CALL TO ORDER AND AGENDA City Council President Tracy called the meeting to order at 9:19 PM. MOTION by Councilor Magee, SECOND by Councilor Mason, to adopt the agenda. VOTING: unanimous; motion carries. 2. CONSENT AGENDA 2.01 Motion to adopt the consent agenda and take the actions as indicated 2.02 Communication: C/T Office, re: Notice of City of Burlington Full Board of Abatement of Taxes - waive the reading, accept the communication and place it on file. 2.03 Request for Abatement of Taxes: CASGVT, LLC, Rina Schneur, 93-95 Brookes Avenue, 045-4-040-000 - deny the abatement request of $1,320.60 and adopt the findings and reasons for this recommendation. 2.04 Request for Abatement of Taxes: Thomas E. Halpin, Jr., Richard Wolbach, 96 Wildwood Drive, 028-4-080-000 - grant the abatement of penalties in the amount of $89.60 and adopt the findings and reasons for this recommendation. 2.05 Request for Abatement of Taxes: Richard M. and Peg Boyle Single, 58 Case Parkway, 046-2-075-000 - grant the abatement of taxes for $26,612.54 and adopt the findings and reasons for this recommendation. 2.06 Request for Abatement of Taxes: Adrian Ivakhiv and Auriel Gray, 51 Northshore Drive, 021-2-211-051 - grant in part the abatement of penalties and interest in the amount of $518.03 and adopt the findings and reasons for this recommendation. MOTION by Councilor Mason, SECOND by Councilor Freeman, to adopt the consent agenda and take the actions as indicated for items 2.01-2.06. VOTING: unanimous; motion carries. 3. DELIBERATIVE AGENDA 3.01 Request for Abatement of Taxes: Falls Properties Corporation, Miguel J. Larach, c/o Deborah Larach Baad, 40 College Page 2 of 3 Full Board Of Abatement Of Taxes Meeting - Monday, February 7, 2022, REMOTELY via ZOOM 2/7/2022 Street, Unit 307, 049-1-087-307 City Assessor Vickery summarized the request, saying that the applicants are asking for an abatement of $3,691.82. He said that the Committee voted to deny that request. He outlined the findings of fact, noting that the bank account was closed for unknown reasons, the daughter lives in Florida, where the mail from the City went. The father was out of the country and was not able to come to the U.S. due to Covid. Deborah Larach Baad said that the property owner was unwell and that she had not been attending to his mail. She said that he had not received mail or notices related to taxes owed. She said that she later found out about the taxes owed and is trying to make things right. She said that they are asking for an abatement of penalties and interest, and that the taxes they owe are on a schedule to be paid. City Assessor Vickery said that because the mail immediately went to the daughter’s residence in Florida, this situation is not manifestly unjust. Councilor Mason noted that the City typically takes the position that absent an error by the City, these fees and penalties should apply. He said that the address on record was accurate and that the notices did go out appropriately. Councilor Freeman agreed with Councilor Mason, saying that the stated reasons for the nonpayment of taxes don’t rise to the level of substantive hardship. MOTION by City Council President Tracy, SECOND by Councilor Mason, to deny the abatement request of $3,691.82 and adopt the findings and reasons for this recommendation.
