VOLUME XC OCTOBER 22, 2025 COUNCIL OF THE CITY OF ELGIN, ILLINOIS COUNCIL-MANAGER FORM OF GOVERNMENT REGULAR MEETING The regular meeting of the Council of the City of Elgin, Illinois, was held on October 22, 2025, in the Council Chambers. The meeting was called to order by Mayor Kaptain at 7:30 p.m. The Pledge of Allegiance was led by Mayor David Kaptain. ROLL CALL Roll call was answered by Councilmembers Alfaro, Dixon, Good, Martinez, Ortiz, Powell, Steffen, Thoren, and Mayor Kaptain. Absent: None. MINUTES OF THE OCTOBER 8, 2025, COUNCIL MEETING APPROVED AS DISTRIBUTED Councilmember Good made a motion, seconded by Councilmember Steffen, to approve the October 8, 2025, regular council meeting minutes as distributed. Upon a roll call vote: Yeas: Councilmembers Alfaro, Dixon, Good, Martinez, Ortiz, Powell, Steffen, Thoren, and Mayor Kaptain. Nays: None. COMMUNICATIONS “Know Your Rights” Presentation by the Elgin Area Immigrant Alliance The Elgin Area Immigrant Alliance provided an abbreviated version of Know your Rights Presentation. A copy of the presentation is on file in the City Clerk’s office. There was discussion regarding identification, immigration enforcement and financial impacts on families. PUBLIC COMMENTS Ed Bates provided details about this year’s Fox Trot and the not-for-profit groups that benefited from the race’s proceeds. Sherry Blaizer commented on how the Elgin History Museum used the funds received from the Fox Trot. Jeremy Lindsey commented on how the Elgin Sharks running team used the funds received from the Fox Trot. 535 OCTOBER 22, 2025 VOLUME XC Angel Martinez commented on the status of the complaint against Officer Lenz. Marlen Romero stated support for the proposed Immigration and Customs Enforcement (ICE) free zones. Maria Nunez commented on Immigration and Customs Enforcement (ICE) enforcement and the proposal to Deferred Action for Childhood Arrivals (DACA) for firefighter hiring eligibility. BID 25-010 AWARDED TO BLUEWATER CONSTRUCTION, LLC FOR LEAD SERVICE LINE REPLACEMENT YEAR 4 (CONTRACT E) Councilmember Ortiz made a motion, seconded by Councilmember Martinez, to award a contract to Bluewater Construction, LLC for Lead Service Line Replacement, Year 4 (Contract E) in the amount of $1,015,840 to improve the water distribution system by replacing lead water service lines located on private and public property. Upon a roll call vote: Yeas: Councilmembers Alfaro, Dixon, Good, Martinez, Ortiz, Powell, Steffen, Thoren, and Mayor Kaptain. Nays: None. BID 25-051 AWARDED TO E. HOFFMAN, INC. FOR THE INSTALLATION OF A CRICKET PITCH AT MEIER PARK Councilmember Thoren made a motion, seconded by Councilmember Steffen, to award a contract to E. Hoffman, Inc. in the amount of $58,370 to purchase all equipment and materials, complete existing site removals, and to install a new cricket pitch at Meier Park. Upon a roll call vote: Yeas: Councilmembers Alfaro, Dixon, Good, Martinez, Ortiz, Powell, Steffen, Thoren, and Mayor Kaptain. Nays: None. SOURCEWELL JOINT PURCHASING AGREEMENT APPROVED WITH ROBE, INC. FOR THE PUBLIC WORKS CANTILEVER GATE RENOVATION Councilmember Good made a motion, seconded by Councilmember Thoren, to approve a contract with Robe, Inc. in the amount of $97,393 for the replacement of the cantilever gates at the Public Works facility. Nays: None. 536 VOLUME XC OCTOBER 22, 2025 ORDINANCE G45-25 PASSED AMENDING CHAPTER 2.08 OF THE ELGIN MUNICIPAL CODE, AS AMENDED, ENTITLED “CITY COUNCIL” AND TITLE 3 OF THE ELGIN MUNICIPAL CODE, AS AMENDED, ENTITLED “BOARDS AND COMMISSIONS” Councilmember Alfaro made a motion, seconded by Councilmember Dixon, to amend Ordinance G45-25 Section 3E regarding electronic attendance to change the word “provide” in the last sentence to read: “…shall use equipment adequate to accomplish”. Ordinance No. G45-25 AN ORDINANCE AMENDING CHAPTER 2.08 OF THE ELGIN MUNICIPAL CODE, AS AMENDED, ENTITLED “CITY COUNCIL,” AND TITLE 3 OF THE ELGIN MUNICIPAL CODE, AS AMENDED, ENTITLED “BOARDS AND COMMISSIONS” WHEREAS, the city council of the City of Elgin has determined that it is desirable to provide for certain amendments to the city council rules regarding travel and expenses, electronic attendance at meetings, and the procedures for materials provided to city council members at a closed meeting under applicable provisions of the Illinois Open Meetings Act (5 ILCS 120/1 et seq.); and WHEREAS, the city council of the City of Elgin has further determined that it is desirable to provide for certain amendments relating to the appointment of city council members and members of the public to certain boards and commissions; and WHEREAS, the City of Elgin is a home rule unit pursuant to Article 7, Section 6, of the Illinois Constitution and as a home rule unit may exercise any power and perform any function pertaining to its government affairs; and WHEREAS, the city council rules of procedure relating to travel and expenses, electronic attendance at meetings, materials provided at closed meetings, and the appointment of persons to boards and commissions pertain to the government affairs of the City of Elgin. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That Chapter 2.08 of the Elgin Municipal Code, as amended, entitled “City Council,” be and is further amended by amending Section 2.08.060 thereof, to be entitled “Travel; expenses,” and to read as follows: 537 OCTOBER 22, 2025 VOLUME XC “2.08.060 – Travel; expenses. A. Members of the city council shall adhere to the travel policy and conference and seminar guidelines applicable to city employees. Members of the city council that attend a conference or seminar on behalf of the city shall report back to the city council a summary of the conference or seminar at a subsequent city council meeting. B. In the event that the city incurs costs for a member of the city council to attend an event or similar function on behalf of the city and the city councilmember is not able to attend the event, such councilmember must notify the city of the councilmember’s inability to attend the event at least five (5) business days prior to the event. If the councilmember does not so notify the city of the councilmember’s inability to attend the event within five business (5) days of the event, the councilmember shall reimburse the city the amount that was paid by the city for the councilmember to attend the event or function unless the inability to attend the event was due to personal illness or disability, illness or death of a family member, or an emergency of a similar nature, or unless such councilmember is able to transfer the ticket or invitation to another councilmember, a member of a board or commission, or an employee of the city that is able to attend the event.” Section 2. That Chapter 2.08 of the Elgin Municipal Code, as amended, entitled “City Council,” be and is further amended by amending subparagraph A of Section 2.08.065 thereof, entitled “Electronic attendance at meetings,” to read as follows: “A. Any member of the city council may attend any open meeting of the city council via electronic means provided that a quorum of the city council is physically present throughout such meeting and such attendance is in compliance with the provisions of this chapter and any applicable laws. Members of the city council may not attend closed meetings of the city council via electronic means. Section 3. That Chapter 2.08 of the Elgin Municipal Code, as amended, entitled “City Council,” be and is further amended by amending subparagraph E of Section 2.08.065 thereof, entitled “Electronic attendance at meetings,” to read as follows: “E. The member participating electronically and other members of the city council must be able to communicate effectively, and members of the audience must be able to hear all communications at the meeting site. In addition, the member participating electronically must be visible via camera or video throughout the meeting. Before allowing electronic attendance at any meeting, the city council shall use equipment adequate to accomplish this objective at the meeting site or shall provide such equipment. Section 4. That Chapter 2.08 of the Elgin Municipal Code, as amended, entitled “City Council,” be and is further amended by amending Section 2.08.080 thereof, entitled “Rules of procedure,” to add a new subparagraph GG to read as follows: 538 VOLUME XC OCTOBER 22, 2025 “GG. Any materials that are provided to councilmembers at a closed meeting under applicable provisions of the Illinois Open Meetings Act (5 ILCS 120/1 et seq.) shall not be removed from the closed meeting.” Section 5. That Chapter 2.08 of the Elgin Municipal Code, as amended, entitled “City Council,” be and is further amended by amending Section 2.08.080 thereof, entitled “Rules of procedure,” to add a new subparagraph HH to read as follows: “HH. Recommendations to the city council for the appointment or reappointment of a person to a board or commission under this code shall be made by two (2) members of the city council, including the mayor, on a rotating basis. After two members of the city council make a recommendation for an appointment or reappointment to a board or commission, two different members of the city council shall be assigned to make the next recommendation for the appointment or reappointment of a person to a board or commission.” Section 6. That Chapter 3.12 of the Elgin Municipal Code, as amended, entitled “Human Relations Commission,” be and is further amended by amending Section 3.12.030 thereof, entitled “Appointment of members; composition; term; salary,” to read as follows: “3.12.030. – Appointment of members; composition; term; salary. A. The human relations commission shall consist of seven (7) members appointed by the city council. Commission members shall be as broadly representative of the community as practically feasible, in such areas as race, color, religion, sex, national origin, age, ancestry, familial status, marital status, physical or mental disability, sexual orientation, gender identity, military status, unfavorable discharge from military service, education, welfare, labor, and management. There shall also be two (2) ex officio nonvoting members of the human relations commission who shall be the city manager and the chief of police of the city. B. Each member as appointed shall serve for a term of three (3) years; except that the terms of initial appointees under this section shall be staggered in such a manner so that the terms of four (4) members shall expire on the first Tuesday of May on each of three (3) successive years. All members of the commission shall continue in such capacity until their successor has been duly appointed and is acting. Any member appointed to fill a vacancy prior to the expiration of the term for which his predecessor was appointed shall serve for the remainder of such term. All members of this commission shall serve without compensation.” Section 7. That Chapter 3.87 of the Elgin Municipal Code, as amended, entitled “Sustainability Commission,” be and is further amended by amending Section 3.87.020 thereof, entitled “Members,” to read as follows: 539 OCTOBER 22, 2025 VOLUME XC “3.87.020. – Members. The Sustainability Commission shall be composed of nine (9) members to be appointed by the City Council. The terms of the members of the Sustainability Commission shall be for three (3) years. Appointments shall expire on June 1 in the anniversary year of the appointment of the member.” Section 8. That all ordinances or parts of ordinance in conflict with the provisions of this ordinance be and are hereby repealed to the extent of any such conflict. Section 9. That the following benefit program is hereby established: Vacation 1 to 5 years of service – 2 weeks 6 to 10 years of service – 3 weeks 11 years to 21 years of service – 4 weeks 22 or more years of service – 5 weeks The city manager, in the city manager’s discretion may also include up to eleven (11) years of non- City of Elgin prior professional or supervisory service of an employee in the same or similar field in determining years of service of an employee for the purpose of vacation at initial hire. If an employee is granted vacation accrual in a higher range than one (1) to five (5) years of service, he or she shall not advance to the next range until he or she has attained the required number of years of service with the city for such range. 548 VOLUME XC OCTOBER 22, 2025 The accumulation of vacation leave shall be limited as provided by Ordinance No. S11-09, as amended. Sick Leave - Fifteen (15) days (in 12-hour increments for Fire shift personnel) will be placed on account when commencing employment, plus annual accrual of one day (8 hours) per month. Employees may accumulate sick leave up to a total maximum accrual of 241 sick days, which is the equivalent of 1928 hours of sick leave. Life Insurance - in an amount equal to the nearest $1,000 of the employee's annual base salary. Holidays - New Year's Day, Martin Luther King Day, Memorial Day, Juneteenth, Independence Day, Labor Day, Thanksgiving Day, the day after Thanksgiving, Christmas Eve, Christmas Day, and New Year's Eve. Fire shift personnel shall receive additional pay for hours actually worked on holidays at a straight- time rate. Twelve (12) hours of personal time off for each holiday which falls on a scheduled day off as well as for each of any undesignated holidays shall also be received by fire shift personnel. Police shift will additionally receive President’s Day, Easter Sunday, Columbus Day, and Veteran’s Day. Police shift personnel will receive additional eight (8) hours holiday pay at their straight-time hourly rate whether the holiday is worked or not. Public Safety Communications Shift Supervisors who are scheduled to and actually work on a holiday shall receive one hour of holiday pay at his or her straight time hourly rate of pay for each hour actually worked on a holiday not to exceed twelve hours of holiday pay for a holiday. A telecommunications supervisor who does not work the holiday will receive eight hours of holiday pay at his or her straight time hourly rate of pay. Personal Days - Three (3) personal days shall be provided per year, but not including Fire shift personnel. Employees commencing employment between January 1 and June 30 in a year shall receive all three (3) personal days for such year. Employees commencing employment between July 1 and December 31 in a year shall receive one (1) personal day for such year. Employees in the Public Safety Communications Shift Supervisor position that are assigned to a 12-hour work day shall instead receive 36 hours of personal time if they commence employment between January 1 and June 30 in a year and 12 hours of personal time if commencing employment between July 1 and December 31 for such year. Longevity Pay – Effective March 14, 2010, employees hired prior to January 1, 2010, shall receive as additional earnings annual longevity pay in the amount of an additional 4% of the employee’s annual salary. Longevity pay shall be paid to employees in installments with each payroll. Employees hired on or after March 1, 2010, shall not be eligible for or receive longevity pay. 549 OCTOBER 22, 2025 VOLUME XC Sick Leave Conversion Sworn Police Management – Sworn police management employees may accumulate sick leave up to a total maximum accrual of 241 sick days, which is equivalent to a maximum of 1,928 hours of sick leave time. In recognition of non-use of sick leave time, police management employees shall be eligible for a severance sick leave conversion payment upon separation from employment. Such severance payment shall be equivalent to twenty-five percent (25%) of the value of the employee's accumulated and unused sick leave as of the effective date of the employee's separation from employment and shall be paid to the employee in a lump sum, minus any applicable deductions. For the purposes of this section, the employee's hourly wage shall be equivalent to the employee's hourly wage rate inclusive of annual longevity pay paid to the employee, if any. IMRF Employees - Upon retirement or leaving city employment in good standing, general employees may be eligible to convert accrued sick leave for severance pay. Employees with accrued sick leave of more than 720 hours may convert up to a maximum of 480 hours of sick leave for severance pay, provided the remaining balance of accrued sick leave does not total less than 720 hours. Such conversion shall be at the rate of 24 hours of sick leave for eight hours of severance pay, not to exceed 160 hours of severance pay. Accrued sick leave applied by an employee for IMRF service credit shall not be eligible for sick leave conversion for severance pay. The provisions of this section shall not apply to police management employees. Fire Pension Employees - Upon retirement or leaving city employment in good standing, fire pension-eligible employees may be eligible to convert accrued sick leave for severance pay. Employees with accrued sick leave of more than 1,080 hours may convert up to a maximum of 720 hours of sick leave for severance pay, provided the remaining balance of accrued sick leave does not total less than 1,080 hours. Such conversion shall be at the rate of thirty-six (36) hours of sick leave for twelve (12) hours of severance pay, not to exceed two hundred and forty hours (240) hours of severance pay. Sick Leave Conversion For Vacation Leave - Accrued sick leave over 480 hours (60 days) (or over 720 hours (60-12 hour days) for fire shift employees) may be converted at the rate of three (3) days of sick leave for one (1) day of vacation leave. Such conversion is limited to a maximum of five (5) days of vacation leave (or 12-12 hour periods for fire shift employees) in any one calendar year. The minimum balance of sick leave after such conversion shall not be less than 60 days. Medical Insurance - Comprehensive major medical insurance program for employee and dependents with employee option to continue coverage upon separation from employment according to one of the available coverage options. Effective March 1, 2010, for employees hired prior to March 1, 2010, the City will pay 85% of the specified premium for the coverage selected (i.e., single, single plus children, single plus spouse, or family) and the employee will pay via payroll deduction the remaining 15% of the specified premium. Effective March 1, 2010, for employees hired on or after March 1, 2010, the City will pay 80% of the specified premium for the coverage selected (i.e., single, single plus children, single plus spouse, or family) and the 550 VOLUME XC OCTOBER 22, 2025 employee will pay via payroll deduction the remaining 20% of the specified premium. Notwithstanding anything to the contrary in Ordinance G70-02, as amended, employees hired on or after March 1, 2010, shall not be eligible to continue to participate in the City’s group health insurance plan pursuant to Ordinance No. G70-02, as amended. Employees who have alternative health insurance coverage may elect to discontinue to participate in the City’s health insurance plan pursuant to the City’s health insurance opt out program adopted pursuant to Resolution No. 05-38, as amended by Resolution No. 09-24. The opt out benefit to such employees shall be in the annual amount of $3,000 prorated based upon employment with the city during the applicable plan year and shall be paid at the employee’s option either to a Health Reimbursement Account or in the form of additional compensation to the employee to be paid in a lump sum, less appropriate deductions, on the first check in December in the applicable plan year. Paid Parental Leave - Employees subject to this ordinance are eligible to receive a total of eight (8) weeks of paid parental leave within any said 12-month period, measured backward from the date a leave is taken, for the birth and care of the employee’s newborn child, or for the placement of a child, younger than eighteen (18), with the employee for adoption or foster care. To be eligible for paid parental leave, employees must: • Have worked for the city for at least twelve (12) months; and • Have completed at least 1,250 hours of work in the preceding twelve (12) months. Conditions of Use: • Paid parental leave must be taken in a continuous block of time. • Leave must be used within the 12-month period beginning on the date of birth or placement. • Employees must apply for and be approved to utilize Family and Medical Leave (FMLA), which will run concurrently with paid parental leave. • Eligibility and use of leave will be subject to guidelines established by Human Resources and approved by the City Manager. Payout Prohibition: Under no circumstances will unused paid parental leave be paid out, including but not limited to instances of separation from employment. Car Allowance – $350 per month car allowance for the following positions: Corporation Counsel, Chief Financial Officer, Assistant City Manager, Human Resources Director, Community Development Director, Parks and Recreation Director, Communications Director, Water Director, Director of Neighborhood Services, Director of Cultural Arts and Special Events, and Economic Development Director. Fire Battalion Chiefs - Fire Battalion Chiefs shall be paid at their current hourly rate of pay at straight time for hours worked filling a vacant shift position on a scheduled day off which otherwise would have been filled by overtime. This provision shall relate only to shift positions only and not any other duties. 551 OCTOBER 22, 2025 VOLUME XC Sworn Police Uniform Allowances - $50 uniform allowance differential for Sworn police management personnel above the authorized annual employee allowances for the Police employee group, in addition to providing replacement for uniforms damaged while on duty. Sworn Police Court Appearance – Sworn police management personnel shall receive compensation for court appearance on days off at a rate equivalent to 150% of their current hourly rate of pay for actual hours with a minimum of two hours pay. Total compensation for standby for court duty on day off is $40. Police Lieutenants and Police Sergeants shall be paid at a rate equivalent to 150% of their current hourly rate of pay for hours worked over 8.25 hours per day. Police Lieutenants and Police Sergeants shall have the option of compensatory time for hours in excess of their regular 8.25 shift hours with a maximum accrual of 80 hours. Sworn Police Management Voluntary Fitness Program – Sworn police management personnel shall be eligible to participate in the police department's voluntary physical fitness program under the same terms and conditions provided for other police department employees. Language Proficiency Stipend - Management employees who are certified by the City or a third party selected by the City to be proficient in Spanish, Laotian or sign language shall be paid a stipend of $50 per month. It must be used in their job. Adjustment of Pay Grades - The City Manager, in the City Manager’s discretion, may either increase or decrease the pay grades for positions within the non-bargaining unit member group based upon the completion of periodic salary or market surveys. Such adjustments shall be limited to movement within classifications and shall not exceed the maximum amount of compensation as established by the City Council in the most recent ordinance establishing the pay and benefit plans for the non-bargaining unit member group. Such adjustments of pay grades by the City Manager shall be identified in the subsequent ordinance to be adopted by the City Council establishing a pay and benefit plan for the non-bargaining unit member group. Section 3. That all ordinances in conflict with the provisions of this ordinance are hereby repealed to the extent of any such conflict. Section 4. G30-22 WHEREAS, the City Council of the City of Elgin, by adopting Ordinance No. G25-08 on May 28, 2008, designated the portions of Randall Point Executive Center Subdivision and Randall Point Executive Center II Subdivision as part of the Randall Road/I 90 Area of Special Character (the “Randall Road/I 90 Area of Special Character”) pursuant to Section 19.50.105 of the Elgin Municipal Code, as amended; and WHEREAS, the City Council of the City of Elgin, by adopting Ordinance No. G29-08 on May 8, 2008, approved the special regulations for street graphics for the Randall Road / I 90 Area of Special Character; and WHEREAS, the City Council of the City of Elgin, by adopting Ordinance No. G40-10 on August 11, 2010, amended the special regulations for street graphics previously provided pursuant to Ordinance No. G29-08; and 554 VOLUME XC OCTOBER 22, 2025 WHEREAS, the City Council of the City of Elgin, by adopting Ordinance No. G30- 22 on July 13, 2022, further amended the special regulations for street graphics previously provided pursuant to Ordinance No. G29-08, as amended by Ordinance No. G40-10; and WHEREAS, written application has been made to further amend the special regulations for street graphics within the Randall Road / I 90 Area of Special Character pursuant to Ordinance No. G29-08, as amended by Ordinance No. G40-10 and Ordinance No. G30-22, to allow a larger- than-permitted monument graphic at 2125 Point Boulevard; and WHEREAS, the Planning and Zoning Commission conducted a public hearing concerning said application on September 8, 2025, following due notice including by publication; and WHEREAS, the Community Development Department and the Planning and Zoning Commission have submitted their Findings of Fact concerning said application; and WHEREAS, the Community Development Department and the Planning and Zoning Commission recommend approval of said application, subject to the conditions articulated below; and WHEREAS, the City Council of the City of Elgin, Illinois, has reviewed the findings and recommendations of the Community Development Department and the Planning and Zoning Commission; and WHEREAS, the City of Elgin is a home rule unit and as a home rule unit may exercise any power and perform any function pertaining to its government and affairs; and WHEREAS, zoning, including, but not limited to, this ordinance granting an amendment to the special regulations for street graphics within an area of special character established by Ordinance No. G29-08, as amended by Ordinance No. G40-10 and Ordinance No. G30-22, pertains to the government and affairs of the city; and WHEREAS, the City Council of the City of Elgin further finds that the use of the Portions of Randall Point Executive Center Subdivision and Randall Point Executive Center II Subdivision as an office park presents specified unique challenges and demands such that the City's street graphic ordinance cannot adequately regulate street graphics for such use in such area; and WHEREAS, the amended special regulations for the portions of Randall Point Executive Center Subdivision and Randall Point Executive Center II Subdivision are consistent with the unique character and unique use of the Randall Road/I 90 Area of Special Character and departures from the street graphics ordinance as contained within such amended special regulations are limited to address the unique and particular area characteristics and use characteristics of the portions of Randall Point Executive Center Subdivision and Randall Point Executive Center II Subdivision portion of the Randall Road/I 90 Area of Special Character. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: 555 OCTOBER 22, 2025 VOLUME XC Section 1. G52-01 (1475 Larkin Avenue) WHEREAS, by adopting Ordinance No. G52-01 on July 11, 2001, the City Council of the City of Elgin granted a conditional use for a master signage plan at 1475 Larkin Avenue; and WHEREAS, written application has been made to reclassify certain property located at 1475 Larkin Avenue from CF Community Facility District to PCF Planned Community Facility District to construct improvements to Larkin High School athletic field (stadium), and to amend 557 OCTOBER 22, 2025 VOLUME XC conditional use Ordinance No. G52-01 to allow a new scoreboard sign adjacent to the new stadium; and WHEREAS, the zoning lot containing the premises at 1475 Larkin Avenue is legally described herein (the “Subject Property”); and WHEREAS, the Planning and Zoning Commission conducted a public hearing concerning said application on September 8, 2025, following due notice including by publication; and WHEREAS, the Community Development Department and the Planning and Zoning Commission have submitted their Findings of Fact concerning said application; and WHEREAS, the Community Development Department and the Planning and Zoning Commission recommend approval of said application, subject to the conditions articulated below; and WHEREAS, the City Council of the City of Elgin, Illinois, has reviewed the findings and recommendations of the Community Development Department and the Planning and Zoning Commission; and WHEREAS, the City of Elgin is a home rule unit and as a home rule unit may exercise any power and perform any function pertaining to its government and affairs; and WHEREAS, zoning, including, but not limited to, this ordinance granting a planned development as a map amendment from CF Community Facility District to a PCF Planned Community Facility District and repealing conditional use Ordinance No. G52-01 pertains to the government and affairs of the city. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That Ordinance No. G52-01 is hereby repealed. Section 2. That the City Council of the City of Elgin hereby adopts the Findings of Fact, dated September 8, 2025, and the recommendations made by the Community Development Department and the Planning and Zoning Commission, a copy of which is attached hereto and made a part hereof by reference as Exhibit A. Section 3. That the City Council of the City of Elgin hereby grants the rezoning from CF Community Facility District to PCF Planned Community Facility District at 1475 Larkin Avenue, which shall be designed, developed, and operated subject to the following provisions: A. Purpose and Intent. The purpose of the PCF Planned Community Facility District is to provide a planned environment for various types of community facilities, subject to the provisions of Chapter 19.60 “Planned Developments” of the Elgin Municipal Code, as amended. In general, community facilities provide governmental, recreational, educational, health, social, religious, and transportation services to the community on a for-profit or on a not-for-profit basis. B. Supplementary Regulations. Any word or phrase contained herein, followed by the symbol “[SR]”, shall be subject to the definitions and the additional interpretive requirements provided in Chapter 19.90 “Supplementary Regulations”, of the Elgin Municipal Code, as amended. The exclusion of such symbol shall not exempt such word or phrase from the applicable supplementary regulation. C. General Provisions. In this PCF Planned Community Facility District, the use and development of land and structures shall be subject to the provisions of Chapter 19.05 “General Provisions”, of the Elgin Municipal Code, as amended. 560 VOLUME XC OCTOBER 22, 2025 D. Zoning Districts; Generally. In this PCF Planned Community Facility District, the use and development of land and structures shall be subject to the provisions of Chapter 19.07 “Zoning Districts”, of the Elgin Municipal Code, as amended. E. Location and Size of District. PCF Planned Community Facility Districts should be located in substantial conformance to the official comprehensive plan. The amount of land necessary to constitute a separate PCF Planned Community Facility District exclusive of rights of way, but including adjoining land or land directly opposite a right of way shall not be less than two (2) acres. No departure from the required minimum size of a planned community facility district shall be granted by the City Council. F. Land Use. In this PCF Planned Community Facility District, the use and development of land and structures shall be subject to the provisions of Chapter 19.10 “Land Use”, of the Elgin Municipal Code, as amended. The following enumerated “land uses” [SR] shall be the only land uses allowed as a “permitted use” [SR] or as a “conditional use” [SR] in this PCF Planned Community Facility District: 1. Permitted Uses. Those land uses enumerated as permitted uses within the CF Community Facility District, Section 19.30.130 A., Land Use, of the Elgin Municipal Code, as it may be amended from time to time. 2. Conditional Uses. Those land uses enumerated as conditional uses within the CF Community Facility District, Section 19.30.130 B., Land Use, of the Elgin Municipal Code, as it may be amended from time to time. G. Site Design. In this PCF Planned Community Facility District, the use and development of land and structures shall be subject to the provisions of Section 19.12, “Site Design”, of the Elgin Municipal Code, as amended, and Section 19.30.135 “Site Design” for CF Community Facility District, of the Elgin Municipal Code, as amended, except as provided within this section, and shall be in substantial conformance with the following documents: 12. Substantial conformance to the Development Application submitted by School District U-46, as applicant and property owner, received July 1, 2025, and supporting documents including: a. Undated Statement of Purpose and Conformance, prepared by Cage Civil Engineering, dated received August 26, 2025; b. Boundary and Partial Topographic Survey, prepared by Cage Civil Engineering, dated February 7, 2025; c. Plans titled Proposed Improvements for Stadium Improvements at Larkin High School 1475 Larkin Avenue, Elgin, IL 60123, prepared by Arcon, dated June 23, 2025, with such further revisions as required by the Community Development Director; 561 OCTOBER 22, 2025 VOLUME XC d. Four-page plans for outdoor pavilion, prepared by Superior Recreational Products, dated received August 13, 2025, with such further revisions as required by the Community Development Director; e. Four-page landscape plans titled Stadium Improvements consisting of Sheets L.1, L.2, L.3, and L.4, prepared by Arcon, dated June 20, 2025, last revised October 7, 2025,with such further revisions as required by the Community Development Director; f. Fifteen-page lighting plans titled Larkin High School Soccer / Track Elgin, IL, prepared by Musco, dated June 5, 2025, with such further revisions as required by the Community Development Director; and g. Undated three-page photographs of the existing monument sig for Larkin High School located northeast of the proposed stadium along S. McLean Boulevard, dated received August 13, 2025, with such further revisions as required by the Community Development Director. In the event of any conflict between such documents and the terms of this ordinance or other applicable city ordinances, the terms of this ordinance or other applicable city ordinances shall supersede and control. 13. A departure is hereby granted to allow the construction of a three-foot-high chain link fence surrounding the track of the stadium, a six-foot-high chain link fence surrounding the stadium area on the north, west, and south sides, and a six-foot-high black ornamental fence surrounding the east side of the stadium and also located along the east property line of the Subject Property along S. McLean Boulevard. The departure is hereby also granted to maintain and replace in-kind all existing chain link fences and netting within and surrounding the athletic fields south of the high school building, including but not limited to all six-foot-high chain link fences surrounding various athletic fields and the property, and the ten-foot-high chain link fence surrounding the tennis courts. 14. A departure is hereby granted to allow the installation of accessory building and accessory structures, including but not limited to stadium bleacher stands with and without a press box, concessions and locker room building, an outdoor pavilion structure, and two ticket booth buildings all located within the street yard south of the school building. The departure is hereby also granted to maintain and replace in-kind all existing accessory building and structures located in the street yards surrounding the building, including but not limited to baseball field dugouts and accessory storage buildings. 15. Compliance with all applicable codes and ordinances. H. Off Street Parking. In this PCF Planned Community Facility District, off-street parking shall be subject to the provisions of Chapter 19.45 “Off Street Parking”, of the Elgin Municipal Code, as amended. 562 VOLUME XC OCTOBER 22, 2025 I. Off Street Loading. In this PCF Planned Community Facility District, off-street loading shall be subject to the provisions of Chapter 19.47 “Off Street Loading”, of the Elgin Municipal Code, as amended. J. Signs. In this PCF Planned Community Facility District, signs shall be subject to the provisions of 19.50 “Street Graphics”, of the Elgin Municipal Code, as amended, except as provided within this section, and shall be in substantial conformance with the following: 1. A departure is hereby granted to allow the installation of three freestanding monument graphics on the Subject Property. The three freestanding monument graphics hereby allowed shall be limited to: a. One scoreboard graphic with the maximum height of 20 feet 2 inches and maximum sign surface area of 362 square feet, including a 189-squre-foot scoreboard sign panel. b. One monument graphic generally located at the southwest corner of Larkin Avenue and S. McLean Boulevard with a maximum height of eight feet four inches, maximum width of 15 feet three inches, and a total sign surface area of 125 square feet. c. One monument graphic generally located along S. McLean Boulevard northeast of the proposed stadium with a maximum height of six feet and maximum sign surface area of 35 square feet. 2. The monument graphic located at the southwest corner of Larkin Avenue and S. Mclean Boulevard shall be in substantial conformance with the Elevation and Site Plan, submitted by White Way Sign Company, dated June 21, 2001 (final revision date), submitted as part of the development application for master signage plan at 1475 Larkin Avenue, petition #27-01. 3. The monument graphic located at the southwest corner of Larkin Avenue and S. McLean Boulevard shall be designed so that it is a monument style sign, or designed so that a solid screen of landscaping is provided and maintained at the base of the sign. 4. The landscaping in the area surrounding the sign located at the southwest corner of Larkin Avenue and S. McLean Boulevard shall be well maintained and kept free of weeds. 5. The monument sign at the southwest corner of Larkin Avenue and S. McLean Boulevard shall not exceed 8’4” in height and 15’3” in width for a total of 127 square feet of surface area. K. Nonconforming Uses and Structures. In this PCF Planned Community Facility District, nonconforming uses and structures shall be subject to the provisions of 563 OCTOBER 22, 2025 VOLUME XC Chapter 19.52 “Nonconforming Uses and Structures” of the Elgin Municipal Code, as amended. L. Amendments. In this PCF Planned Community Facility District, text and map amendments shall be subject to the provisions of Chapter 19.55 “Amendments” of the Elgin Municipal Code, as amended. M. Planned Developments. In this PCF Planned Community Facility District, the use and development of the land and structures shall be subject to the provisions of Chapter 19.60 “Planned Developments” of the Elgin Municipal Code, as amended. A conditional use for a planned development may be requested by the property owner without requiring an amendment to this PCF zoning district. N. Conditional Uses. In this PCF Planned Community Facility District, conditional uses shall be subject to the provisions of Chapter 19.65 “Conditional Uses”, of the Elgin Municipal Code, as amended. A conditional use may be requested by the property owner without requiring an amendment to this PCF zoning district. O. Variations. In this PCF Planned Community Facility District, variations shall be subject to the provisions of Chapter 19.10.500 “Authorized Land Use Variations”, Chapter 19.12.800 “Authorized Site Design Variations”, and Chapter 19.70 “Variations”, of the Elgin Municipal Code, as amended. A variation may be requested by the property owner without requiring an amendment to this PCF zoning district. P. Appeals. Any requirement, determination, or interpretation associated with the administration and enforcement of the provisions of this ordinance may be appealed subject to the provisions of Chapter 19.75 “Appeals”, of the Elgin Municipal Code, as amended.
