APRIL 22, 2026 VOLUME XCI COUNCIL OF THE CITY OF ELGIN, ILLINOIS COUNCIL-MANAGER FORM OF GOVERNMENT REGULAR MEETING The regular meeting of the Council of the City of Elgin, Illinois, was held on April 22, 2026, in the Council Chambers. The meeting was called to order by Mayor Kaptain at 7:05 p.m. The Pledge of Allegiance was led by Mayor David Kaptain. ROLL CALL Roll call was answered by Councilmembers Alfaro, Dixon, Good, Martinez, Ortiz, Powell, Steffen, Thoren, and Mayor Kaptain. Absent: None. Councilmember Steffen made a motion, seconded by Councilmember Martinez, to permit Councilmember Thoren to participate electronically at this meeting. MINUTES OF THE APRIL 8, 2026, COUNCIL MEETING APPROVED AS DISTRIBUTED Councilmember Martinez made a motion, seconded by Councilmember Good, to approve the April 8, 2026, regular council meeting minutes as distributed. COMMUNICATIONS Mayor Brandon Johnson Proclamation Councilmember Powell read the following proclamation: PROCLAMATION WHEREAS, Brandon Johnson, a proud native of Elgin, has demonstrated a lifelong commitment to service, leadership, and community empowerment; and 156 VOLUME XCI APRIL 22, 2026 WHEREAS, his formative years were shaped within Elgin’s public schools – beginning at Garfield Elementary School and Ellis Middle School, culminating in his graduation from Elgin High School – where he developed the character, resilience, and vision that would guide his life’s work; and WHEREAS, he continued his educational journey at Elgin Community College and Aurora University, reflecting a steadfast commitment to personal growth and lifelong learning; and WHEREAS, his dedication to youth development was evident early on through his service as a youth leader at Community Center Christian Ministries, the ministry founded by his parents, Andrew L. Johnson and Wilma Jean Johnson, where he mentored young people through music and character development; and WHEREAS, his foundation of faith, service and family was further rooted in the legacy of his grandfather, Leonard R. Spates Sr. of Spates Temple COGIC, instilling values in him that continue to guide his public life; and WHEREAS, through his service as Mayor of Chicago, he has brought honor to his hometown, exemplifying principled leadership and a deep commitment to equity, education, and opportunity for all, and serving as a source of pride and inspiration to the residents of Elgin; and NOW, THEREFORE, I, David Kaptain, Mayor of the City of Elgin, Illinois, do hereby proudly recognize and honor Brandon Johnson for his outstanding achievements, his unwavering commitment to service, and for being a distinguished son and proud alumnus of Elgin High School, whose impact reaches beyond the City’s boarders, and whose legacy, leadership, and example continue to inspire future generations. Kaptain Mayor Asian Pacific Heritage and Lao New Year Proclamation Mayor Kaptain read the following proclamation: PROCLAMATION WHEREAS, the month of April was established as Lao New Year Celebration Month and the month of May was established as Asian Pacific American Heritage Month, our community’s Asian population will continue celebrating these two milestones through the month of May; and WHEREAS, these celebrations are designed to combat polarization and stereotypes, and 157 APRIL 22, 2026 VOLUME XCI to improve understanding and cooperation among people from different cultures; and WHEREAS, Lao New Year Celebration Month and Asian Pacific American Heritage Month allow all citizens to celebrate and support each other’s culture and heritage in the Elgin community; and WHEREAS, Lao New Year Celebration Month and Asian Pacific American Heritage Month Celebration provide occasions of hopes to build relationships with community members and encourage support for the Asian population in Elgin. Kaptain Mayor Sikh Heritage Month Proclamation Councilmember Martinez read the following proclamation: PROCLAMATION WHEREAS, Sikhs have been living in the United States for more than 120 years, during the early 20th century, thousands of Sikh Americans worked on farms, in lumber mills and mines, and on the Oregon, Pacific & Eastern Railroad; and WHEREAS, Sikhism is the fifth largest religion in the world and today, there are more than 25 million Sikhs worldwide and an estimated 500,000 Sikh Americans and 25000 Sikhs in the State of Illinois; and WHEREAS, Sikh Americans pursue diverse professions, and make rich contributions to the social, cultural, and economic vibrancy of the United States, including service as members of the United States Armed Forces and significant contributions to our great nation in agriculture, information technology, small businesses, the hotel industry, trucking, medicine, legal services and technology; and WHEREAS, Sikh Americans distinguished themselves by fostering respect among all people through faith and service; and WHEREAS, The city of Elgin is committed to educating citizens about the world’s religions, the value of religious diversity, tolerance grounded in First Amendment principles, a culture of mutual understanding, and the diminution of violence; and WHEREAS, Today, the City of Elgin seeks to further the diversity of its community and afford all residents the opportunity to better understand, recognize, and appreciate the rich history and shared experiences of Sikh Americans; and NOW, THEREFORE, I, David Kaptain, Mayor of the City of Elgin, Illinois, do hereby proclaim the month of April as Sikh Awareness and Appreciation Month in the City of Elgin. 159 APRIL 22, 2026 VOLUME XCI IN WITNESS WHEREOF, I have hereunto set my hand this 22nd day of April 2026. BID 26-006 AWARDED TO IHC CONSTRUCTION COMPANIES, LLC FOR LEAD SERVICE LINE REPLACEMENT—YEAR 5 (CONTRACT C) Councilmember Powell made a motion, seconded by Councilmember Good, to award a contract to IHC Construction Companies, LLC in the amount of $4,165,270 for the Year 5 Lead Service Line Replacement to improve the water distribution system by replacing lead water service lines located on private and public property. FOR THE 2026 PAVEMENT MARKING PROGRAM Councilmember Martinez made a motion, seconded by Councilmember Steffen, to award the 2026 pavement marking program bid to Maintenance Coatings, Co. in the amount of $461,340 to provide clear traffic guidance on city-maintained roads through annual maintenance marking programming. Nays: None. 160 VOLUME XCI APRIL 22, 2026 ORDINANCE S2-26 PASSED PROVIDING FOR THE ISSUANCE OF APPROXIMATELY $23,995,000 GENERAL OBLIGATION CORPORATE PURPOSE BONDS, SERIES 2026, OF THE CITY FOR THE PURPOSE OF FINANCING WATER AND SEWER UTILITY PROJECTS WITHIN THE CITY AND PAYING THE EXPENSES INCIDENT THERETO, PROVIDING FOR THE LEVY AND COLLECTION OF A DIRECT ANNUAL TAX SUFFICIENT TO PAY THE PRINCIPAL OF AND INTEREST ON THE BONDS, AND AUTHORIZING THE SALE OF THE BONDS TO THE PURCHASER THEREOF Councilmember Ortiz made a motion, seconded by Councilmember Steffen, to amend Ordinance S2-26 to reflect the total issued of $24,335,000. Ordinance No. G15-26 AN ORDINANCE AMENDING CHAPTER 5.18 OF THE ELGIN MUNICIPAL CODE ENTITLED “LEASES FOR DESIGNATED CITY FACILITIES AND PERFORMANCE CONTRACTS FOR HEMMENS AUDITORIUM” WHEREAS, Chapter 5.18 of the Elgin Municipal Code, entitled “Leases for Designated City Facilities and Performance Contracts for Hemmens Auditorium,” expressly authorizes the City Manager to award performance contracts for entertainment performances to be conducted in the Hemmens Auditorium in accordance with the procedures set forth therein; and WHEREAS, since the 1997 establishment of the procedures in Chapter 5.18 for awarding performance contracts, the City’s event and entertainment programming has grown significantly and is no longer limited to the specific locations identified in Chapter 5.18; and 161 APRIL 22, 2026 VOLUME XCI WHEREAS, the City Council of the City of Elgin has determined it is necessary and desirable to amend Chapter 5.18 to authorize the City Manager to award performance contracts for entertainment performances for all venues managed by or events conducted by the City; and WHEREAS, the City of Elgin is a home rule unit of government, and pursuant to Article VII, Section 6(a) of the Illinois Constitution, may exercise any power and perform any function pertaining to its government and affairs; and WHEREAS the adoption of an ordinance amending the regulation and procedures for the procurement of supplies, services, and construction pertains to the government and affairs of the City of Elgin. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That foregoing recitals are hereby incorporated into this ordinance as though fully set forth herein. Section 2. That Chapter 5.18 of the Elgin Municipal Code, entitled “Leases for Designated City Facilities and Performance Contracts for Hemmens Auditorium,” be and is hereby retitled “Leases for City Facilities and Performance Contracts,” and amended in its entirety to read as follows: “CHAPTER 5.18. – LEASES FOR CITY FACILITIES AND PERFORMANCE CONTRACTS 5.18.010. – Generally. Lease agreements with third parties for events to be conducted in city facilities and performance contracts for entertainment performances to be conducted at city venues or events be made by the city manager in accordance with the procedures authorized in this chapter. 5.18.020. – Procedures. The city manager or designee shall be responsible for the initial negotiation of the lease agreements with third parties for events to be conducted in city facilities and performance contracts for entertainment performances to be conducted at city venues or events. All such leases and performance contracts shall be forwarded to the corporation counsel for review and approval. All such performance contracts shall also be forwarded to the fiscal services manager for the manager’s determination as to whether a budget appropriation has previously been made and whether sufficient funds remain available for the proposed performance contract. Upon final approval by the corporation counsel and upon the fiscal services manager certifying in writing the existence of a budget appropriation and sufficient remaining funds for performance contracts, such leases and performance contracts shall be forwarded to the city manager for consideration of award and execution. 162 VOLUME XCI APRIL 22, 2026 5.18.030. – Reports to council. All leases and performances contracts under this chapter which have not been approved by the city council shall be reported monthly to the city council.” Section 3. That all ordinances or parts of ordinance in conflict with the provisions of this ordinance are hereby repealed to the extent of any such conflict. Section 4. Resolution No. 26-72 RESOLUTION ADOPTING THE CITY OF ELGIN ADA TRANSITION PLAN WHEREAS, the City of Elgin (hereinafter referred to as the “City”) is a home rule unit pursuant to subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and WHEREAS, the City of Elgin as a home rule unit, may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and 163 APRIL 22, 2026 VOLUME XCI WHEREAS, pursuant to Title II of the Americans with Disabilities Act (ADA) of 1990, the City of Elgin cannot discriminate against qualified individuals with disabilities in its services, programs, or activities; and WHEREAS, the ADA requires public entities such as the City of Elgin to periodically update an ADA Transition Plan to identify accessibility barriers in its public rights-of-way and to develop a schedule for addressing them; and WHEREAS, the City began developing an ADA Transition Plan (titled Plan for Accessible Streets and Sidewalks) in January 2025, in partnership with Vitruvian Planning and funded by a grant from the Chicago Metropolitan Agency for Planning (CMAP); and WHEREAS, the plan’s development was led by a steering committee of community stakeholders and representatives from CMAP, and City staff, with public input from approximately 400 residents who participated in surveys and meetings; and WHEREAS, the City Council has reviewed the Plan for Accessible Streets and Sidewalks and finds that adopting the plan for its ADA Transition Plan is in the best interest of the City and its residents and will serve as a guide for future accessibility projects that enhance walkability throughout the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. The foregoing recitals are hereby incorporated into and made a part of this Resolution as though fully set forth herein. Section 2. Resolution No. 26-73 RESOLUTION AUTHORIZING A GRANT TO PUBLIC ACTION TO DELIVER SHELTER, INC. (PADS OF ELGIN) WHEREAS, the City of Elgin is a home rule unit of government under Article VII, Section 6 of the Constitution of the State of Illinois and may exercise any power and perform any function pertaining to its government and affairs; and WHEREAS, the City of Elgin is committed to addressing homelessness through comprehensive action and compassionate support, with the goal of ensuring every individual has access to safe, stable housing and the resources needed to thrive; and WHEREAS, Public Action to Deliver Shelter, Inc. (PADS of Elgin) was incorporated in 1989 as a nonprofit 501(c)(3) organization and has long served the community through programs addressing homelessness; and WHEREAS, the City of Elgin recognizes the important public benefit provided by PADS of Elgin through services to individuals and families experiencing homelessness and housing insecurity; and WHEREAS, PADS of Elgin provides shelter, supportive services, case management, and related assistance that promote the health, safety, and welfare of residents of the City of Elgin; and WHEREAS, PADS of Elgin operates a year-round shelter that provides a safe and secure environment for guests, including sleeping accommodations, separate sleeping quarters for men and for women with children, shower and laundry facilities, and daily meals; and WHEREAS, in addition to shelter services, PADS of Elgin provides comprehensive case management and individualized action plans designed to help guests achieve stability and independence; and WHEREAS, supportive services offered through PADS of Elgin include financial literacy, life skills training, counseling, referrals, mental health assessments, substance abuse support, advocacy, employment assistance, and educational opportunities; and 165 APRIL 22, 2026 VOLUME XCI WHEREAS, PADS of Elgin is experiencing an immediate financial hardship that threatens its ability to continue providing shelter, case management, and supportive services to individuals experiencing homelessness in the community; and WHEREAS, despite substantial community support that helped offset prior federal funding losses, PADS of Elgin continues to face urgent short-term funding needs; and WHEREAS, PADS of Elgin has undertaken expense reductions where possible while maintaining the safety of shelter guests, staff, and operations; and WHEREAS, absent immediate financial assistance, PADS of Elgin may be required to implement significant staffing and program reductions that would negatively impact services to residents of the City of Elgin experiencing homelessness or housing insecurity; and WHEREAS, the City Council has determined that providing financial assistance to PADS of Elgin serves a valid public purpose and is in the best interests of the City and its residents; and WHEREAS, the City Council further finds that the funds authorized herein are intended as a direct contribution to support the organization’s mission and operations and shall not be subject to reimbursement to the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, as follows: Section 1. That the City Manager, or designee, is hereby authorized and directed to provide a contribution in the amount of $200,000 to PADS of Elgin. Section 2. That such contribution is made for a public purpose in support of services benefiting residents of the City of Elgin. Section 3. That the funds provided pursuant to this Resolution are a grant and PADS of Elgin shall have no obligation to repay or reimburse the City for such funds. Section 4. Resolution No. 26-66 RESOLUTION RATIFYING THE ACCEPTANCE OF A GRANT FROM METROPOLITAN MAYORS CAUCUS (MMC) AND RATIFYING THE EXECUTION OF AN AGREEMENT RELATING THERETO IN CONNECTION WITH LOW INCOME ENERGY EFFICIENCY OUTREACH AND ENGAGEMENT BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that it accepts a grant from the Metropolitan Mayors Caucus in the amount of $22,275 and hereby ratifies and approves Richard G, Kozal, City Manager, accepting such grant on behalf of the City of Elgin.
