City of Edwardsville City Council Proceedings June 17, 2014 A Public Hearing was held at 6:30 p.m for the Review of An Ordinance Making Appropriations for the Fiscal Year beginning the First Tuesday in May, A.D., 2014 and ending the Monday preceding the First Tuesday in May, A.D., 2015. The hearing was conducted by City Clerk/Collector Dennis McCracken. No one was present to speak for or against the ordinance. The hearing concluded at 6:35 p.m. A Public Hearing was held at 6:45 p.m regarding a Proposed Boundary Agreement between the City of Edwardsville and the Village of Glen Carbon. The hearing was conducted by City Attorney Jeff Berkbigler. No one was present to speak for or against the agreement. The hearing concluded at 6:50 p.m. The regularly scheduled meeting of the Edwardsville City Council was held at 7:00 p.m at Edwardsville City Hall, 118 Hillsboro Avenue with Mayor Patton presiding. Aldermen Stack, Butts, Risavy, Mallon, Stamer and Louer answered present on roll call. Alderman Krause was excused. The Pledge of Allegiance was recited by all present. Mayor Patton welcomed everyone in attendance to the meeting and asked if any citizen wished to address the council. Matt McSparin, owner of Edison’s spoke requesting support from the Council for a Dynamic Display Sign. Desiree Bennyhoff, Director of the Edwardsville/Glen Carbon Chamber of Commerce voiced her concerns regarding the lack of public engagement by the City Council with the business community which restricts the right of business owners. Motion by Butts, seconded by Risavy, to approve the Consent Agenda. City Attorney Berkbigler added two Executive Sessions – a) Pending Litigation and b) Real Estate. ACS item i) Sign Variance request for Dynamic Display to approve variance for Edison’s. Mayor Patton read Consent Agenda items as follows: Approval of minutes of Council Meeting on June 3, 2014 Activity and Financial Reports: A. Reports of Elected and Appointed Officials: a) City Clerk/Collector – Monthly Financial Report (electronic distribution) b) City Clerk/Collector – Monthly Activity Report c) City Treasurer – Monthly Financial Report d) Police – Monthly Activity Report e) Fire Chief – Monthly Activity Report (Fire and EMS Services) f) Public Works Director – Building, Electrical and Plumbing Permits B. Circuit Clerk’s Report Group Health Insurance Fund Report - $485,539.34 Roll call: Five Ayes, with Aldermen Stack, Butts, Risavy, Mallon and Louer voting aye. One Nay, with Alderman Stamer voting nay. Motion Carried. A Presentation by Rick Welle, Fire Chief was given regarding the Edwardsville Fire and EMS Department. Chief Welle spoke of the 140 year history of the fire department and 40 year history of the EMS program that led to the “Lean On Me” Motto of today. Chief Welle spoke of Specialized Training, Code Enforcement, Preparedness for any type of emergency, Infrastructure, Fire and Ambulance call volume and future challenges of the department. Motion by Stamer, seconded by Stack, to accept with regret the Resignation of Jim Zupanci from the Historic Preservation Commission. Roll call: Six Ayes, with Aldermen Stack, Butts, Risavy, Mallon, Stamer and Louer voting aye. Motion Carried. Motion by Mallon with no second to table tobacco license for lack of application information. Motion by Stamer, seconded by Stack, Approval of a Tobacco License for Luxury Smoke Shop and Vapors at 2127 S State Route 157, Edwardsville, IL. Roll call: Five Ayes, with Aldermen Stack, Butts, Risavy, Stamer and Louer voting aye. One Nay, with Alderman Mallon voting nay. Motion Carried. Minutes of Finance Committee meeting on May 28, 2014 were received for information and file. Motion by Butts, seconded by Mallon, to approve Claims - $320,178.85 (Regular) and $24,683.96 (Library) for a total of $344,862.81. Roll call: Six Ayes, with Aldermen Stack, Butts, Risavy, Mallon, Stamer and Louer voting aye. Motion Carried. Motion by Butts, seconded by Stack, to approve An Ordinance Making Appropriations for the Fiscal Year Beginning the First Tuesday in May, A.D., 2014 and Ending the Monday Preceding the First Tuesday in May, A.D., 2015. Roll call: Six Ayes, with Aldermen Stack, Butts, Risavy, Mallon, Stamer and Louer voting aye. Motion Carried. Finance Committee will meet on Wednesday, June 25, 2014 at 5:30 p.m. in the Governor Edwards Conference Room. Public Safety Committee meeting will be announced. Minutes of the Public Services Committee meeting on May 27, 2014 were received for information and file. Motion by Stamer, seconded by Butts, to approve a Resolution Appropriating Motor Fuel Tax Funds for the Milling and Resurfacing of the Parallel Parking Lanes along IL 159/Il 143 (Main St) and along IL 157/Il 143 (Vandalia St) and Replacement of Decorative Stamped Crosswalks along Illinois Route 143 (North Main Street) in the amount of $134,144.21. Roll call: Six Ayes, with Aldermen Stack, Butts, Risavy, Mallon, Stamer and Louer voting aye. Motion Carried. Motion by Stamer, seconded by Risavy, to approve a Resolution Authorizing the Mayor to Sign an Agreement with the State of Illinois Department of Transportation for the Improvement of FAP/FAU Route 592/789/8890 (IL Route 157/159/143), State Section (7z, 56)Rs-1, 65-2rs-4, Madison County IL. Roll call Six Ayes, with Aldermen Stack, Butts, Risavy, Mallon, Stamer and Louer voting aye. Motion Carried. Motion by Stamer, seconded by Risavy, to approve a Resolution Approving Plans and Specifications for the Improvement of FAP/FAU Route 592/789/8890 (IL 157/143), State Section (7z, 56)Rs-1, 65-2rs-4, Madison County IL. Roll call: Six Ayes, with Aldermen Stack, Butts, Risavy, Mallon, Stamer and Louer voting aye. Motion Carried. Public Services Committee will meet on Tuesday, June 24, 2014 at 5:30 p.m. in the Governor Edwards Conference Room. Minutes of Administrative & Community Service Committee meeting on May 28, 2014 were received for information and file. Motion by Louer, seconded by Stack, to approve An Ordinance Ascertaining the Prevailing Rate of Wages for Public Works of the City of Edwardsville, Madison County, Illinois – Ordinance adopted and updated annually listing the annual rate of pay for required various trades within Madison County for all contracts utilizing Public Funds per State Statutes. Roll call: Six Ayes, with Aldermen Stack, Butts, Risavy, Mallon, Stamer and Louer voting aye. Motion Carried. Motion by Louer, seconded by Stack, to approve An Ordinance Amending the Land Development Code of the City of Edwardsville Division 1, Article 1 General Provisions, Section 1-4 Instances when plats will not be required – Clarifies the applicability of Illinois Plat Act Exemptions to the Land Development Code. Roll call: Six Ayes, with Aldermen Stack, Butts, Risavy, Mallon, Stamer and Louer voting aye. Motion Carried. Motion by Louer, seconded by Stack, to approve An Ordinance Approving a Boundary Line Agreement Between the City of Edwardsville and the Village of Glen Carbon, Illinois (Intergovernmental Cooperation Agreement – Establishes mutual agreed upon annexation boundaries between the two communities. Roll call: Six Ayes, with Aldermen Stack, Butts, Risavy, Mallon, Stamer and Louer voting aye. Motion Carried. Second reading of An Ordinance Amending Section 1250 of the Codified Ordinances of the City of Edwardsville (Lot Coverage and Utilization) – previously known as a Small Lot Overlay District (revised version implementing a Small Lot Overlay review Committee) (First Reading occurred at City Council on 2/4/14; 2nd Reading at ACS occurred on 2/13/14; Item withdrawn from 2/18/14 Council Agenda for further review by ACS (ACS Committee recommends denial) – Allows single family residence construction on lots between 40’ – 49’11 wide containing between 5,000 – 7,499 sq. ft. was held in committee. Ordinance Amending Chapter 94 of the Codified Ordinances of Edwardsville, Illinois (Signs) – Amendment prohibits installation of Dynamic Display Signs and specifically lists existing Dynamic Display Signs that were grandfathered when the 2010 Ordinance was adopted and those approved under the 2010 ordinance and the established operating criteria filed for second reading. The following items were for information and file: 1) 2014 Veterans March 2) Zoning Board of Appeals minutes of 4/28/14 3) Recreation, Arts and Special Events Board minutes of 4/1/14 & 5/6/14 Motion by Louer with no second, to approve a sign variance request for a dynamic display sign for Edison’s. Motion by Risavy, seconded by Stack, to table the sign variance. Roll Call: Five Ayes, with Aldermen Stack, Butts, Risavy, Mallon and Stamer voting aye. One Nay, with Alderman Louer voting nay. Motion Carried. Administrative & Community Service Committee will meet on Thursday June 26, 2014, at 5:00 p.m. in the Governor Edwards Conference Room. Council recessed and went into Executive Session at 8:00 p.m. Council reconvened into Open Session at 9:05 p.m. Motion by Risavy, seconded by Mallon, to approve a Resolution Authorizing the Mayor to apply for Open Space Lands Acquisition and Development (OSLAD) grant with State of Illinois. Roll call: Five Ayes, with Aldermen Stack, Butts, Risavy, Mallon and Louer voting aye. One Nay, with Alderman Stamer voting nay. Motion Carried.
