CALL TO ORDER
The meeting was called to order at 9:00 a.m. by Chairman Sam Davis.

COMMITTEE DISCUSSION
1. The Committee is asked to review the Sidewalk Vending Ordinance and update it to
modern classifications of carts.
Ms. Jeanne Lisowski, Esq., Assistant City Attorney advised the Committee that City Council
cannot prohibit national chains from applying for sidewalk vending carts. City Council should
disqualify applications that do not meet the definitions and the requirements of business
licensing.
Ms. Sidra Nelson, Business License Administrator said the word and definition of cart is used
consistently through the City's ordinance. She asked if we want to stick with that or add upon the
definition to include other types of displays. She presented pictures of well-constructed carts
versus other things that should not be allowed. The ordinance doesn’t clarify if coolers and tables
are allowed. She reported that we currently have three (3) vendors.
Ms. Jeanne Lisowski, Esq., Assistant City Attorney suggested that Council add language that
sets a designated footprint for sidewalk vending carts and at no time can the designated footprint
obstruct pedestrian traffic. She recommended not changing the current definition of a cart.
There was an in-depth discussion about the carts, accessories, safety of pedestrians, and
merchandise.

There was a consensus of the Committee to:
1. Advise City Council that national chains cannot be prohibited from submitting a sidewalk
vendor application;
2. Do not amend the current definition of a cart or allowed accessories that fit within the
designated footprint;
3. Add language that sets a designated footprint for sidewalk vending carts and for the
safety of pedestrians, at no time can the designated footprint obstruct pedestrian traffic;
4. Staff will add sample photos of well-constructed sidewalk vending carts to the ordinance;
5. Amend the list of permitted merchandise to reflect all merchandise included in the City's
ordinance along with salads and pizza; and
6. Amend the ordinance as outlined.

Sec. 11-252. - Definitions.
The following words, terms and phrases, when used in this division, shall have the meanings
ascribed to them in this section, except where the context clearly indicates a different meaning:
Cart means any portable vending device, pushcart or other wheeled vehicle or device which may
be moved without the assistance of a motor and which is not required to be licensed and
registered by the department of motor vehicles, used for the displaying, storing or transporting of
articles offered for sale by a vendor, and which does not exceed four feet in width, six feet in
length, and five feet in height, excluding canopy or cover.
Vending district means the zone or area specifically designated for vending franchises.
Vendor means any person engaged in the selling, or offering for sale, of food, beverages or
merchandise on the public streets or sidewalks, from a cart.
