Commissioner Sheehy moved we move to executive session pursuant to Section 2(c)(21) of the Open

performance, or dismissal of specific employees, at 9:49 am, Yeas 3 Nays 0.
Commissioner Sheehy moved we move to open session at 9:54 am, Yeas 3 Nays 0
Commissioner Meyers moved that recordings be destroyed from eligible meetings 6/15/21 to 8/31/21

Motion to amend Ch. 3 Sec. 10 of the Board of Fire & Police
Commission Rules and Regulations
Statement of the Issue:
The current Rules and Regulations for the Board of Fire and Police Commission allow for a
“secondary list” of applicants, commonly known as a Lateral Officer Eligibility List, under Ch3
Sec10, which mirrors 65 ILCS 5/10-2.1-14. Under this section, lateral applicants must be currently
employed for a minimum of two years and be certified by the Illinois Law Enforcement Training
and Standards Board (ILETSB), at time of application. The current Board Rules and Regulations
prohibit out of state officers or recently separated officers from applying as a lateral officer
candidate, limiting the number of qualified applicants allowed to apply under the lateral hire
program.
Analysis:
The current Commission Rules governing lateral hires is based on the BFPC Act, specifically 65
ILCS 5/10-2.1-14. As a home rule community, the Village can deviate from the Act. ILETSB is
the agency that certifies police officers in Illinois. ILETSB has an out of state reciprocity process,
allowing for out of state officers to be certified in Illinois, after being hired by an Illinois agency and
a review of their training/experience. Subsequent to the review, additional conditions may apply,
such as, additional training and completing an equivalency exam with a passing score. Police officers
in Illinois, having separated from their department in good standing, maintain their certification for a
specified period of time. Those officers, if hired by another department and continue the training
requirements set by ILETSB, within the specified period of time, are able to maintain their
certification.
The proposed amendment would allow for a greater number of lateral applicants to apply and for
the Village to utilize ILETSB’s currently existing reciprocity process.

SECTION 10 – SECONDARY LIST (Lateral Entry)
a) As provided for within 65 ILCS 5/10-2.1-14 of the Board of Fire and Police
Commissioners Act, the commission may, at its discretion, prepare and keep a
“Second List” of applicants all of whom have successfully completed their basic
law enforcement training and have been so certified by the Illinois Law
Enforcement Training and Standards Board and who, at the time of application,
been currently employed as a full-time sworn law enforcement officer, for a
minimum of 24 months, of a regular police department in any municipal, county,
university, college, or State law enforcement agency.
a)b) Applicants must be currently certified by the Illinois Law Enforcement Training
and Standards Board, or hold an equivalent certification from another state, at time
of application. Applicants must be actively employed as a full-time sworn law
enforcement officer for a minimum of 24 months of service, or recently separated
from service with a minimum of 24 months of service. Applicants who are
currently separated from service must have a current valid certification issued by
the Illinois Law Enforcement Training and Standards Board or current valid
equivalent certification from another state.
b)c) Applicants, for a position on a “Secondary List” shall be required to successfully
pass a written examination. The examination shall be based upon a scale of 1 to
100, and the passing point, if any, to be set and announced by the commission prior
to the conduct of the examination.
c)d) Notice of the examination will be provided as set forth in Section 3 of this Chapter.
d)e) An applicant’s position upon a “Secondary List” shall be based upon the applicant’s
final written test score, without reference to priority of time of examination, plus
an award of preference points as noted above in Section 8 of this Chapter.
e)f) At the time a vacancy is declared for an original appointment to a police officer
position, the commission shall have the option to fill said vacancy from its Original
Eligibility List or from the Secondary List.
f)g) Prior to an offer of conditional appointment, applicants shall be required to undergo
a polygraph examination, thorough background check, and oral board interview as
set forth in these rules. If successful, the commission shall make a conditional offer
of employment subject to successful completion of an in-depth psychological
examination and a thorough medical examination as provided for within these rules.
g)h) Applicants appointed from a Secondary List shall serve on a probationary basis as
set forth in Section 12.
i) h) Application - Applicants for lateral entry must complete and submit an
application to the Board as provided for in Chapter II of the Board’s Rules and

Regulations. In addition, lateral entry applicants may be required to furnish additional
documents, such as; resume and cover letter, last two years of law enforcement job
performance evaluations, or documentation verifying valid certification as a full-time
police officer from the Illinois Law Enforcement Training and Standards Board.

Statement of the Issue:
The Board of Fire & Police Commission, as a public body in Illinois, is required to periodically
review closed session minutes, in order to make a determination if they need to remain closed or
made available for public inspection.
Analysis:
Pursuant to the Open Meetings Act, 5 ILCS 120/2.06(d); Each public body shall periodically, but no less
than semi-annually, meet to review minutes of all closed meetings. At such meetings a determination shall be made,
and reported in an open session that (1) the need for confidentiality still exists as to all or part of those minutes or (2)
that the minutes or portions thereof no longer require confidential treatment and are available for public inspection.
Pursuant to 5 ILCS 120/2.06(a); All public bodies shall keep written minutes of all their meetings, whether open
or closed, and a verbatim record of all their closed meetings in the form of an audio or video recording.
Pursuant to 5 ILCS 120/2.06(c); The verbatim record may be destroyed without notification to or the approval of
a records commission or the State Archivist under the Local Records Act or the State Records Act no less than 18
months after the completion of the meeting recoded but only after; (1) The public body approves the destruction of a
particular recording; and (2) The public body approves minutes of the closed meeting that meet the minutes
requirements of subsection (a) of this section.

For the BFPC to meet in closed session for the purpose of reviewing closed session minutes and to
make the following determinations in open session:
1. The need to keep closed session minutes confidential or to make them available for public
inspection.

qualify.
