GENEVA CITY COUNCIL MEETING MARCH 16, 2015 CALL TO ORDER The March 16, 2015 meeting of the Geneva City Council was called to order at 7:05 p.m. in the Council Chambers of City Hall by Mayor Kevin Burns. Aldermen present: Chuck Brown, Mike Bruno, Don Cummings, Dorothy Flanagan, Dean Kilburg, Craig Maladra, Richard Marks, Mary Seno, Tom Simonian, Ron Singer. Aldermen absent: None. Also attending: Acting City Atty. Scott Fintzen, City Administrator Mary McKittrick, Asst. City Administrator/Dir. of Administrative Services Stephanie Dawkins, Public Works Director Richard Babica, Economic Development Director Cathleen Tymoszenko, Community Development Director David DeGroot, Police Chief Steve Mexin. PLEDGE OF ALLEGIANCE Led by Girl Scouts from Heartland School, Harrison Street School, Middle School North, and Middle School South. PUBLIC HEARINGS, SPECIAL ITEMS AND PRESENTATIONS Oath of Office – Police Officer Dustin Haney Mayor Burns asked Officer Haney to step forward. Officer Haney introduced family members present. He was then sworn in by Clerk Landberg. Welcome Geneva Girl Scouts and Proclaim March 15-21 as Girl Scouts Week Mayor Burns welcomed the Girl Scouts, who then spoke to their activities and achievements. Moved by Ald. Marks, seconded by Ald. Singer to proclaim March 15-31 as Girl Scouts Week. Carried unanimously by voice vote. MOTION CARRIED Mayor Burns presented the Scouts with a copy of the proclamation. Recognize Geneva High School Girls Gymnastics Team Mayor Burns greeted the GHS Girls Gymnastic Team, which finished second in the 2015 state tournament. Each team member introduced herself and stated her gymnastic specialty. The Mayor presented a Certificate of Recognition to each team member. He also unveiled a road sign recognizing gymnast Clair Rose Ginsberg’s 2014 all-around state championship. Proclaim March as Ethics Awareness Month Moved by Ald. Marks, seconded by Ald. Cummings to proclaim March as Ethics Awareness Month. Carried unanimously by voice vote. MOTION CARRIED OMNIBUS AGENDA All items listed on the Omnibus Agenda are considered to be routine by the Council and will be enacted by one motion. There will be no separate discussion on these items unless a Council member or citizen so requests in which event the item will be removed from the Omnibus (Consent) Agenda and considered in its normal sequence on the Agenda. Brown, Bruno, Cummings, Flanagan, Kilburg, Maladra, Marks, Seno, Simonian, Singer) NAYS: 0 MOTION CARRIED COMMITTEE OF THE WHOLE ITEMS OF BUSINESS Approve Resolution 2015-18 Adopting City’s Coyote Management Plan Moved by Ald. Cummings, seconded by Ald. Marks to approve Res. 2015-18 adopting the City’s Coyote Management Plan. Ald. Kilburg asked if the $500 payment to the Humane Society of the United States is a donation or payment. Admin. McKittrick said that the $500 is a payment for travel expenses related to the planned training session. Referring to the Coyote Management Plan, Admin. McKittrick explained that, for clarification, changes have been made to the “Hazing” and to the “Response to Coyote/Human Interaction” sections since last week’s COW meeting. 1312 Geneva City Council Meeting March 16, 2015 Motion to amend Res. 2015-18 Ald. Simonian wished to amend the motion to include a date certain at which time the management plan would be reviewed. Moved by Ald. Simonian, seconded by Ald. Maladra to amend the motion with a sunset clause to review the efficacy of the plan in one year’s time hence. Roll call: AYES: 10 (Ald. Brown, Bruno, Cummings, Flanagan, Kilburg, Maladra, Marks, Seno, Simonian, Singer) NAYS: 0 MOTION CARRIED Vote on original motion by Ald. Bruno, seconded by Ald. Marks to approve motion as presented. Approved by unanimous roll call vote. (Omnibus Agenda). MOTION CARRIED Approve Amendment to a Sales Agreement Between the City of Geneva and Shodeen Investment Properties Company LLC Regarding Herrington Plaza Moved by Ald. Bruno, seconded by Ald. Marks to approve motion as presented. Approved by unanimous roll call vote. (Omnibus Agenda). MOTION CARRIED Approve Ordinance 2015-08 Granting a Special Use for a Preliminary/final Planned Unit Development Plan Approval to Construct a 21,470 Square Foot Medical Building on an Existing Site Containing a 10,280 Square foot Medical Building Located at 2700 and 2800 Keslinger Road – M-C Commercial Properties, Inc. Moved by Ald. Bruno, seconded by Ald. Marks to approve motion as presented. Approved by unanimous roll call vote. (Omnibus Agenda). MOTION CARRIED PRESENTATION OF ORDINANCES, PETITIONS, RESOLUTIONS, AND BID AWARDS Approve Resolution 2015-19 Urging the Governor and General Assembly to Protect Full Funding of Local Government Distributive Fund Revenues Moved by Ald. Seno, seconded by Ald. Flanagan to approve Res. 2015-19 urging the Governor and General Assembly to protect full funding of local government distributive fund revenues. Roll call: AYES: 10 (Ald. Brown, Bruno, Cummings, Flanagan, Kilburg, Maladra, Marks, Seno, Simonian, Singer) NAYS: 0 MOTION CARRIED 1313 Geneva City Council Meeting March 16, 2015 NEW BUSINESS Mayor Burns wished the Geneva High School Boys Basketball Team good luck in the state supersectional tournament. CLOSED SESSION ON THE SEMI-ANNUAL REVIEW OF CLOSED SESSION MINUTES Moved by Ald. Bruno, seconded by Ald. Singer that the Council adjourn to Closed Session. Roll call: AYES: 10 (Ald. Brown, Bruno, Cummings, Flanagan, Kilburg, Maladra, Marks, Seno, Simonian, Singer) NAYS: 0 MOTION CARRIED The Council adjourned to Closed Session at 7:49 p.m. Moved by Ald. Flanagan, seconded by Ald. Seno that the Council return to Open Session. Carried unanimously by voice vote. MOTION CARRIED The Council returned to Open Session at 8:03 p.m. OPEN SESSION ON RELEASE OF CERTAIN CLOSED SESSION MINUTES Moved by Ald. Maladra, seconded by Ald. Seno to approve partial release of May 12, 2014 Closed Session minutes regarding litigation and full release of Sept. 2, 2014 Closed Session minutes regarding review of Closed Session minutes. Carried unanimously by voice vote. MOTION CARRIED ADJOURNMENT There being no further business, moved by Ald. Simonian, seconded by Ald. Marks to adjourn the Geneva City Council meeting.
