parties with respect to the matters addressed herein. Previous agreements and understandings of the parties, with respect to such matters are null and void and of no effect. As required by Subsection 163.01(11) of Florida Statutes, this Interlocal Agreement and all amendments thereto shall be filed with the Clerk to the Circuit Court for Manatee County (the “Clerk”). 5.9 Notices. A permit was issued and work began in November of 2025. During an inspection in March of 2026, the City’s inspector observed work performed that exceeded the scope of the issued permit resulting in a Stop Work Order. The unpermitted work was removed within several days and as such, the Stop Work Order was lifted. The permitted improvements have since passed all inspections and the project was successfully completed in June of 2026. After parting ways with the original contractor, the Knights have hired a new General Contractor to properly obtain a permit for the work that was previously removed. In an effort to recoup some of the financial loss suffered because of the original contractor’s missteps, the Knights are requesting a building permit fee waiver in the amount of $1,111.94 (Exhibit A). According to the City’s Fee Schedule, fees may be waived by the City Commission.
