COMMITTEE OF THE WHOLE MINUTES APRIL 22, 2013 Present: Ald. Brown, Cummings Jr., Flanagan, Hill, Kilburg, Maladra, Marks, Singer, Vogelsberg (arr. 7:25pm) Absent: Mayor Burns Also Present: Dawkins, Divita, Dinges, Buffington 1. Call to Order Chairman Brown called the meeting to order at 7:00 noting that Mayor Burns would not be present due to a prior commitment. Ald. Vogelsberg arrived at 7:25pm. At the request of staff, Item 5g was removed from the agenda. 2. Consider Consent Agenda Moved by Ald. Flanagan, second by Ald. Hill V/V: 8-0 Motion carried. *3. Approve Committee of the Whole Minutes from April 8, 2013 Approved on Consent Agenda 4. Special Items and Presentations a. Recognize Alderman Sam Hill for Years of Service to Geneva’s 1st Ward: May 7, 2001 – April 22, 2013. Ald. Brown presented Hill with a clock and certificate and thanked him for his many years of service to the council. Hill introduced his wife Carolyn and additional family members who attended. Hill thanked the city and his council colleagues, also remembering the recently departed former Aldermen DesCoteaux and Dantino. The meeting was adjourned for a short reception in Hill’s honor. 5. Items of Business a. Recommend Draft Ordinance for City Modification of Bond Issuance of $12,000,000 Tax- Exempt Revenue Bonds (Northern Illinois Food Bank Project) Moved by Ald. Hill, second by Ald. Flanagan Committee of the Whole Minutes – April 22, 2013 Page 1 Representatives from Northern Illinois Food Bank were on hand to thank the council for their assistance. It was noted that a scrivener’s error on page 8 of the packet documents noted an incorrect Exhibit and Brown stated that Exhibit C should read Exhibit A. V/V: 8-0 Motion carried. b. Approve Request from American Legion Post 75 for Use of Public Right-of-Way for Annual Poppy Day Fundraiser May 25, 2013. Moved by Ald. Cummings Jr., second by Ald. Maladra Singer recused. V/V: 7-0 Motion carried. c. Approve Request from American Legion Post 75 for Use of Public Right-of-way for Memorial Day Ceremonies May 27, 2013. Moved by Ald. Marks, second by Ald. Kilburg Singer recused. V/V: 7-0 Motion carried. d. Recommend Draft Resolution Authorizing Execution of First Amendment to Development Economic Incentive and Reimbursement Agreement Between the City of Geneva and Sho- deen, Inc. Moved by Ald. Hill, second by Ald. Marks V/V: 9-0 Motion carried. e. Approve Request from Classic Car Club of America for Use of Public Parking Lot at Northwest Corner of River and James May 9, 2013. Moved by Ald. Maladra, second by Ald. Flanagan V/V: 9-0 Motion carried. f. Approve Request by Chamber of Commerce for Art Fair July 27-28, 2013. Moved by Ald. Hill, second by Ald. Maladra V/V: 9-0 Motion carried. g. Recommend Draft Ordinance Allowing A Special Use for Property Located at 227 East Side Drive – Fox Valley Presbyterian Church. THIS ITEM WAS REMOVED FROM THE AGENDA h. Recommend Draft Resolution Authorizing Execution of Labor Contract with Utility Dynamics in the Amount of $482,141.02 for Underground Electric Relocation Contract 2013-14. Moved by Ald. Recommend Draft Resolution Awarding Professional Services Agreement to Stanley Consultants Inc. in the Amount of $88,300 for Geneva Business Park 2 Substation Relay Upgrade. Moved by Ald. Recommend Draft Resolution Authorizing Bid Award for 2013-14 Underground Cable Replacement Materials to HD Supply in the Amount of $48,727.28. Moved by Ald. Marks, second by Ald. Cummings, Jr. V/V: 9-0 Motion carried. k. Recommend Draft Ordinance Amending Title 9, Chapter 1, Article A (Service, Rates, and Charges) of the Geneva City Code. Moved by Ald. Maladra, second by Ald. Cummings, Jr. V/V: 9-0 Motion carried. l. Recommend Draft Resolution Awarding Bid and Contract to Advanced Disposal Services Solid Waste Midwest, LLC for Five (5) Year Solid Waste Services Contract in the City of Geneva. Moved by Ald. Marks, second by Ald. Cummings, Jr. Ald. Hill stated that while Advanced did come in with the lowest bid, he was very satisfied over the years with Republic’s service. Dinges stated that staff would be sharing the new information with residents throughout its website, Geneva Mail, and the City E-Newsletter. V/V: 8-1 (Hill) Motion carried. m. Recommend Draft Ordinance Amending Title 5 (Health & Sanitation), Chapter 2, Section 5-2-3 (Collection Charges) of the Geneva City Code. Moved by Ald. Marks, second by Ald. Vogelsberg V/V: 9-0 Motion carried. n. Recommend Draft Resolution Authorizing Contract for Street Sweeping Services to Hoving Clean Sweep LLC for 2013 and 2014 Season in the Amount of $69,240 Per Year with Two (2) Year Additional Option for 2015 and 2016. Moved by Ald. Marks, second by Ald. Hill V/V: 9-0 Motion carried. o. Recommend Acceptance of FY2012-13 Fourth Quarter Goals Status Report. Moved by Ald. Vogelsberg, second by Ald. Cummings, Jr. V/V: 9-0 Motion carried. 6. New Business Ald. Kilburg requested that Alderman –elect Bruno be included in the closed session. Asst. Admin. Dawkins stated that since he was not sworn in, that would not be advisable until he was duly sworn in. Dawkins stated that staff would be happy to update him separately on any issues. Cummings Jr. to go into closed session. Roll Call: Ayes: 9 Nays: 0 The meeting was adjourned to closed session at 8:00pm. The meeting returned to open session at 8:37pm on a motion by Ald.
