At the regular meeting of the Plan Commission's Land Use Committee, the following was discussed:
Case 2014-04: GOVERNORS WAY –Final Plat
Developer: Governors Way LLC
Engineer: Thouvenot, Wade & Moerchen, Inc.
Hanson explained this is Phase 1 Final Plat of Governors Way subdivision. It has the same layout as the
Preliminary Plat which was previously approved in May of 2013. The Final Plat also stipulates on the
front the requirement for designated 5-foot sidewalks.
B. Riedel explained Lot 19 had a small lot line change. As Lot 19 is now laid out, all of the lot is now
inside the city limits. They did not want to pay annexation fees for a portion of that lot. He also pointed
out all of Lots 25, 26, and 39 will be required to have 5-foot sidewalks as outlined in the Covenants and
Restrictions. They did not like the idea of narrowing the sidewalks around the corners. There will also be
a temporary sign easement for Commons B which is in the passive greenspace area.
Williams discussed the connection to Willow Creek. City Council passed a resolution allowing the
connection to Willow Creek and awarded the contract with the contractor working on this site. The City
will be installing a temporary bollard until 60 percent of the 72 lots have been improved to avoid
construction traffic through Willow Creek.
Hanson stated staff had looked at the drainage and utility easements closely because of fencing issues to
narrow them down as much as possible but still meet the requirements. One particular lot, Lot 1, had
easements around the entire property. After discussions with the developer, the easement on the south
side was reduced and the west side was eliminated. Maller suggested the City may consider reducing the
rear yard setback on that lot to make it a more buildable area. This is an odd shaped lot due to the way
the sanitary sewer comes across Willow Creek. The lot is widened as much as possible but it narrows
quickly in the rear. This lot would, most likely, accommodate a 2-story house but not a ranch house.
Miller asked for the clarification of the accuracy of the NGS monument. Maller explained the accuracy is
not guaranteed because it is very accurate at the Courthouse but by the time it is translated out to the site,
there are discrepancies. Miller asked if this would have a negative effect in any way. Maller stated this is
strictly for vertical elevations only. Improvements to technology has allowed for more accurate readings
so most surveyors today don’t use this datum to get accurate elevations.
