Originating Department: City Clerk Background: Attached is a letter from Cory Fehrenbacher and Shelbi Ladd, two of the owners of Still Woods Bar, LLC dba Stillwoods, located at 300 South Oakland Avenue. They are notifying the Local Liquor Control Commission about the reduction in the number of owners of the legal entity and seeking the approval of a change in operational name from Stillwoods to Oakland Station. Title 2 of the Carbondale Revised Code has two applicable provisions related to this request. The first, 2-4-13.A2, states that a change in ownership that is simply a reduction in the number of owners requires notification to the City, but does not require the approval of the Local Liquor Control Commission, so long as it does not constitute a "successive change in ownership", as outlined in 2-4-13.D of the Code. However, Title 2-4-14.B does require the Local Liquor Control Commission's approval for a change in operational name. Upon approval of the change in operational name, an updated City liquor license reflecting the change in operational name will be issued, as well as a letter addressed to the Illinois Liquor Control Commission outlining the change in ownership. Evidence of the change in ownership will need to be submitted to the Illinois Liquor Control Commission, in addition to updated information from the Secretary of State reflecting the same details. Final Resolution: Motion Yea: None Nay: None June 1, 2026 Local Liquor Control Commission​ Carbondale, IL Re: Change in Ownership Structure and Operational (DBA) Name To Whom It May Concern, We are writing to notify the Local Liquor Control Commission of several planned updates related to our liquor license and business operations. The licensed entity will remain the same legal entity, Still Woods Bar, LLC. However, we are reducing the number of owners/members associated with the LLC, removing John Deas and Alison Smith. Following these ownership changes, the business intends to operate under a new assumed business name (DBA), changing from Stillwoods to Oakland Station. At this time, we have begun the process at the state level by updating the applicable filings with the Illinois Secretary of State. There are no anticipated changes to the nature of our operations. The applicant is a convicted felon who has not been adequately rehabilitated. 5. The issuance of the license can reasonably be expected to create excessive noise, traffic, parking, or litter problems. 6. The applicant has a history of problems with regard to violations of health regulations, laws, and ordinances at prior establishments owned or managed by the applicant. 7. The building in which the applicant seeks to operate does not meet building and zoning code ordinances and regulations. 8. The issuance of the license can reasonably be expected to create a nuisance such as excessive and repeated breaches of the peace. 9. The applicant has previously had a liquor license revoked or suspended in this or any other state or jurisdiction. 10. The applicant is seeking a restaurant license and does not provide sufficient facilities or menu items to operate as a restaurant. D. Conditions On Issuance: If the Commission finds that any change in the applicant's plans is/are needed to create grounds for the issuance of such license, the Commission may require such change(s). A condition on the granting of a license and the failure of the applicant at any time to adhere to or perform such condition shall be considered a violation of this title. An On-Premises Not For Profit license allows a nonprofit entity to sell alcohol for on-premises consumption. The fee for such a license is determined by whether alcohol or video gaming revenues are its principal source of revenue. Organizations that have video gaming terminals will be placed in a higher fee tier of $750.00. The fee for secondary use without video gaming is $100.00. Outstanding Items: A copy of the deed for the property and a Certificate of Insurance are outstanding. An Illinois Business Authorization certificate for the new location will be required. Staff Recommendation: Approve License classification is appropriate for the operation. The applicant currently holds another liquor license at their location on Walnut Street with no notable issues reported.
