COMMITTEE OF THE WHOLE MINUTES May 9, 2016 PRESENT: Mayor Burns, Ald. CALL TO ORDER Mayor Burns called the meeting to order at 7:00pm 2. SPECIAL ITEMS a. Oath of Office and Pinning Ceremony for Police Chief Eric M. Passarelli The City Clerk read the oath to Chief Passarelli and the council congratulated him on his promotion. Passarelli thanks the council, staff, and his family for their support and was looking forward to his new role as Police Chief. b. Police Department Promotion/Pinning Ceremonies for Commander Brian J. Maduzia, Sergeant Matthew T. Dean, and Sergeant Bradley M. Jerdee 3. APPROVE COMMITTEE OF THE WHOLE MINUTES FROM APRIL 11, 2016 AND MAY 2, 2016. 4. ITEMS OF BUSINESS a. Approve Special Event Application for Fox River Trail Runners Summer Sunset 5K and Youth Mile Event on July 27, 2016. Moved by Ald. Cummings, second by Ald. Marks V/V: 10-0 Motion carried. b. Approve Chamber of Commerce Class E-6 Liquor License for Arts Fair Patron Event July 23, 2016 Moved by Ald. Cummings, second by Ald. Marks V/V: 10-0 Motion carried. f. Recommend Approval of Draft Ordinance Amending Title 4 (Business and License Regulation), Chapter 2 (Liquor Control), Section 4-2-13 (License Fees and Number) Adding One (1) Class A-3 (Specialty Packaged Liquor) License for The Royal Wren at 11 S. Third Street, Geneva, IL. Moved by Ald. Cummings, second by Ald. Marks Owner Brian Feltes was present to answer questions and provide information on his new business that will be opening in June, 2016. V/V: 10-0 Motion carried. g. Recommend Draft Resolution Authorizing Execution of a License Agreement for Temporary Use of Sidewalk for Installation of Mural at 121 S. Third St. (Fox Valley Jewish Neighbors) Moved by Ald. Cummings, second by Ald. Marks Fox Valley Jewish Neighbors Director Greg Cibura provided information on the project and the artist, who was also present. V/V: 10-0 Motion carried. h. Recommend Draft Ordinance Amending Title 7 (Motor Vehicles and Traffic), Chapter 3, Section 10 (Parking Fines) and Title 8 (Public Ways and Property), Chapter 7, Section 5 (Permit Parking Zones) of the Geneva City Code. Moved by Ald. Marks, second by Ald. Bruno as amended. After considerable discussion on the possible impact the proposed fine structure would have on downtown businesses, and after hearing from Commander Maduzia and CSO Brad Koontz, the aldermen offered a friendly amendment to remove the overtime parking rates from the proposed ordinance for more discussion at a later date. V/V: 10-0 Motion carried. i. Recommend Draft Ordinance Amending Title 6 (Police Regulations), Adding Chapter 8 (Seizure and Impoundment of Vehicles) of the Geneva City Code. Moved by Ald. Recommend Draft Resolution Authorizing Purchase of Three (3) Ford Interceptor Police Vehicles in the Budgeted Amount Not to Exceed $114,810 from Morrow Brothers Ford (State Purchase Program). Recommend Draft Resolution Authorizing Waiver of Bidding Process and Acceptance of Proposal from Tri-R Systems Inc. in the Amount Not to Exceed $225,000 for Completion of Wastewater Treatment Plant SCADA System Upgrade and Fiber Optic Network Installation Project. Moved by Ald. Marks, second by Ald. Seno V/V: 10-0 Motion carried. l. Recommend Draft Resolution Authorizing Waiver of Bidding Process and Approval of a Three Year Purchase Agreement with Sensus for Water Meters in a Budgeted Amount Not to Exceed $200,000 Combined Cost for Meters and ERTs. Recommend Draft Resolution Authorizing Purchase of Itron 100W ERTs from Water Products in an Amount Not to Exceed $200,000 Combined Costs for Meters and ERTs. Moved by Ald. Marks, second by Ald. Bruno V/V: 10-0 Motion carried. n. Recommend Draft Resolution Authorizing Waiver of Bidding Process and Purchase of Polydyne Polymer for Wastewater Treatment Plant at a Cost of 1.00/lb. for FY2017. Recommend Draft Resolution Authorizing City Clerk to Execute IDOT State Motor Fuel Tax Fund Forms BLR 14230 and BLR 14231 for FY2017 Street Maintenance Operations. Moved by Ald. Marks, second by Ald. Recommend Draft Resolution Authorizing Execution of Proposal from Hampton, Lenzini and Renwick, Inc. in the Amount of $44,000 for Completion of 2016-17 Wetlands Management Services for Eagle Brook and On Brentwoods Pond Subdivision. Consider Draft Resolution Authorizing Agreement with DeMar Tree and Landscaping Services Inc. in an Amount Not to Exceed $120,000 for FY2017 Tree Trimming Project. Moved by Ald. Bruno, second by Ald. Marks V/V: 10-0 Motion carried. r. Consider Draft Resolution Authorizing Easement Agreement for Storm Sewer Extension at 729 Edison Street. Moved by Ald. Marks, second by Ald. Recommend Draft Resolution Granting Conditional Site Plan Approval for a Nursing Home Facility with the OR-Office Research District (Meadowbrook Manor/MMG Partners LP) Moved by Ald. Recommend Draft Ordinance Amending Title 11 (Zoning), Chapter 5, Article J, Section 11- 5J-5A (Accessory Buildings and Uses) and Section 11-5J-4B (Lot and Area Requirements), All Related to Regulation of Temporary Facilities (Modular Classrooms) in the R-PS Public School District – Geneva Community School District 304. Moved by Ald. Marks, second by Ald. Simonian V/V: 10-0 Motion carried. u. Recommend Draft Resolution Amending the City’s Adopted Downtown Station Area Master Plan to Change the Future Land Use Designation for a Portion of the Property from “Public/Semi-Public” to “Downtown Commercial Mixed-Use”. Moved by Ald. Marks, second by Ald. Cummings Dir. DeGroot provided an overview of the Plan Commission votes and discussion at the April hearing, also identifying the items that the commission approved and did not approve. Roll Call Ayes: 10 Nays: 0 Motion carried. v. Recommend Draft Resolution Amending the City’s Adopted Downtown Station Area Master Plan to Change the Future Land Use Designation of a Portion of the Property from “Industrial Office” to “Downtown Commercial Mixed-Use”. Moved by Ald. Bruno, second by Ald. Marks Roll Call Ayes: 10 Nays: 0 Motion carried. w. Recommend Draft Ordinance Amending Chapter 6 (Office and Commercial Districts) Article H (B6 Planned Unit Development District) of Title 11 of the Geneva City Code (Zoning Ordinance), Specifically Section 11-6-6H (Description and Intent). Moved by Ald. Marks, second by Ald. Cummings Discussion on changing the zoning to B6 was debated with support to overturn the plan commission coming from Ald. Bruno. Several nearby residents voiced their opposition to this change stating there was no need to go that route and suggested that the city commission a residential feedback group much like what was done for the Dodson developments. Roll Call Ayes: 1 Nays: 9 Motion failed. x. Recommend Draft Ordinance Amending Chapter 6 (Office and Commercial Districts) Article H (B6 Planned Unit Development District) of Title 11 of the Geneva City Code (Zoning Ordinance), Specifically Section 11-6H-3 (Lot and Area Requirements). Moved by Ald. Marks, second by Ald. Cummings Further discussion on the commission’s opposition to this change, coupled with neighborhood concerns on the lot and area requirements were heard. Roll Call Ayes: 0 Nays: 10 Motion failed. y. Recommend Draft Ordinance Amending Chapter 9 (Planned Unit Developments) of Title 11 of the Geneva City Code (Zoning Ordinance), Specifically Section 11-9-2 (Purpose and Objectives). Moved by Ald. Marks, second by Ald. Seno Roll Call Ayes: 10 Nays: 0 Motion carried. z. Recommend Draft Ordinance Amending Chapter 9 (Planned Unit Developments) of Title 11 of the Geneva City Code (Zoning Ordinance), Specifically Section 11-9-9 (Bulk Incentives and Open Space). Moved by Ald. Singer, second by Ald. Marks Roll Call Ayes: 0 Nays: 10 Motion failed. Ald. Burghart thanked the commission and city staff for the many months of work on this project. aa. Recommend Draft Resolution Approving a Four (4)-Year Collective Bargaining Agreement Between the City of Geneva and the Geneva Professional Firefighters Association, Local 4287 (IAFF) as Presented. Moved by Ald. Marks, second by Ald. Singer Roll Call Ayes: 10 Nays: 0 Motion carried. 5. NEW BUSINESS Ald. Maladra encouraged residents to help with the Beautification Committee summer planting event Saturday morning, May 14th. 6. ADJOURNMENT On a motion by Ald. Simonian, second by Ald. Marks, the meeting was adjourned by unanimous voice vote at 9:45pm.
