CITY OF DEKALB BUILDING BOARD OF APPEALS MINUTES February 11, 2016 Call to Order. The meeting was called to order at 9:02 AM by Chairman Don Whitmore. Roll Call BBA Members present were Chairman Don Whitmore, Charles Shepard, Christine Scholl, Jim Ward, and Lisa Sharp. Steve Irving was not present. Staff present were Community Development Director Ellen Divita, Fire Chief Eric Hicks, Dan Burrow of SAFEbuilt, and Community Development Administrative Assistant Natalie Nelson. Natalie Nelson acted as recording Secretary. Also present were Ken Anderson and Randy Nelson. Approval of Agenda Chairman Whitmore asked for a motion to approve the agenda. C. Shepard motioned to approve the Agenda, and the motion was seconded by L. Sharp. All approved by voice vote. Approval of Minutes L Shepard motioned to approve the January 21, 2016, minutes, and the motion was seconded by C. Scholl. All approved. Public Participation Old Business 1. Continued Workshop discussion on 2015 ICC Building Codes New Business Approved Minutes 021116 Building Board of Appeals 1 1. Subcommittee report on Chapter 24, DeKalb Municipal Code Chairman Whitmore noted that Chapter 24 of the DeKalb Municipal Code references to the 2003 International Building Code and 2003 International Residential Code, and those references will need to be removed. L. Sharp recommended that we look closely at each line of Chapter 24 to determine if each item addresses something specific to DeKalb that needs to be kept. L. Sharp stated that it is complicated to go into a community and find all of the amendments to each code, and it would be better if they were all consecutive. Chief Hicks also recommended reviewing this line by line to compare to the Fire Code. 24.01 a, b, and c – need to be reviewed and rewritten to see if the 2015 IBC and IRC cover these items. 24.01-01 Identification of Local Building Code Not Adopted – The Board recommended to delete this item. 24.02 Deletions and Additions to the International Building Code The Board recommended keeping the definitions and adding the following: In all chapters and sections strike out references to Chapter 11 and replace with references to the Illinois Accessibility Code. In all chapters and sections strike out references to International Plumbing Code and replace with references to the Illinois Plumbing Code. 103.1 Code Official – The Board recommended to keep this item. 106.1 One and Two Family Plan Submittal – Board will review these requirements as part of the review of the IRC requirements. 106.3.3 Approval of part – The Board recommended to delete this item, as contractors performing work on footings and/or foundations are responsible for determining if the weather permits this kind of work. 108.2 Fee Schedule – The Board recommended to move to the Fee Schedule to section to 109.2 in the 2015 IBC. 109.3 Required Inspections – The Board recommended to delete this item since IBC 104.4 Inspections addresses this item. 114.3 Unlawful continuance – The Board recommended to delete this item since IBC 115.3 Unlawful continuance addresses this item. It was also recommended that a sentence for fees be added to IBC 115.3. All fees and fines should be placed in one location in the adopting ordinance. 110.3 Temporary Occupancy – The Board recommended to delete this item as IBC 111.1 Use and occupancy address this item. It was also recommended that a sentence for fees be added to IBC 111.1. 110.2 Final Occupancy Certificate – Final Occupancy will be reviewed along with the review of the IRC requirements. 112.0-112.7 Building Board of Appeals is addressed in IBC section 113. The Board recommended to delete IBC 113 and replacing it with a separate chapter about the City of DeKalb Building Board of Appeals structure and procedures. Another recommendation was to delete the other boards (electric, plumbing, HVAC) and including language that refers to members of the BBA who represent each of these trades. 502.1 Height, Building –The Board recommended to delete this item and refer to Chapter 2 of IBC for the definition of measuring the height of a structure. 903.3.5 Water Supplier – The Board recommended to delete this item and refer to the Illinois Plumbing Code. 907.2.10.2 Battery Backup – The Board recommended to delete this item and refer to the language in the code which does require battery backup. 906 Fire Extinguisher. – The Board recommended comparing IBC section 906 Portable Fire Extinguishers or Chapter 28 of the DeKalb Municipal Code. Chapter 11 Accessibility – The Board recommended updating this item and referring to the Illinois Accessibility Code. 1104.3.3 – The Board recommended deleting this item, as this section no longer appears in the IBC and the requirements are already in the Fair Housing Act. 2308.9.3 Bracing – The Board recommended deleting this item, as it is already in the 2015 IBC. Elevators within the City of DeKalb shall be required to comply with all applicable regulations under the Illinois Elevator Safety and Regulation Act and any regulations adopted pursuant thereto. Pursuant to said Act, the City shall not conduct a local inspection scheme for any device subject to the requirements of the Act, and all such inspections shall be completed by the Illinois Office of the State Fire Marshall. For purposes of building plan review, the City shall utilize the most current specifications required under the Act or regulations adopted pursuant thereto. Miscellaneous hoisting and elevating equipment that falls outside of the requirements of the Act shall be inspected at such intervals as may be deemed necessary by the Chief Building Official to insure safety and operation, and the owner or operator thereof shall be responsible for all costs of inspection as shall be assessed by the Chief Building Official. (13-17) – The Board recommended deleting this item as the guidelines appear in Chapter 30 of the 2015 IBC. 3410.2 Applicability – The Board recommended deleting this item. Announcements E. Divita announced the change in City’s Fiscal Year to be Calendar Year, and contractors will have the choice of renewing their licenses for either 6 months or 18 months. Randy Nelson reported that the Rockford has sun-setted the townhouse sprinkler requirements. The Homebuilders group and Illinois Realtors group brought the issue to their council. Chief Hicks will check with the Rockford Fire Department to confirm. Adjournment Hearing and seeing no additional comment from attendees, Chairman Whitmore closed the meeting at 10:14AM. The next Building Board of Appeals meeting is set for Friday, March 4, 2016, 9:00AM at DeKalb City Hall.
