SPECIAL COMMITTEE OF THE WHOLE MINUTES DECEMBER 2, 2013 Present: Ald. Brown, Bruno, Cummings, Flanagan, Kilburg, Maladra, Marks, Simonian, Vogelsberg Absent: Mayor Burns, Ald. Singer Also Present: McKittrick, Dawkins, Radovich, Schultze 1. Call to Order Ald. Marks, serving as Mayor Pro-Tem, called the meeting to order at 7pm. 2. Presentations a. Presentation by Jim Alderman, Advanced Disposal Mr. Alderman was present to give a brief overview of their service contract, which began in July. Ald. Brown noted no complaints so far from his constituents. Kilburg asked how residents could exchange cart sizes if needed. Alderman said to have them call Advanced, or go to their website to contact them with the request. b. Art on Fire Program Presentation Admin. McKittrick presented information on the recent “Art on Fire” hydrant-painting program in Geneva noting that it was a huge success with 41 entries. Ace Hardware donated paint. c. Art on Fire Award Presentation Cultural Arts Commission rep. Tim Vetang presented monetary awards to the winners of the judged hydrants from the Art on Fire program. 1st place: Tia Holinger 2nd place: Meghan McKenna 3rd place: Lorraine Ochsner d. Mental Health Board Grant Distributions Mental Health board chairman John Ford presented funding checks to Lynn O’Shea with AID and Caroline Nagle with Fox Valley Special Recreation Assn. Other organizations that were selected for funding included: CASA, Geneva School District 304, DayOne Network, Easter Seals, Ecker Center, Elderday, Fox Valley Hospice, Haley’s Playground, Lazarus House, NAMI, Renz Addiction Center, Suicide Prevention, TriCity Family Services, TriCity Health Partnership, and Living Well Cancer Resource Center. Committee of the Whole Minutes – December 2, 2013 Page 1 3. Items of Business a. Consider Approval of a Temporary Tent at 330 W. State Street (Aurelio’s Pizza – patio location) Moved by Ald. Maladra, second by Ald. Simonian Applicant Arnie Silvestri was present and spoke in support of his request for the temporary heated tent at 330 W. State. Building Commissioner Dustin Schultze spoke on the code requirements for tents. Discussion on location of tent in relation to nearby parking spaces and fire/life safety issues. Council members approved the applicant’s request with the following amendment: eliminate requirement to close off parking spaces but instead, to require head-in only parking with signage for the north side of the parking lot. V/V: 7-2 (Marks, Vogelsberg) Motion carried. 4. New Business Resident Bob McQuillian thanked city staff for meeting with him recently to review the Prairie State project, noting his support for the project. 5. YES NO If NO, please explain how the item will be funded: Executive Summary: The Building Division has received a city permit application by Aurelios Pizza requesting permission to erect a 30’X 40’ temporary tent on the patio of the property located between the building and off-street parking lot. The proposed tent would be heated, and primarily used for dining and private parties beginning with the Christmas Walk on December 6th. The request seeks approval for the tent to be up for 8 weeks. The subject property is zoned B2 Business District. Temporary Uses and Events are permitted uses in the B2 district. The zoning ordinance doesn’t set a maximum time duration for authorized temporary uses. Staff is currently drafting regulations pertaining to temporary outdoor uses and tent/canopies. Until the regulations are finished and adopted, staff has presented these permit applications to the city council for review and approval. City council review is also appropriate for this request because the tent is quite large and is proposed for a longer time frame than we typically see. City staff has reviewed the proposed tent plans for compliance with the adopted 2009 International Fire Code. The plans generally comply with applicable code requirements including such items as setbacks, number, spacing and width of aisles and egress points, location of heaters/fuel, interior lighting, emergency lighting, exit signs, CO2 detection, fire extinguishers, etc., however a few minor modifications are necessary that must be approved by staff prior to city council action. The fire code requires a minimum 20 foot setback from parking areas. Therefore, the six on-site parking spaces immediately south of the proposed tent location must be blocked off and not used for parking vehicles while the tent is up. Kane County Health Department approval is required prior to issuance of a permit by the city. It is the understanding of staff that no food would be cooked in the tent.
