Town of Archer Lodge AGENDA Board of Adjustment Special Meeting Tuesday, July 21, 2026 @ 5:30 PM Jeffrey D. Barnes Council Chambers NCGS § 143-318.17. Disruptions of official meetings. A person who willfully interrupts, disturbs, or disrupts an official meeting and who, upon being directed to leave the meeting by the presiding officer, willfully refuses to leave is guilty of a Class 2 misdemeanor. 1. WELCOME/CALL TO ORDER: 1.a. Invocation 1.b. Pledge of Allegiance 2. NEW BUSINESS: 2.a. Quasi-Judicial Public Hearing on a Variance Application submitted by Abdo Sharhan of Sharhan Properties LLC for a variance from the Perimeter Buffer standards (Ch. 30-Article 6-Division 5-Sec. 30-6501(k) Perimeter buffers) to redevelop the property as a gas station, on a 1.87 acre lot at 13785 Buffalo Road, Archer Lodge, NC. This property is owned by Sharhan Properties LLC and is referenced as Johnston County parcel tag id number 16J03037D. Conduct of Quasi-Judicial Evidentiary Hearing: 1. Town Attorney - Swear in Witnesses (including staff, who intend to present evidence) 2. Chair of the Board - Call Case as Stated on the Agenda 3. If applicant is to be represented by anyone other than a licensed attorney, the applicant shall request the consent of the Board of Adjustment. 4. Members of the Board of Adjustment to Disclose the Following:  Any Site Visits  Ex Parte Communications  Specialize Knowledge They Have Relevant to the Case  Fixed Opinion That is Not Susceptible to Change Based on What They Learn  Conflict of Interest Page 1 of 2  Financial Interest; and  Any Other Information Relevant to Determining Whether a Conflict of Interest Exists ** Board of Adjustment to Vote on Recusal of Member if Any Conflict Exists. Note: The Applicant or Other Affected Persons May Present Any Objections Regarding a Member's Participation. ** 5. Chair of the Board - Open the Hearing 6. Staff Report 7. All Parties Represented by Attorneys, the Applicant, Followed by Any Opposing Party, May Present a Brief Opening Statement 8. Applicant - Present Arguments and Evidence in Support of the Application 9. Persons Opposed to Granting the Application Shall Present Arguments and Evidence Against 10. Opportunity for Cross-Examination 11.After All Evidence Has Been Presented, the Chair of the Board May Ask the Parties if There is Additional Relevant Information that has Not Been Presented that Would Make a Continuance in Order 12. The Chair of the Board will Entertain Objections and Rule on the Admissibility of the Evidence or Exhibit 13. The Chair of the Board - Close the Hearing Unless the Hearing Has Been Continued to the Next Scheduled Quasi- Judicial Hearing or to a Publicly Stated Date, Time, and Location 14. The Chair of the Board - Calls for a Vote on Each of the Findings of Fact/Conclusions for the Variance Permit  Must Receive a Super Majority Vote of the Board of Adjustment for the Application to be Approved.  The Board of Adjustment May Attach Conditions of Approval in Accordance with Existing State Law and Town Code 15.
