A meeting of the Plan Commission's Ordinance Sub-Committee was held on Monday, October
20, 2014, and the following proposed ordinance was discussed (continuation from September 25,
2014):
1. An Ordinance amending the provisions of Chapter 1243 of the Codified Ordinances relating
to Planned Unit Developments (PUD)
Hanson presented the second part of a two part ordinance to review to the committee. Hanson
explained the PUD Development Plan process which would be approved by City Council as
previously discussed at the last meeting. Once that is done, the developer will move to the Site
Plan Process. Most of the soft costs are included in the Site Plan Process. The plan that is
approved by City Council will include a conceptual site plan. The actual Site Plan Process will
allow for a 10% deviation from the plan approved by Council to give some flexibility. Currently,
the City does not have a site plan review process. The only time there would be some type of
review is if the property is located within a historic district. With this proposal, the developer can
get preliminary approval to move forward without the out of pocket cost imposed with design
objectives.
The committee recommended the following changes.
1. Section 2.4.3 Site Plan Review Subsection (1) Purpose and Scope – “review” should be
capitalized.
2. Make sure the permits pointed out in this section are consistent throughout the entire
ordinance and do not need to be capitalized.
3. Subsection (1) “land use plan” should be replaced with “Comprehensive Plan”.
4. “Shall” should be replaced with “is” or “will” where needed.
5. Subsection (2) (a) – “review” should be capitalized. “Shall be” should be replaced with
“is”. Remove “residential and nonresidential”. “Building Permit” should be lower
case. Reference subsection (5) for the process of the Site Plan Review.
6. Subsection (2) (b) – Remove “in 2.4.3(3)” and “shall be reviewed and approve” should
be replaced with “are subject to review and approval”.
7. Site Plan needs to be defined somewhere in this section with the details required for
submittal including elevations and landscape plans.
8. Subsection (3) Exemptions in the first paragraph remove “City requirements” and
replace with “provisions of the City codes”.

9. Subsection (3) the first sentence should be reworked. The board felt the wording was a
little awkward.
10. Subsection (3) (a) remove “Individual”.
11. Subsection (3) (b) “Plans” does not need to be capitalized. Remove “to” and adding
“ing” to “exceed”. Remove “per the provisions of” and replace it with “under”.
12. Review the difference from Subsection (3) and Subsection (8). Possibly combining
these 2 subsections.
13. Combine Subsections (3) (b) and (c) by adding “or” after “building” in the first line.
Both items have “not requiring submittal of a Stormwater Plan under the Land
Development Code”.
14. Subsection (3) (d) “The” does not need capitalized. Remove “gross floor area, increase
the intensity of use, or affect” and replace with “the”. Also striking “on a site that
meets all development and site design standards of this ordinance”. Adding “and” and
the end.
15. Subsection (3) (e) should read “temporary construction trailers.”
16. Subsection (4) - The word “review” in the first sentence should be capitalized.
17. Rename Subsection (5) to “General Procedure for Site Plan Review Process”.
18. Subsection (5) should read “The review procedure for a Site Plan Review is as
follows:”
19. Captions should be after each step in Subsection (5).
20. Subsection (5) (a) caption should be “Site Plan Review Conference.” Remove the
second sentence. This should include reference to an “Administration Manual”.
21. Remove Step 2
22. Subsection (5) (c) Insert “with the PUD Review Committee” in the first line after
“meeting”.
23. Subsection (5) (c) The third sentence should be replaced with the following: “The
Department of Public Works – DPZ shall provide to the applicant all review comments
and recommendations.”
24. Subsection (5) (c) The 5th sentence “Upon submittal..” should be replaced with the
following sentence: “Upon resubmission, the revisions will be scheduled for the next
available meeting per the Administration Manual.”
25. Subsection (5) (c) – The last sentence should read “The DPZ shall prepare a report with
rational as to how it relates to the development plan and recommend approval, approval
with conditions, or disapproval of the Site Plan to the Plan Commission. Staff and Plan
Commission’s review is based on the PUD Development Plan ”
26. Subsection (5) (d) – This subsection should read “The Plan Commission, at their next
regularly scheduled meeting, shall make a decision to approve, approved with
conditions, or disapprove the Site Plan application in accordance with this ordinance,
state law, and the Plan Commission Bylaws.
27. Subsection (5) (e) needs to be looked into further to decide when this should be
required – either before occupancy permit or building permit.
28. Land Use review should be built into the Administrative Manual.
29. Subsection (6) (b) Remove “is in compliance” and replace with “complies”. Also add
“uses” after “base district”.
30. Subsection (7) (a) Need to coordinate the timeline to reflect either 1 year from PUD
approval or 1 year from the Site Plan approval. The PUD could expire prior to the Site
Plan approval. Should the PUD remain on the land instead of revoking the PUD and
allow the developer to keep the zoning? If it would revert back to original zoning, that
would be considered spot zoning if part of the PUD was developed.
31. Subsection (7) (b) “Planning” should be “Plan”.
32. Subsection (7) (c) Coordinate with Step 5 to read either Building Permit or Occupancy
Permit. Hanson to review this section because it is not consistent with Step 5.

33. Subsection (8) should be combined with Subsection (3).
34. Subsection (8) (a) – Should be amended to include the PUD Committee not just City
Planner and Public Works Director.
35. Subsection (8) (b) i - should add “or decreased;”
36. Subsection (8) (b) ii – remove “nonresidential”.
37. Subsection (8) (b) iii & iv – remove “to be deleted” and replace with “any substantive
change”.
