APPROVED PLAN COMMISSION VILLAGE OF DEERFIELD The Plan Commission of the Village of Deerfield held a Public Hearing at 7:30 P.M. on June 11, 2015 at the Village Hall, 850 Waukegan Road, Deerfield, Illinois. Chairman Pro Tem Oppenheim called the meeting to order. Present were: Mary Oppenheim, Chairman Pro Tem Alan Bromberg Elaine Jacoby Jim Moyer Stuart Shayman Absent were: Bob Benton Larry Berg Also present: Jeff Ryckaert, Principal Planner Dan Nakahara, Associate Planner Public Comment on a Non-Agenda Item There was no public comment. (1) Public Hearing on the Request for a Text Amendment for Public Art Consideration in Large Developments in the Village Center Proof of notification was submitted and the Legal Notice was published in the Deerfield Review on May 21, 2015. Jeff Marks, Chairman of the Deerfield Fine Arts Commission, along with David Fitzgerald, Management Analyst, Village of Deerfield, opened his presentation by noting that research has shown that communities that support the arts are thriving while communities that do not support the arts are in a decline. Mr. Marks commented that Deerfield has always supported the arts and he is very appreciative of that. The background for this proposed text amendment is derived from a discussion that the Village Board had on whether there should be an impact fee going toward artwork when new construction is proposed. The impact fee was not enacted but he feels that this proposal is a good compromise. Mr. Marks stated that the concept for this text amendment was that new development in the Village Center should give due consideration to public art on their property. This text amendment ensures that the Plan Commission and Village take into consideration public art when a new development is being proposed for the Village Center. Public Hearing June 11, 2015 Page 2 Commissioner Bromberg asked how we are going to distinguish between art and a sign. He recalled a past petition where an artistic image on a building was being considered a sign. Mr. Ryckaert noted a provision in the zoning ordinance that addresses this issue. Mr. Ryckaert said if it’s non-commercial, it’s not a sign, but if the art becomes business related (eg. Items sold in the store) then it is considered to be a sign as it’s commercial in nature. Chairman Pro Tem Oppenheim commented that it could be a gray area because of the interpretation. Mr. Ryckaert indicated that the interpretation is handled on a case by case basis. Mr. Fitzgerald stated that the Fine Arts Commission has a good working relationship with the Appearance Review Commission and they have worked together to answer these type of questions as they come up. Mr. Marks added that the Fine Arts Commission is aware of the sign requirements and the branding issues and noted that they go to the Appearance Review Commission with any of their projects. Chairman Pro Tem Oppenheim also had questions on who decides the appropriateness of public art. She realizes that there are certain requirements that need to be upheld and asked how public art is currently handled when a business wants to have public art. Mr. Marks stated that the Fine Arts Commission will review the piece and make a decision and then forward their findings to the Board of Trustees who has the final vote. He commented that the Board has done this for all of their art pieces. Chairman Pro Tem Oppenheim commented that art can be controversial and offensive to some, and not offensive to others so it is good that there is a vetting process that is in place. Mr. Ryckaert noted that the Fine Arts Commission will review the content of the art which is in their purview. The Plan Commission will look more at the location and placement of the piece(s) on the site plan. Commissioner Moyer asked Mr. Marks how public art is handled if a business asks for help from the Fine Arts Commission. Mr. Marks noted that the Commission can help coordinate the public art. Chairman Pro Tem Oppenheim commented that the text amendment is to encourage developers to consider public art where it is appropriate in their project. Commissioner Shayman asked at what point the art will be reviewed by the ARC. Marks hopes that this will get developers looking at their space with art in mind. He noted that the Fine Arts Commission is part of a consortium of artists that can supply art from all over the country. Mr. Marks commented that the concept is to have space for public art so that the public can interact with art. Commissioner Pro Tem Oppenheim noted that there are other things to consider having art in outdoor public spaces such as security, safety and maintenance of the art. She feels that having a resource with this expertise would be useful. Commissioner Shayman asked for clarification of a “public context designer”. Mr. Marks commented that a public context designer is a term used for architects that consider art in different contextual design elements such, but not limited to, entryways, access areas, or staircases. Commissioner Moyer asked how businesses will be alerted to this consideration. Mr. Ryckaert noted that the text amendment is intended for new development and major renovation in the C-1 district. He said the developer would Public Hearing June 11, 2015 Page 3 submit this element along with the other parts of their development plan, i.e., lighting, signage, landscape plan, engineering, etc. (2) Public Hearing on the Request for Approval to Amend the Sign Plan for the Woodview Apartments to Allow Changes to the Monument Ground Sign, Wall Signs and Various Directional Signage at Their Location at 15 Parkway North (Woodview Deerfield LLC). Proof of notification was submitted and the Legal Notice was published in the Deerfield Review on May 21, 2015. Mr. Greg Moyer, Woodview Apartments, commented that they are requesting a change to their previously approved monument ground sign as well as minor signage changes to their property. The new ground sign is directed by the Parkway North Association so that their sign will conform to all other ground signs for the other properties in the Parkway North Planned Unit Development. The ground sign is larger than what was previously approved. Mr. Moyer commented that the additional signs changes are due to color and design changes. These signs are smaller than what was previously approved. The directional signs were directed by the Fire Department and were not on the original sign plan. Commissioner Shayman asked why there were changes to the signs on the building. Mr. Moyer commented that the architect called out some colors that they wanted for the building. Mr. Ryckaert also noted that address signs were added to the building. A motion was made and seconded to close the public hearing. Commissioner Jacoby motioned to approve the request to add a text amendment for public art consideration in large developments in the Village Center (Article 2.12) and the definition of public art to Article 14 in the Zoning Ordinance. Commissioner Moyer seconded the motion. The vote was as follows: Ayes: (5) Bromberg, Jacoby, Moyer, Shayman, Oppenheim Nays: (0) None The recommendation will go to the Village Board of Trustees on July 6, 2015. (2a)Discussion of the Signage Request for Woodview Apartments. The Commissioners believed the changes to the sign plan were appropriate and were in favor of the revised sign plan. Commissioner Bromberg motioned to approve amending the sign plan for the Woodview Apartments to allow changes to the monument Ground Sign, Wall Signs and various directional signage at their location at 15 Parkway North. Commissioner Moyer seconded the motion. The vote was as follows: Ayes: (5) Bromberg, Jacoby, Moyer, Shayman, Oppenheim Nays: (0) None Workshop Meeting June 11, 2015 Page 2 The recommendation will go to the Village Board of Trustees on July 6, 2015. (3) Request for a Finding of Substantial Conformance Re: Approval of a Final Plat of Resubivision for 1555 Wilmot Road (Michael Stone Group and Terry Franke) Ryan Johnstone, principal, Michael Stone Group, on behalf of Terry Franke, is seeking substantial conformance from their preliminary plat of resubdivision to their final plat of resubdivision. The proposal requests to resubdivide two lots of record into three lots of record. Mr. Johnstone stated that there have been no changes to the final plan from the previously approved preliminary plat of resubdivision. He noted that the new lots conform to the required zoning code and they do not require any variations. Commissioner Jacoby motioned to approved the final plat of resubdivision for 1555 Wilmot Road and found that the final plat of resubdivision is in substantial conformance to the preliminary plat of resubdivision. Commissioner Moyer seconded the motion. The vote was as follows: Ayes: (5) Bromberg, Jacoby, Moyer, Shayman, Oppenheim Nays: (0) None Designation of Representative for the next Board of Trustees Meeting Commissioner Oppenheim will attend the June 15, 2015 Board of Trustees Meeting.
