CALL TO ORDER
The August 15, 2016 meeting of the Geneva City Council was called to order at 7:00
p.m. in the Council Chambers of City Hall by Mayor Kevin Burns. Aldermen present:
Mike Bruno, Tara Burghart, Don Cummings, Dean Kilburg, Craig Maladra, Richard
Marks, Jim Radecki, Mary Seno, Tom Simonian, Ron Singer. Aldermen absent: None.
Also attending: City Atty. Charles Radovich, City Administrator Stephanie Dawkins,
Public Works Director Richard Babica, Economic Development Director Cathleen
Tymoszenko, Community Development Director David DeGroot.

COMMITTEE OF THE WHOLE ITEMS OF BUSINESS
Table Resolution 2016-69 Amending the City’s Comprehensive Plan to Change the
Future Land Use Designation for the Subject Realty from “Single Family Residential” to
Single-Family Attached Residential” – K. Hovnanian Homes
Moved by Ald. Cummings, seconded by Ald. Bruno to approve Res. 2016-69 amending
the City’s Comprehensive Plan to change the future land use designation for the subject
realty from “Single Family Residential” to “Single-Family Attached Residential.”
Dir. DeGroot summarized the intent of the resolution. Ald. Marks felt consideration of
this item should be postponed until the zoning change and plat approval are discussed,
adding that all Geneva Meadows items should be considered at the same time.
Moved by Ald. Marks, seconded by Ald. Simonian to table this item until the Sept. 6 City
Council meeting. Roll call:

Resolution 2016-70 Proposing the Increase of Rate of Non-Home Rule Sales Tax in the
City of Geneva, Ill.
Moved by Ald. Bruno, seconded by Ald. Seno to approve Res. 2016-70 proposing the
increase of the rate of non-home rule sales tax in the City of Geneva, Ill.
Ald. Maladra favored the “places for eating” tax (PET) over the sales tax as a revenue
source. He noted that, unlike the proposed sales tax increase, the PET does not require a
public referendum, nor are the revenue uses restricted. Ald. Simonian agreed, with the
stipulation that the Council approve all PET revenue allocations so that the funds are
earmarked for specific uses. Ald. Bruno and Radecki also concurred with Ald. Maladra’s
proposal.

Robert Shiffler, Geneva library board president, requested that the sales tax referendum
not be placed on the April 2017 ballot, saying that the library plans to have a referendum
on that ballot seeking financing for a new library building. He felt that placing those
referendums on the same ballot would adversely affect both referendums. Roll call:

Seno, Simonian, Singer) MOTION FAILS
Mayors Burns now recommended discussion regarding staff preparation of a resolution
for consideration of a places for eating tax (PET). Further, he recommended that such
resolution include the opportunity for the Council to communicate to Geneva eateries the
purpose of the PET and how the revenues would be invested per Council approval, as
well as seeking input from those eateries.
Moved by Ald. Maladra, seconded by Ald. Marks to direct staff to bring forward a
resolution for a places for eating tax, including the Mayor’s caveats.
Ald. Simonian suggested investigating any changeover costs that would be incurred by
the eateries relative to the PET, and that the City credit the establishments for the average
costs prior to collecting the tax. Roll call:
