Reconvened at 9:15 am VI. COMMISSIONER UPDATES a. Commissioner Haessly gives updates on a variety of topics b. Commissioner updates close at 9:17 am VII. RECISSION MICRO MOBILE KITCHEN a. Micro Mobile Kitchen requests to have contract for 2025 food cart terminated. b. Motion to adopt the staff recommendation brought by Commissioner Haessly, Seconded, Commissioner Monsen c. Discussion on the motion around consistent policy and appropriate fee for vendors looking to terminate their contract. d. Commissioner Magoon makes a friendly amendment to the motion: 10% of the total fee ($150) Seconded by Commissioner Von Hermann e. VOTE: passes unanimously VIII. MENU CHANGE MATHEW’S MONTREAL FAMOUS a. Request by Mathew’s Montreal Famous to return to their original food care menu. b. Motion to adopt the staff recommendation brought by Commissioner Haessly, Seconded, Commissioner Magoon c. VOTE: Passes unanimously IX. TREASURER’S REPORT a. Commissioner Tolstoi gives an overview of where the budget stands one-month into the new fiscal year. Nothing of concern. X. DIRECTOR’S REPORT a. Director McGinnis gives a variety of updates including upcoming events, city wide updates, store vacancies, RFP for 62 Church and more. XI. CHAIR’S REPORT a. Commissioner Bouchett gives a variety of updates including success of Sidewalk Sale, current challenges in the restaurant industry, graffiti initiative by BBA and feedback on the Mayor’s Virtual Town Hall. Vote not taken Commission fails to have a quorum of members present Commission adjourns due to lack of quorum Page 5 of 7 To: Church Street Marketplace Commission From: Samantha McGinnis, Director Date: July 11, 2025 Re: Rescission of Micro Mobile Kitchen Contract Background: Daryoush Khamnei is the owner/operator of the food cart, Micro Mobile Kitchen. His cart joined the Marketplace’s cart vending program in 2024, where he operated his cart along with the community cart program. With this, he allowed new vendors to try their hand at vending using his kitchen and equipment. Micro Mobile Kitchen was a consistent and reliable vendor during the 2024 season and the cart vendor committee openly accepted and approved their application for the 2025 season. The Commission followed the cart vendor committee’s recommendation and approved them as a vendor at the February 2025 commission meeting. Request for Rescission: After the birth of his first child earlier this year, Daryoush had the best intention to continue to vend on the Marketplace. However, as the season began, he realized he would not be able to accommodate vending on the Marketplace along side childcare and has requested the Commission cancel is contract for the 2025 season. He has not operated at all on the Marketplace during the 2025 season and has indicated his intent to apply for the program again in 2026. Recommended Action: Marketplace staff recommends the Commission approve the rescission of Micro Mobile Kitchen’s contract and impose a 20% fee, calculated off of the total value of the contract ($300). Page 6 of 7 To: Church Street Marketplace Commission From: Samantha McGinnis, Director Date: July 14, 2025 Re: Mathew’s Montreal’s Famous Cart Menu and Schedule Change Background: Mathew Panetta is the owner of the food cart, Mathew’s Montreal’s Famous. For the 2025-2026 season, Mathew partnered with Maharaja Spice, a local Indian food truck, to manage his cart and serve food from Maharaja Spice’s menu. At the Church Street Marketplace Commission meeting on May 21, 2025, the Commission approved the menu change. Due to concerns about menu competition with Laliguras, a brick-and- mortar Indian restaurant on the same block, the cart schedule was adjusted to be from 10 pm – 2 am only. Request for Menu and Schedule Change: The business agreement between Maharaja Spice and Mathew’s Montreal’s Famous was dissolved at the end of June, leaving no one to operate Mathew’s cart. In order to remain an active cart on the Marketplace, Mathew is requesting to revert to his original menu of Mediterranean lamb gyros and chicken over rice. His new operating schedule will be Thursday-Saturday 12 pm – 2 am. Recommended Action: Marketplace staff recommends the Commission approve Mathew’s requested menu and schedule change on the condition that no further menu or schedule changes are proposed for this season.
