ORDINANCE SUB-COMMITTEE
EDWARDSVILLE PLAN COMMISSION

A meeting of the Plan Commission's Ordinance Sub-Committee was held on Monday, September
25, 2014, and the following proposed ordinance was discussed (continuation from September 4,
2014):
1. An Ordinance amending the provisions of Chapter 1243 of the Codified Ordinances relating
to Planned Unit Developments (PUD)
Hanson presented the first part of a two part ordinance to review to the committee. This
ordinance is for an overlay district which was decided at the last meeting. The proposed
ordinance will have a trade off of money for time. There will be less money up front but the
process will take more time.
The committee recommended the following changes.
1. Put page numbers on the ordinance.
2. Section (1) Purpose – in the first sentence “that is intended” should be replaced with
“designed”.
3. Changing Section (3)(b) heading to Section (4) with the heading of “When a PUD is
required”. Also to change the following Section numbers as needed.
4. Currently under Section (3) 3) should read “A multi-family residential development in
which density is less than 4,000 square feet of lot area per dwelling unit”.
5. Currently under Section (3) 4) replace the word “use” with “structure”.
6. Currently under Section (3) 5) should say “Any development that requires a development
agreement”.
7. Move items (a) through (g) from page 4 to page 2 under “Others”. Remove items (b), (d),
and (e). The gross density in (c) should be 10.0 not 5.0. The gross square foot in (f) should
be 50,000 and (g) should be 20,000.
8. Page 2 under “Procedure” staff needs to discuss if 5 business days would be enough time
for review of the preliminary plan. It was discussed that maybe it should be 10 days.
9. Page 3 #6 should be removed (Projected impacts/positive and negative).
10. Page 3 #9. Should say “Concept of similar projects”.
11. Discussions to have the Plan Commission hear all zoning changes.
12. Page 3(C)(1) the first sentence should read “The City Planner shall be responsible for
scheduling the conceptual project workshop at the next regularly scheduled Plan
Commission meeting, including publishing a Public Meeting Notice.”
13. Discussion to create an Administrative Review Manual to give detailed requirements of the
procedures of this ordinance.

14. Page 3(C)(2) “being scheduled” should be added after “Prior to the workshop”.
15. Page 5 (j) Step 10 – instead of “public hearing”, it should be “public meeting”.
16. Page 6 (c) The proposed Development Plan will “not place undo burden” for potable water
supply… Also strike “fire protection” and replace it with “public safety”.
17. Page 6 (d) should be noted that no buyout of Greenspace is permitted.
18. Page 6 (e) needs to be outlined with the phasing. Porter suggested that this section should
also include the greenspace and detention basin locations. Hanson stated this may need to
be an internal discussion.
19. Page 6 (8)(a) strike “and/or intensity” and replace it with “size and use”.
20. Page 6 (10) – delete this entire section including (a) and (b).
21. Page 7 (11)(a)4. – delete this section.
22. Page 7 (11)(b) remove ‘Franklin Municipal”
Discussion was held regarding the items allowed for deviations from a Development Plan of
record as laid out in pages 8 through 10. They felt any deviation would require the developer to
start over. They would like to take a little more time to review these sections again. The board
would like to see this ordinance a little more simplified.
This discussion will continue on October 20, 2014 at 6:00 p.m. since there will not be Plan
Commission meeting that evening.
