PUBLIC HEARING An ordinance of the City Council of the City of Berkley, Michigan to amend Section 2.02 Definitions and Section 6.03.C Use Groups, to add Section 8.23 Data Centers and to amend Section 14.04.Q Off-Street Parking Requirements of Chapter 138 Zoning of the City of Berkley Code of Ordinances to add definitions for various types of data centers, to regulate where data centers are permitted, to add off-street parking requirements for data centers and to add regulations for data centers. Planning Consultant Marin summarized the proposed amendments and the changes since the Planning Commission’s previous discussions of the proposed amendment. Chair Kempner opened the public hearing at 7:10PM. No one wished to speak and there were no comments received. Chair Kempner closed the public hearing at 7:10PM. The Planning Commission asked clarifying questions and asked that the following corrections be included:  Typographical errors for sound requirements be adjusted to allow greater decibels during the daytime and less at night for both continuous and impulse noise.  Add “must” to failure to report constitutes a zoning violation. Date: July 14, 2026 Background  The applicant is proposing to occupy a vacant suite at the recently constructed office building at 3462 Greenfield Rd. with a medical spa use.  The zoning of the property is Residential Corridor District, which permits medical spas as special land uses.  No site improvements are proposed and the plans are for reference purposes only.  The Planning Commission held the required public hearing and recommended approval of the request on July 14, 2026. Summary  An analysis of the special land use standards is provided in the staff review. Recommendation Motion to (recommend approval/recommend denial/postpone) the special land use approval for PSU-01- 26, Sugarcoated, for 3462 Greenfield Rd. because the proposal meets all of the standards in Chapter 138, Section 10.03 of the City of Berkley Zoning Ordinance. MEMORANDUM To: Ashley Coleman of Sugarcoated, Applicant From: Kristen Kapelanski, Community Development Director Subject: PSU-01-26: 3462 Greenfield Rd. Date: May 13, 2026 The applicant has requested to operate a medical spa in a tenant space at the recently developed office building at 3462 Greenfield Rd. Background The current zoning of the parcel is Residential Corridor. The site type (medium) and street type (corridor) allow medical spas as special land uses in the Residential Corridor District. The subject property was recently developed under the standards of the previous Zoning Ordinance. Special Land Use Standards Special land uses require the approval of the City Council after a recommendation from the Planning Commission. Standards listed in the ordinance for consideration of a special land use request are identified below. Staff comments are italicized.  Compatibility with Adjacent Uses: The special land use must be designed and constructed in a manner harmonious with the character of adjacent properties and the surrounding area, as compared to the impacts of permitted uses. The impacts from a small medical spa use would not be greatly different from those of a small medical office tenant, which was originally approved for the site. Additionally, adequate buffering has been provided from the residential uses to the rear and the site fronts a major thoroughfare.  Compatibility with the Master Plan: The proposed special land use must be compatible and in accordance with the goals and objectives of the City of Berkley Master Plan and any associated sub-area and corridor plans, including the Downtown Master Plan. While the master plan recommends attached and multi-family residential uses for this area of the City, it is important to note that the site was recently approved for offices (under the old zoning ordinance) and office and retail uses exist along this corridor.  Traffic Impact: The proposed special land use must be located and designed in a manner that will minimize the impact of traffic, taking into consideration the following: pedestrian access and safety; vehicle trip generation; types of traffic; access location and design; loading and unloading; circulation; parking design; street and bridge capacity; and traffic operations at nearby intersections and access points. Efforts must be made to ensure that multiple transportation modes are safely and effectively accommodated in an effort to provide alternate modes of access and alleviate vehicular traffic congestion. The site fronts a major thoroughfare and traffic impacts from a medical spa space will not lead to any concerns.  Impact on Public Services: The proposed special land use must be adequately served by essential public facilities and services, such as streets, pedestrian or bicycle facilities, police and fire protection, drainage systems, refuse disposal, water and sewage facilities and schools. Such services must be provided and accommodated without an unreasonable public burden. This is a recently developed site served by public utilities and with stormwater detention.  Compliance with Zoning Standards: The proposed special land use must be designed, constructed, operated and maintained to meet the stated intent of the zoning district and must comply with applicable ordinance standards. The applicant is intending to occupy this recently developed site as is. The site already contains buffering, landscaping and lighting that match or closely match current Zoning Ordinance standards. No alterations or additions are required to meet the intent of the Zoning Ordinance.  Impact on the Overall Environment: The proposed special land use must not unreasonably impact the quality of the natural features and the environment in comparison to the impacts associated with typical permitted uses. The applicant is proposing to use an already developed site and no new environmental impacts are proposed.  Special Land Use Approval Specific Requirements. The general standards and requirements of this section are basic to all uses authorized by special land use approval. The specific and detailed requirements relating to particular uses and area requirements must also be satisfied for those uses. There are no specific use requirements for medical spas.  Additional Factors: The following factors must also be considered by the Planning Commission when reviewing a special land use request. o The nature and character of the activities, processes, materials, equipment or conditions or operation, either specifically or typically associated with the use. o Vehicular circulation and parking areas. o Outdoor activity, storage and work areas. No outdoor storage or work areas are proposed. o Hours of operation. Hours of operation are 9AM to 6PM. o Production of traffic, noise vibration, smoke, fumes, odors, dust, glare, light or other public nuisances. General Zoning Ordinance Standards  Non-conforming Site Standards: Per Article 16 of the Zoning Ordinance, non-conforming lots and structures may be used for a permitted or special land use in the applicable district provided the non-conformity is not increased. Any additions or other site changes would need to comply with current zoning ordinance standards. The applicant is not proposing any site changes.  Special Land Use Considerations: Since a medical spa is considered a special land use in the Residential Corridor District, the Planning Commission and City Council have some discretion in PSU-01-26 3462 Greenfield Rd. 2|P a g e determining if the site layout (as-is) meets the intent of the Zoning Ordinance and Master Plan. Given that the site was recently developed, provides greenspace and complies with lighting standards, no additional site updates are recommended by staff.  Parking Requirements: The site was originally envisioned with professional and medical office tenants in mind and was parked per the parking standards in the previous Zoning Ordinance. This would be considered part of the non-conformities of the site. Medical spas have the same parking requirements as medical offices, which was an anticipated use on the site. Adequate parking is provided to accommodate this use.
