IMPROVEMENT FUND FOR DOCUMENT IMAGING
BE IT ORDAINED by the Borough Council of the Borough of Bernardsville, in
the County of Somerset, New Jersey, as follows:
Section 1. The sum of $200,000 as appropriated from the capital improvement
fund for document imaging.
Section 2. This ordinance shall take effect immediately upon final passage and
publication as required by law.

AUTHORIZING THE PURCHASE OF VEHICLE PARTS AND REPAIR SERVICES
FROM VENDORS UTILIZING COOPERATIVE PURCHASING CONTRACTS, NEW
JERSEY STATE CONTRACTS, OR PRE-ESTABLISHED DISCOUNT PRICING
WHEREAS, the Borough of Bernardsville has a continuing need to procure vehicle parts,
maintenance, and repair services for the Borough's fleet, including Police Department vehicles;
and
WHEREAS, the Borough may purchase goods and services through nationally recognized
cooperative purchasing programs, New Jersey State Contracts, or from vendors offering
established discounted pricing in accordance with applicable provisions of the Local Public
Contracts Law, N.J.S.A. 40A:11-1 et seq.; and
WHEREAS, utilizing cooperative purchasing contracts, State Contracts, and pre-negotiated
discount pricing provides the Borough with competitive pricing while ensuring the timely
procurement of necessary vehicle parts and repair services;
NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of
Bernardsville as follows:
1. The Borough is hereby authorized to purchase vehicle parts, maintenance, and repair
services from vendors participating in approved cooperative purchasing programs, New
Jersey State Contracts, or offering established discounted pricing, as permitted by law.
2. Such purchases shall be made only when funds have been duly appropriated and certified
by the Chief Financial Officer and shall comply with all applicable purchasing
regulations and Borough policies.
3. This Resolution shall remain in effect through 12/31/2026.

FY27 TRANSIT VILLAGE GRANT PROGRAM FOR THE COMPLETION OF THE
OLCOTT SQUARE AND BERNARDSVILLE PEDESTRIAN SAFETY IMPROVMENT

NOW, THEREFORE, BE IT RESOLVED that the Council of the Borough of Bernardsville
formally approves the grant application for the above stated project; and
BE IT FURTHER RESOLVED that the Mayor and Clerk are hereby authorized to submit an
electronic grant application identified as TV-2027-Olcott Square and Bernardsville Trai-00008 to
the New Jersey Department of Transportation on behalf of the Borough of Bernardsville; and
BE IT FURTHER RESOLVED that the amount of the grant is $805,681.50; and
BE IT FURTHER RESOLVED that Mayor and Clerk are hereby authorized to sign the grant
agreement on behalf of the Borough of Bernardsville and that their signature constitutes
acceptance of the terms and conditions of the grant agreement and approves the execution of the
grant agreement.

NOW, THEREFORE, BE IT RESOLVED by the Borough Council to approve Change Order

00344 in the amount of $17,896.76. The final contract amount of $296,569.00 represents an
increase of 9.96%.

Project 2024-MA-00344 in the amount of $8,975.
FURTHER RESOLVED, the final increase of $8,975 accounts for the signage & striping
revisions completed by Straight Edge Striping. This increases the Final Contract Price to
$296,871.76.

(FROM CENTER STREET TO WEST STREET), WEST STREET, CENTER STREET,
AND PROSPECT STREET, IN THE AMOUNT OF $156,213 FOR ROAD
IMPROVEMENT RESERVES
WHEREAS, during 2025, New Jersey American Water (NJAW) replaced water mains on
Boylan Terrace (from Center Street to West Street), West Street, Center Street, and Prospect
Street; and
WHEREAS, NJAW planned standard trench restoration and pave full the widths of Boylan
Terrace (from Center Street to West Street), West Street, Center Street, and Prospect Street; and
WHEREAS, the Borough of Bernardsville has plans to fully pave Boylan Terrace (from Center
Street to West Street), West Street, Center Street, and Prospect Street as part of its regular
pavement management plan; and
WHEREAS, Kevin Murray, Public Works Director, confirmed with NJAW that in lieu of the
full-road payment restoration of Boylan Terrace (from Center Street to West Street), West Street,
Center Street, and Prospect Street. NJAW will provide a one-time non-refundable payment to
the Borough of Bernardsville for the Borough to retain a contractor to conduct the restoration.
NOW THEREFORE BE IT RESOLVED, that in lieu of full-road width pavement restoration
of Boylan Terrace, New Jersey American Water will:
1. Perform standard Trench Restoration; and
2. Pay the Borough of Bernardsville $156,213 for Boylan Terrace (from Center Street to West
Street), West Street, Center Street, and Prospect Street to be held in reserve for Road
Improvements.

ROAD RESURFACING (MILLING AND PAVING – DISTRICT 1)
WHEREAS, the Borough of Bernardsville is a member and participant in the Morris County
Cooperative Pricing Council (“MCCPC”) in 2026; and
WHEREAS, the Public Works Director is seeking a proposal through the MCCPC to mill and
pave the following streets Crest Drive Section 2 (Club Lane to dead end), Center Street from
Bernards Avenue to Prospect Street, Maple Village Court, Brookside Avenue, Dobbs Street,
Sunnybrook Road, Sunset Drive, Winding Way, Prospect Street from Mount Airy Road to Center
Street, Douglass Avenue from Mine Brook Road to #41; and
WHEREAS, Schifano Construction Corp provided the Borough of Bernardsville a proposal &
contract which bidding has been completed trough the MCCPC; and
WHEREAS, the cost of mill and paving of the streets listed above is for an amount of $550,000
subject to the “as built” quantities as measured in the field and Asphalt Price Index and Fuel Price
Index.
NOW, THEREFOR, BE IT RESOLVED by the Borough Council of the Borough of
Bernardsville to authorize the issuance of a purchase order for 2026 milling and paving of the
streets mentioned above.

RESOLUTION #26-172
GOVERNING BODY CERTIFICATION OF THE ANNUAL AUDIT (2025)
WHEREAS, N.J.S.A. 40A:5-4 requires the governing body of every local unit to have made an annual
audit of its books, accounts and financial transactions; and
WHEREAS, the Annual Report of Audit for the year 2025 has been filed by the Registered Municipal
Accountant with the Borough Clerk pursuant to N.J.S.A. 40A:5-6, and a copy has been received by each
member of the governing body; and
WHEREAS, R.S. 52:27BB-34 authorizes the Local Finance Board of the State of New Jersey to prescribe
reports pertaining to the local fiscal affairs; and
WHEREAS, the Local Finance Board has promulgated N.J.A.C. 5:30-6.5, a regulation requiring that the
governing body of each municipality shall, by resolution, certify to the Local Finance Board of the State
of New Jersey that all members of the governing body have reviewed, as a minimum, the sections of the
annual audit entitled “Comments and Recommendations”; and
WHEREAS, the members of the governing body have personally reviewed, as a minimum, the Annual
Report of Audit, and specifically the sections of the Annual Audit entitled “Comments and
Recommendations”, as evidenced by the group affidavit form of the governing body attached hereto; and
WHEREAS, such resolution of certification shall be adopted by the governing body no later than forty-
five days after the receipt of the annual audit, pursuant to N.J.A.C. 5:30-6.5; and
WHEREAS, all members of the governing body have received and have familiarized themselves with, at
least, the minimum requirements of the Local Finance Board of the State of New Jersey, as stated aforesaid
and have subscribed to the affidavit, as provided by the Local Finance Board; and
WHEREAS, failure to comply with the regulations of the Local Finance Board of the State of New Jersey
may subject the members of the governing body to the penalty provisions of R.S. 52:27BB-52 - to wit:
R.S. 52:27BB-52 - "A local officer or member of a local governing body who, after
a date fixed for compliance, fails or refuses to obey an order of the director (Director
of Local Government Services), under the provisions of this Article, shall be guilty
of a misdemeanor and upon conviction, may be fined not more than one thousand
dollars ($1,000.00) or imprisoned for not more than one year, or both, in addition
shall forfeit his office."
NOW, THEREFORE, BE IT RESOLVED, that the governing body of the Borough of
Bernardsville, hereby states that it has complied with N.J.A.C. 5:30-6.5 and does hereby submit a
