Purpose The Department of Parks, Recreation and Waterfront (BPRW) seeks approval and recommendation to the City Council that it grant a license to Beansie’s Bus for continued use of the concession area they have been using for decades next to Battery Park, and authorize the Mayor to enter into a license agreement memorializing the terms and conditions of use. II. Background Beansie’s Bus recently celebrated their 80th anniversary with the ownership currently with Tammy Carron. The City has had no issues with the current owner and supports the license request. The most recent agreement with the Carron’s was done under a different city agreement. The attorney’s office determined that it was most appropriate to use the license agreement process for Beansie’s Bus as the location is a long-term occupation of City owned property and involves a vehicle occupying the Right of Way. Beansie’s Bus will pay the Clerk/Treasurer’s office the annual peddlers’ license fee in one lump sum of $500 to cover the five years of the agreement. In addition, they remit 5% of gross revenue monthly to Burlington Parks, Recreation and Waterfront, which we would accept in replacement to the vehicle license endorsement fee. In 2024, the department received $4,502. DEPARTMENT RECOMMENDATION City Council License Committee Motion: To approve and recommend that the City Council approve and authorize the granting of a license to Battery Park, LLC (DBA Beansie’s Bus) to occupy space in the Sherman Street extension from April 1, 2025 – December 31, 2029 for the purpose of carrying on food concession operations; and, to further authorize the Mayor to execute a license agreement with Battery Park, LLC (DBA Beansie’s Bus) and all documents necessary to effect the license, subject to the final review and approval of the City Attorney’s Office.
