I. CALL TO ORDER
The Columbia/Boone County Board of Health met for a regularly scheduled
meeting at 5:30 p.m., Thursday, October 13, 2016. The meeting was held
at the Columbia/Boone County Department of Public Health and Human
Services. Public Health & Human Services Assistant Director Scott Clardy
represented the staff. Dianna Ledgerwood, Administrative Support
Assistant, recorded the minutes of the meeting.
After determining there was a quorum, Dr. Szewczyk called the meeting to
order at 5:37 p.m.
Present: 8- Cynthia Boley, Sally Lyon, Colin Malaker, Lynelle Phillips, Jean Sax, David Sohl,
Denise Stillson and Michael Szewczyk
Excused: 3- Harry Feirman, Elizabeth Hussey and Mahree Skala
II. APPROVAL OF AGENDA
Dr. Szewczyk requested attendance at Board Meetings be added to New
Business.
A motion was made, seconded, and carried for the approval of the amended
Agenda.
III. APPROVAL OF MINUTES
Jean Sax advised the committee she and Mahree Skala are serving on is
the Board of Health and Boone County Commission for the Legal Judicial
Task Force. Dr. Lyon reported the minutes indicated Dr. Malaker was
both present and absent. They should be changed to indicate he had an
excused absence.
A motion was made, seconded, and carried for the approval of the minutes with
stated changes.
IV. REPORTS
Director's Report
Scott Clardy reported the Flu Clinics have been extremely busy. Initially
there was concern that there might not be enough vaccine available due to
the flu mist not being used, but that has not been the case. The

Department recently had three staff members, Andrea Waner, Carrie
Utterback, and Dominique King, recognized for their contributions related
to city’s initiative for diversity. The North Central Community Advisory
Group (NCCAG) is aware of our efforts toward establishing a prescription
drug monitoring program in the City and Boone County. They asked that we
share their brochure on Hepatitis C as growing evidence suggests that
abusers of prescription opioids are shifting to heroin as prescription drugs
become less available. An increased use of heroin means an increase in
Hepatitis C rates and heroin-related overdose deaths.
County Commissioner Report
Janet Thompson was not at the meeting. Jean Sax advised the Judicial
Review Task Force is focusing on mapping to see what is available in
areas of housing, mental health first aid, training, etc.

Dr. Szewczyk provided a copy of the minutes from the Subcommittee
Meeting held September 12, 2016. Members attending were Dr.
Szewczyk, Lynelle Phillips, Cynthia Boley, and David Sohl. He also
provided several brochures related to tobacco retail licensing (see
Presentation Handouts).
A lengthy discussion followed. The Board recommended the City Council
start a licensing program. Revenue from the licensing would be used to
cover the expense of two annual compliance checks including education of
merchants. However, the Board did not recommend any fee amounts.
Their recommendation will include using a fee calculator to set licensing
fees. Further discussion focused on fines for violations. The Board voted
to recommend a license be revoked for 30 days if a seller accumulates five
or more violations within a two-year period. Members agreed revenues
from noncompliance fines should go to the health department for tobacco
retailer education.

The board was unanimous in all its recommendations except for the
amount of the fines levied for non-compliance. Regarding the fines, the
board heard testimony from James Greer, representing a business that
owns multiple gas station/convenience stores. He indicated that he was
not against licensing but felt that the current fine structure should be left in
place He noted that since the City does not do compliance checks, there
is no evidence that it will not work as an effective deterrent. He felt that
before fines are raised, it should be seen whether or not the current fine
structure is effective. There was considerable discussion and the board
voted 6 to 2 to keep the current fine structure. Ms. Boley and Ms. Phillips
felt that the fines should be higher, consistent with best practices, the fine
structure recommended by the Tobacco Control Legal Consortium, and
voted against the measure.
Dr. Szewczyk will prepare a letter for the Council and will send it to all
Board Members for comments prior to submitting.
VI. GENERAL COMMENTS BY PUBLIC, MEMBERS AND STAFF
James Greer presented comments on behalf of tobacco retailers.
VII. NEW BUSINESS
Dr. Malaker advised he will be resigning from the Board at the end of the
year. He knows of a dentist who may be interested in serving on the board.
He feels they would do a good job and will encourage them to apply.
Dr. Szewczyk feels there should be a protocol for attendance at the Board
Meetings. Business cannot be conducted without a quorum. There was
discussion about meeting reminder notices and it was determined
meetings should be cancelled 24 hours in advance if there is not a quorum.
Board members were reminded that when they receive the agenda and
draft minutes for review prior to a Board meeting, they should respond at
that time as to whether or not they will be attending the meeting.
