A meeting of the Plan Commission's Ordinance Sub-Committee was held on Monday, November 7, 2016,
and the following proposed ordinance amendment was discussed:
A. An amendment to R-1 Zoning Code
Members discussed the amendment on page 3 to allow an accessory structure to be placed at the
property line. Questions of how the vehicles could get out of their garages with no setbacks. It
was brought up that some alleys are actually easements, would the property line be in the middle
of the alley, therefore allowing the garage to be placed in the middle of the alley.
Suggested changes are as follows:
Page 3 item B.
Replace the period in line 3 after “lines” with a semicolon and insert “provided, however,” and
delete “except”. The following lines shall read as follows, “when the accessory structure is
adjacent to an alley, the property owner may elect to reduce the setback to zero (0) feet from the
alley right-of-way or easement. The required setback for the principal structure shall still apply.”
Also make a conforming change to page 6.
Further discussion as to whether they agree with this change. Several examples were given of
issues with getting in and out of the garage. They felt there are few instances where the zero
setback would apply. Why couldn’t the property owner just apply for a variance? The board felt
they would forward it to Plan Commission for their comments.
Discussion regarding the change in Section 1248.02.14 Recreational vehicles and travel trailers.
It is okay to put the garage on the rear property line but a boat must meet the 5 foot setback from
the property line so it can’t sit right next to the garage as this is written.
Suggestion to change the first sentence under this section to read, “The regulations of this section
apply to travel trailers, utility trailers, and other trailers, recreational vehicles, and watercraft
(each a “Subject Item”): provided however, the regulations of this section are not applicable to
travel trailers or other recreational vehicles parking in a permitted travel trailer park that
conforms to the pertinent requirements of a mobile home park within this title.”
The subsections (a-g) will need to be corrected accordingly. Remove travel trailer or other
recreational vehicle and replace with “subject item”.

Going back to Page 3, highlighted area for 30 percent of a required rear yard. After further
discussion, it should be left as previously written. Just remove the highlighting.
Page 8 – remove highlighted area. No change needed.
Page 9 under Section 1248.03.3 (b) in the fourth line add “then current” before regulations. In
the second line of red area added, replace the word “the” with “any” and add “nonconforming”
after existing. Line 3 of same section, delete, “which is not in conformity”.
Staff pointed out they added Building Footprint under Definitions.
The definition should read as follows: “The area falling directly beneath and sharing the same
perimeter outline as the building.”
Changes to be forwarded to the Plan Commission for their review and comment.
