Proceedings of the City Council, City of Cape Girardeau, Mo. Regular Session June 1 , 2026 MM- 255 STUDY SESSION— June 1, 2026 NO ACTION TAKEN DURING THE STUDY SESSION The Cape Girardeau City Council held a study session at the Cape Girardeau City Hall on Monday, June 1, 2026, at 5: 00 p.m. with Mayor Robert F. Guard presiding and Council Members Mark Bliss, David Cantrell, Bryan Johnson, Tameka Randle, DeWayne Schaaf and Nate Thomas present. REGULAR SESSION— June 1, 2026 CALL TO ORDER The Cape Girardeau City Council convened in regular session at the Cape Girardeau City Hall on Monday, June 1, 2026, at 5: 16 p.m. with Mayor Robert F. Guard presiding and Council Members Mark Bliss, David Cantrell, Bryan Johnson, Tameka Randle, DeWayne Schaaf and Nate Thomas present. ADOPTION OF THE AGENDA A Motion was made by David J. Cantrell, Seconded by Tameka Randle, to approve and adopt the agenda. Motion passed. 7- 0. Ayes: Bliss, Cantrell, Guard, Johnson, Randle, Schaaf, Thomas. PUBLIC HEARINGS A Public Hearing regarding the proposed operating budget for the fiscal year ending June 30, 2027. Mayor Guard opened the public hearing. There being no appearances, the hearing was closed. A Public Hearing to consider the request of Zenith Enterprises, LLC for a special use permit for the purposes of constructing, maintaining, and operating a vehicle fueling station and convenience store with carry- out fast food on property located at 2090 North Sprigg Street in the NC, Neighborhood Commercial District. The Agenda report in the agenda packet presented for the record, a certified copy of the following items: ( 1) Section 30- 104 entitled" Special Use Permits" from the City Code; ( 2) the application for Special Use Permit; and( 3) the application file. Mayor Guard opened the public hearing There being no appearances, the hearing was closed. CONSENT AGENDA Approval of the May 18, 2026 Regular Session City Council Minutes. BILL NO. 26- 43, an Ordinance approving the record plat of Presley' s Addition. Second and Third Readings. BILL NO. 26- 45, a Resolution authorizing the City Manager to execute a Performance Guarantee Agreement with The Ryland R. Meyr Trust for certain improvements for Baldwin Farms Subdivision, in the City of Cape Girardeau, Missouri. Reading and Passage. Proceedings of the City Council, City of Cape Girardeau, Mo. Regular Session June 1 , 2026 MM- 256 BILL NO. 26- 48, a Resolution authorizing the City Manager to execute a License and Indemnity Agreement with Broadway Theater LLC, for a sidewalk cafe in the right- of-way adjacent to 805 Broadway, in the City of Cape Girardeau, Missouri. Reading and Passage. A Motion was made by Nate Thomas, Seconded by Mark Bliss, to approve and adopt. Motion passed. 7- 0. Ayes: Bliss, Cantrell, Guard, Johnson, Randle, Schaaf, Thomas. Mayor Guard abstained from BILL 26- 48 for financial reasons due to his employment with MRV Banks. BILL NO. 26- 43 will be Ordinance NO. 5910. BILL NO. 26- 45 will be Resolution NO. 3703. BILL NO. 26- 48 will be Resolution NO. 3704. ITEMS REMOVED FROM CONSENT AGENDA Approve the Planning& Zoning Commission's recommendation to deny a request for a special use permit for the purposes of constructing, maintaining, and operating a vehicle fueling station and convenience store with carry-out fast food on property located at 2090 North Sprigg Street in the NC, Neighborhood Commercial District. A Motion was made by Mark Bliss, Seconded by DeWayne Schaaf, to approve and adopt. Motion passed. 7- 0. Ayes: Bliss, Cantrell, Guard, Johnson, Randle, Schaaf, Thomas. NEW ORDINANCES BILL NO. 26- 46, an Ordinance adopting the annual operating budget for the fiscal year beginning July 1, 2026. First Reading. Mayor Guard called for public appearances regarding this Bill. Edward Bauerle, 3916 Hopper Rd., appeared and spoke in regards to tax incentives. A Motion was made by David J. Cantrell Seconded by Bryan Johnson, to approve. Motion passed. 7- 0. Ayes: Bliss, Cantrell, Guard, Johnson, Randle, Schaaf, Thomas. BILL NO. 26- 47, an Ordinance establishing utility rates for the City of Cape Girardeau, Missouri, by amending Chapter 29 relating to Sewer and Water Rates. First Reading. Mayor Guard called for public appearances regarding this Bill. No one appeared. A Motion was made by David J. Cantrell, Seconded by Mark Bliss, to approve. Motion passed. 7- 0. Ayes: Bliss; Cantrell, Guard, Johnson, Randle, Schaaf, Thomas. APPOINTMENTS Appointment to the Board of Appeals A Motion was made by Mark Bliss, Seconded by Nate Thomas, to appoint Bruce Baker to the Board of Appeals for a term expiring June 4, 2031. Motion passed. 7- 0. Ayes: Bliss, Cantrell, Guard, Johnson, Randle, Schaaf, Thomas. Appointment to the Planning and Zoning Commission A Motion was made by David J. Cantrell, Seconded by Nate Thomas, to appoint Larry Patterson to the Planning and Zoning Commission for a term expiring November 1, 2028. Proceedings of the City Council, City of Cape Girardeau, Mo. Jay Goodart, 5899 Langholm Drive, appeared in regards to street repairs in his neighborhood. MEETING ADJOURNMENT A Motion was made by Nate Thomas, Seconded by David J. Cantrell, to adjourn.
