Waring Chairperson PETITION FOR PARTIAL CLOSURE OF STREET PURSUANT TO SOUTH CAROLINA CODE SECTION 5-27-150 THIS PETITION is respectfully submitted to the Mayor and Members of City Council of the City of Charleston, South Carolina, this ___ day of July, 2015 by Sam Gilchrist an individual and resident of the City of Charleston, South Carolina (“Gilchrist” or “Petitioner”). BACKGROUND WHEREAS, Petitioner is the owner of certain tracts of land in the City of Charleston, on Meeting Street in the block bounded by Lee Street on the South and Jackson Street on the North, containing in the aggregate approximately 1.507+/- acres, consisting of the following Charleston County TMS No’s.: 459-05-01-024, 459-05-01-047, 459-05-01-055, 459-05-01-091, 459-05-01-092, and 459-05-01-094 (collectively, the “Petitioner Owned Parcels”) all as shown on a preliminary survey entitled “Boundary and Topographic Tree Survey Showing TMS No.S 459-05-01- 023,024,047,055 and 091 thru 094, Located in the City of Charleston, Charleston County, South Carolina”, prepared by GPA Professional Land Surveyors, dated January 7, 2014 (the “Owned Parcels Survey”) a copy of which is attached hereto and incorporated as Exhibit A; and WHEREAS, Drews Court (sometimes also referred to as Drews Alley) separates two of the Petitioner Owned Parcels, being specifically TMS Parcel No’s. 459-05-01-055 and 459-05-01-091 (the “Subject Lots”) all as reflected on the Owned Parcels Survey; and WHEREAS, Drews Court was originally laid out as street by plat on that certain Plat of H.S. Lamble, Surveyor, of date 30th November 1882, which plat is recorded in Plat Book C at page 42 in the Office of the RMC for Charleston County, a legible reproducible copy of which is incapable of being attached and is therefore not included herewith; and WHEREAS, pursuant to South Carolina Code Section 5-27-150 Petitioner is desirous of having the City of Charleston close a portion of Drews Court that divides the Subject Lots and abandon any interest the City of Charleston may have in that portion of Drews Court, all of which is more particularly shown and designated as the “Drews Court Partial Closure Area, 241 sq. ft., 0.006 acres” on a survey entitled “Survey Showing Drews Court Partial Closure Area” prepared by GPA Professional Land Surveyors, dated July 7, 2015 (the “Partial Closure Area Survey”) a copy of which is attached hereto and incorporated as Exhibit B; and WHEREAS, Petitioner requests that the Mayor of the City of Charleston execute a Quitclaim Deed to Petitioner to convey any and all interest of the City of Charleston in and to the Drews Court Partial Closure Area, so that the Drews Court Partial Closure Area can be combined with the Subject Lots. NOW THEREFORE, Petitioner does hereby petition the Mayor and Members of City Council of the City of Charleston as follows: 1. Pursuant to the authority given to a municipality under South Carolina Code Section 5-27-150, Petitioner hereby requests that the City of Charleston close that portion of Drews Court designated as the Drews Court Partial Closure Area and abandon any interest the City of Charleston has or may have in the land area thereof as reflected on the Partial Closure Area Survey attached as Exhibit B, and further described by metes and bounds in Exhibit C attached to and incorporated herein, and that the City of Charleston convey any interest it may have in said Drews Court Partial Closure Area to Petitioner by Quitclaim Deed using the metes and bounds description set forth in Exhibit C. 2. Petitioner hereby certifies that the Subject Lots and the Drews Court Partial Closure Area are each in the city limits and within the jurisdiction of the City of Charleston. 3. Petitioner hereby certifies that he is the owner of record of the Subject Lots which adjoin and are contiguous to the Drews Court Partial Closure Area on each of the northern and southern sides, respectively, and on the western end as reflected on Exhibit B; that he has the right to make this Petition and to request the partial closure as set forth herein, and that Petitioner is entitled under South Carolina Code Section 5-27-150 to have said interest conveyed to him. 4.
