Call to Order/Roll Call NO ACTION TAKEN 2. Convene into Executive Session CONVENED Upon a public majority vote, the Mayor and Council will convene into Executive Session pursuant to: a) A.R.S. Section 38-431.03 (A.3) and A.R.S. Section 38-431.03 (A.4) for discussion or consultation for legal advice with the attorney or attorneys of the public body and for discussion and consultation with the attorney or attorneys of the public body in order to consider its position and instruct its attorneys regarding the public body’s position regarding litigation in the City of Buckeye vs. Rubcorp Distribution LLC, a Delaware limited liability company, Maricopa County Superior Court Case No. CV2025-011076, including discussion of litigation strategy, settlement discussion, and settlement authority; and, b) A.R.S. Section 38- 431.03 (A.3) for discussion or consultation for legal advice with the attorney or attorneys of the public body regarding strategic water policies and the City’s application for an Alternative to Designation of Assured Water Supply. 3.
