CALL TO ORDER
The May 26, 2015 special meeting of the Geneva City Council was called to order at
7:00 p.m. in the Council Chambers of City Hall by Mayor Kevin Burns. Aldermen
present: Mike Bruno, Tara Burghart, Don Cummings, Dean Kilburg, Craig Maladra,
Richard Marks, Jim Radecki, Mary Seno, Tom Simonian, Ron Singer. Aldermen absent:
None. Also attending: City Administrator Mary McKittrick, Asst. City
Administrator/Dir. of Administrative Services Stephanie Dawkins, Public Works Director
Richard Babica, Community Development Director David DeGroot, Economic
Development Director Cathleen Tymoszenko, Finance Manager Thomas Dahl,
Preservation Planner Michael Lambert, Water & Sewer Division Superintendent Bob
VanGyseghem.
ITEMS OF BUSINESS
Approve Resolution 2015-58 Authorizing Execution Intergovernmental Agreement with
Illinois Dept. of Transportation for Routine Road Maintenance of State Routes 25, 31 and
38
Moved by Ald. Marks, seconded by Ald. Bruno to approve Res. 2015-58 authorizing
execution of an intergovernmental agreement with the Illinois Dept. of Transportation for
routine road maintenance of State Rtes. 25, 31 and 38.
Ald. Singer had several questions seeking clarification of items within the agreement.
His questions were addressed by Dir. Babica and Finance Mgr. Dahl. Roll call:

NAYS: 0 MOTION CARRIED
Ald. Babica reported that he and Asst. Dir. of Public Works/City Engineer Brian Schiber
met earlier today with IDOT representatives regarding the Council’s follow-up road diet
questions from the May 18, 2015 City Council meeting. He said that IDOT has agreed to
undertake independent traffic counts at the entrances to Houghton Mifflin and the Byrnes
office park, as well as at the Fabyan Pkwy./Rte. 31 intersection. The resulting data will
be given to Dir. Babica and Engineer Schiber, who will then address the concerns of the
Council and the property owners within that corridor.

Approve Resolution 2015-59 Authorizing Execution of Proposal from CEMCON, Ltd. to
Complete Abbreviated Project Report Associated with Ill. Rte. 31 Road Diet for IDOT
Review and Consideration
Moved by Ald. Marks, seconded by Ald. Singer to approve Res. 2015-59 authorizing
execution of the proposal from CEMCON, Ltd. to complete an abbreviated project report
associated with Ill. Rte. 31 road diet for IDOT review and consideration.
Ald. Simonian presented a statement in response to requests at the May 18, 2015 City
Council meeting as to the identities of those residents funding the preparation of the
required documents. He provided a timeline of the road diet initiative, beginning in 2005
when the Council adopted a bike paths plan that included the road diet concept. He said
that when he was appointed to the Council in 2013, he was approached by Bob
Fitzsimmons, a neighbor, who was interested in pursuing the road diet plan, noting that
Mr. Fitzsimmons had invested his own money in an initial study to determine if the Rte.
31 road diet, including the bike paths, was feasible.
He went on to say that the plan proved feasible, that the City was approached, a mailing
was sent to surrounding residents to determine interest, and a meeting involving residents
along with city and county officials was held. He said the City Council was interested as
long as no taxpayer money was used to develop a phase one engineering plan as required
by IDOT. He said that he and Mr. Fitzsimmons were able to secure the private financial
contributions needed to develop the initial plan, follow-up plan and final study. With
their permission, he said that those contributing monetarily were residents Bob
Fitzsimmons, Larry Gies Jr., Gerard Keating, and Fred and Bonnie Hackendahl.
Ald. Simonian said that at no time during the road diet process was he asked the names of
the contributors until the May 18 Council meeting. He said that the contributors had no
review authority, editorial authority or leadership role in developing the plan, and that
their only motives were to connect the Fox River bike path, and the public health, safety
and welfare of Geneva citizens and those using Rte. 31. Roll call:

Waive Fee for Special Council Meeting
Moved by Ald. Marks, seconded by Ald. Bruno that the fee for the special Council
meeting be waived. Carried unanimously by voice vote. MOTION CARRIED

NEW BUSINESS
Appreciation for Memorial Day Participation
On behalf of American Legion Post 75, Ald. Singer thanked the Mayor and Council as
well as all participants in Monday’s Memorial Day Parade and activities.
ADJOURNMENT
There being no further business, moved by Ald. Simonian, seconded by Ald. Seno to
adjourn the special Geneva City Council meeting. Carried by voice vote.

Executive Summary:
Back in October 2005, the City agreed to enter into a 10 year intergovernmental
agreement with the IDOT for the routine maintenance of the State Routes 25, 31, and 38
within the City’s boundaries. IDOT is now seeking another 10 year extension of the same
agreement. The agreement is extended by mutual agreement between IDOT and the City
in 12 month increments through June 30, 2025. Said routine maintenance includes
pothole repairs, temporary full depth patches, crack sealing, cleaning, litter collection,
and snow plowing. IDOT is offering the City an annual payment of $79,628.00 plus there
are provisions for cost adjustments based on the annual Construction Cost Index
published in the January edition of “Engineering News Record”. This IDOT payment is
typically paid to the City on a quarterly basis.

Respectfully recommend that the City Council direct the City Administrator/Clerk to execute the
IDOT Intergovernmental Agreement for the Routine Maintenance of State Routes 25, 31, and 38
within the City’s boundaries; and return these IDOT documents to IDOT District 1 headquarters
for their further processing.
RESOLUTION NO. 2015-58
RESOLUTION AUTHORIZING EXECUTION OF
IDOT Intergovernmental Agreement for the routine maintenance of State Routes 25, 31, and
38 within the boundaries of the City of Geneva.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GENEVA, KANE
COUNTY, ILLINOIS, as follows:
SECTION 1: That the City Clerk and Administrator are hereby authorized to execute, on
behalf of the City of Geneva, the IDOT Intergovernmental Agreement for the continued routine
maintenance of State Routes 25, 31, and 38 within the boundaries of the City of Geneva. This is an
extension of a current routine 10 year maintenance agreement with the IDOT for the same routes.
Said limits of the State routes, annual compensation to the City, 10 year agreement terms, and the
items of routine maintenance are contained within the attached Exhibit “A”. This IDOT
intergovernmental agreement relates to the City’s financial and maintenance obligations for State
routes within the City of Geneva, IL.
SECTION 2: This Resolution shall become effective from and after its passage as in
accordance with law.

Executive Summary:
At the May 18, 2015 City Council Meeting, Staff was directed to present a formal
proposal from CEMCON, Ltd., to complete an Abbreviated Project Report (APR) to
IDOT for the IL RT 31 Road Diet. Their proposal is attached for your review with an
upper limit of compensation of $14,000. Their estimated time to complete this task is
three weeks.

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GENEVA, KANE
COUNTY, ILLINOIS, as follows:
SECTION 1: That the City Administrator is hereby authorized to execute, on behalf of
the City of Geneva, a Proposal to Complete an Abbreviated Project Report, I the form attached
hereto at Exhibit “A”, relating to the Illinois Route 31 Road Diet.
SECTION 2: This Resolution shall become effective from and after its passage as in
accordance with law.
