ALTERNATE MEMBER(S) PRESENT: None. MEMBERS ABSENT: None. OTHERS PRESENT: Administrator Robert Hawley, Stacie Lozada, Erin Veysey and two others . MINUTES 1. Regular Meeting of February 18, 2025. Board Action: Motion by Member Zeiler, and seconded by Member Cole, to correct Joseph Hayes to Jason Hayes on the Regular Meeting minutes of February 18, 2025, as presented. Ayes: 5 Nays: 0 Motion carried. Board Action: Motion by Member Zeiler, and seconded by Member Cole, to approve the Regular Meeting minutes of February 18, 2025, as presented. Variance Request: ZBA26-02, 450 E Chicago St, PEA Group; Front yard Setback reduction along US 12 for a drive-through canopy. Leslie who is a representatives of the project, were on hand to answer commissioner’s questions. Public Comment: none. Chairman Swan closed the public hearing at 5:06 p.m. END OF PUBLIC HEARING An affirmative vote of a majority (0/5) of ZBA members is necessary to approve this variance request. Publication of legal notice was published in the Coldwater Daily Reporter on February 28, 2026. Board Action: Motion by Member Zeiler, and seconded by Member Sattler, to Deny the variance request for ZBA26-02, 450 E Chicago St, PEA Group; Front yard Setback reduction along US 12 for a drive-through canopy, as presented. The decision to deny the variance was based on the criteria below. 1. The property can be used in compliance with the Zoning Ordinance without the requested variance. 2. The need for the variance is not caused by unique physical conditions of the property. 3. The circumstances creating the request are related to the proposed design rather than the property itself. 4. Granting the variance would provide a benefit not shared by other similarly situated properties. 5. The request does not meet the standards required under the Michigan Zoning Enabling Act and the City of Coldwater Zoning Ordinance. Ayes: 5 Nays: 0 Motion denied. b. Vice-Chairperson Board Action: Motion by Member Hayes, and seconded by Member Cole, to elect Dave Sattler as Vice-Chairperson, as presented. Roll Call Ayes: Hayes, Swan and Sattler Nays: Zeiler and Cole. Motion Carried. Board Action: Motion by Member Sattler, and seconded by Member Cole, to elect Jason Hayes as Vice-Chairperson, as presented. Roll Call Ayes: Zeiler and Cole. Nays: Hayes, Swan and Sattler. Motion denied due to lack of support.
