Schneck, Staff A meeting of the Plan Commission's Ordinance Sub-Committee was held on Thursday, January 9, 2013, and the following proposed ordinance amendments were discussed: 1. Maximum building height in Single Family Residence District (R-1). After further discussion with the Aldermen and Mayor, it was suggested to revisit the height restriction above 40 feet in an R-1 Single Family District. RECOMMENDATION: Forward to Plan Commission the approval of the 40-foot height for R- 1 Single Family Residential District as presented. Determination of Measuring the Height Currently the City’s code states the height is measured from the average grade of the front wall of the building to the highest point of the roof. It was suggested by a contractor to measure the distance from the floor joists supporting finished floor elevation of the first floor to the highest point of the roof. There was further discussion to determine the best way to measure the height of the building. RECOMMENDATION: The following to be forwarded to Plan Commission for approval: Residential buildings – the vertical height of the ground floor elevation at the front entrance door to the highest point of the roof. For split level or multi level, first floor elevation the measurement would be at the finished floor elevation at the front entryway door. 2. Single Family Residence Estate Lot District (R-EL District). The minimum lot size with this zoning district would have to be ½ acre or 21, 780 square feet. Rezoning for this district would be a minimum of 5 acres. This zoning district would allow for building heights taller than 40 feet. This would be the only zoning district which would allow for horses. This would change Section 14-6(g) which does not allow for horses within the city limits unless grandfathered by annexation into the city. The committee thought it would be nice to introduce a horse community with the option of possible riding trails as greenspace within the development. 2 The committee intensively discussed and proposed these changes: 1. Move 1.B.(1)(c) which allows horses as an accessory use to 1.B.(2)(d) as a Special Uses with a minimum of 5 acres and the maximum of 2 horses. Each additional horse would require an additional acre. Wording for this subsection will need to be reworded. 2. Eliminate (e), (f), & (g) under (2) Special Uses. 3. Add wording in Section 1.B.(2)(d) to address the requirement of fence setback of 25 feet from the property line. 4. Section C.(2) should be deleted. 5. Sections C.(3)(c)(i) and C.(3)(c)(ii) between the words “between structures” add “the proposed and existing”. 6. Yard exceptions (a) through (e) should be replaced with “See Section 1248.02.3” 7. Setbacks for accessory uses should be 10 feet from property lines and 10 feet from the principle structure. This should be added under Lot and Building Requirements. 8. Need clarification from the Fire Department concerning the type of driveways to allow for heavy equipment and if fire hydrants will be required since the homes could sit further from the street. Possibly adding (b) pavement widths, thickness, and pavement surface type. Also distance of fire hydrants from primary residence. 9. Section (7) (b) add “from ground level” to the end of “extend to one hundred (100) feet”. 10. Adding a maximum accessory height of 66% of the principle structure. 11. Change tower heights from 30 feet to 50 feet. 12. Accessory dwellings allowed under “Definitions”. 13. Section 7(c): thirty (30) feet needs to be changed to fifty (50) feet in height. RECOMMENDATION: Forward to Plan Commission with the changes previously discussed. REMINDER: PLAN COMMISSION MEETING: Wednesday, January 22, 2013 at 7:00 p.m. at City Hall, City Council Chambers, 118 Hillsboro Avenue.
