Minutes of Public Hearing March 3, 2015
The Deerfield Board of Zoning Appeals held a Public Hearing on Tuesday, March 3,
2015 at 7:30 p.m. at the Village Hall Conference Room, 850 Waukegan Road,
Deerfield, Illinois. Chairman Robert Speckmann called the meeting to order at 7:30
p.m.

Ch. Speckmann confirmed the mailings were in order for the petition and the Public
Hearing was properly advertised and listed. Ch. Speckmann swore in the petitioners
and opened the Public Hearing to reconsider the request of Carol Smith for the property
located at 1152 Chestnut Avenue, Deerfield, Illinois. Andrew Venamore, 225 Oakmont
Drive, Deerfield, Illinois represented the property owner. The initial Public Hearing took
place on November 18, 2014 and resulted in a vote of 3 to 1 to recommend granting the
variation as presented. In the absence of 4 concurring votes, the motion failed. The
Mayor and Board of Trustees directed the Board of Zoning Appeals to reconsider the
proposal after additional information was presented at the January 20, 2015 Board of
Trustees meeting.
The petitioner is seeking relief from article 2.03-D,2 and article 4.03-F,3,F,2 of the
Deerfield Zoning Ordinance for the property legally described as follows: Lot 6 in
Foxworthy’s resubdivision of lots 21 and 34 included in block 1 of Deerfield Park Land
and Improvement Association’s subdivision in the southeast quarter of section 29,
Township 43 north, range 12, east of the third principal meridian, according to the plat
thereof recorded December 8, 1926 as document 291159 in book “Q” of plats page 90
in Lake County, Illinois.
Said property is commonly known as 1152 Chestnut Avenue, Deerfield, Illinois, 60015.
The variation, if granted, would permit the removal of the existing detached garage and
allow the reconstruction of a new, similar sized detached garage which occupies more

than 30% of the required rear yard in lieu of the maximum 30% specified and is located
3.18 feet from the north side yard property line in lieu of the 5 foot minimum specified.
The reconstructed accessory structure would consist of a two car garage covering 413
square feet of the required rear yard in lieu of 240 square feet as would be permitted by
the Zoning Ordinance.
Mr. Venamore explained they propose to replace the existing detached garage that is in
poor condition with a structure located 3.8 feet from the north property line. The
proposed structure would be 18 square feet larger than the current structure to provide
a two vehicle garage with some additional storage space. Mr. Venamore explained the
structure would have gutters to protect the occupants as they walk. On the north side of
the structure, the overhang will be reduced from the typical 6” to 3” to address the
shadow concerns of the neighbor to the north. The requested changes from the initial
proposal include moving the structure 6” to the south (3” additional from the original
proposal) and reducing the gutter on the north side of the property to 4”.
Pam Siudyla, 1156 Chestnut Avenue, is the adjacent neighbor to the north. Gordon
Cerrel, 800 Chester Street, Park Ridge, represented Ms. Siudyla as a retired engineer.
Ms. Siudyla appreciates what Ms. Smith has done. Her husband has an award winning
garden which she wanted to protect. Ms. Siudyla clarified that the soffit was being
reduced, the gutter is being reduced and the garage is being moved 2” instead of 3” to
the south. She is okay with the proposed changed. Ms. Siudyla explained the garage
would be built on the location specified on the plat of survey. Mr. Case explained the
drawings, as presented, would be made part of the Ordinance.
Mr. Kessel moved to send a favorable recommendation to the Mayor and Board of
Trustees. Mr. Adams seconded the motion. Mr. Adams requested new drawings be
submitted when there are changes in the plans rather than just marking up old plans.
The motion passed by the following vote:
AYES: Adams, Bezman, Kessel, Scott, Speckmann (5)
NAYS: None (0)
Ch. Speckmann opened the Public Hearing to consider the request of Dan and Cathy
Ziemba for the property located at 829 Cedar Terrace, Deerfield Illinois. Ch.
Speckmann confirmed the mailings were in order for the petition and the Public Hearing
was properly advertised and listed. Ch. Speckmann swore in the petitioners.

Elmview Subdivision of the South half in Lot 2 in Theodore Scheurmann’s Addition to
Deerfield in the South West quarter of Section 29, Township 43 North, Range 12, East
of the 3rd P.M., according to the plat thereof, recorded January 5, 1928, as Document
311069, in Book “S” of Plats, page 40, in Lake County, Illinois.

Said property is commonly known as 829 Cedar Terrace, Deerfield, Illinois, 60015.
Dan Ziemba explained they propose adding a storage shed along the north edge of
their garage. He presented three photographs showing what they propose. There
would be an indentation and a 2’ setback on the shed. Ch. Speckmann explained the
coverage of the rear yard exceeds what is allowed by the Zoning Ordinance. Mr.
Ziemba explained they built their garage 30 years ago and want to add storage along
the north side. Ch. Speckmann explained the existing coverage exceeds what is
currently allowed by the Ordinance and the petitioners are proposing increasing the
coverage to 20% more than what the Ordinance allows. Mr. Ziemba explained that
when the garage was installed in 1985, the Ordinance did not exist. He noted they
would be in compliance with the setback requirements. Mr. Ziemba ensured they would
use the same materials as the existing garage structure.
Mr. Adams asked if the petitioner about the foundation. Mr. Case explained that he
would discuss the actual structural aspects with Mr. Ziemba. Mr. Ziemba added he is
already in discussion with a concrete company. Mr. Ziemba noted they proposed a
location that would have the least impact on the neighbors. Ch. Speckmann closed the
information gathering portion of the Public Hearing.
Ms. Bezman moved to send a favorable recommendation to the Mayor and Board of
Trustees. Mr. Adams seconded the motion. The motion passed by the following vote:
AYES: Adams, Bezman, Kessel, Scott, Speckmann (5)
NAYS: None (0)
There being no further business or discussion, the meeting was adjourned at 8:00 pm.
