Channel 6, AT&T Channel 99, and Comcast Cable Services Channel 10. Any individual with a disability

and the business of the Village Board, and shall refrain from abusive demeanor and
language. The practice of ceding time to other speakers shall be prohibited, except

Proclamation
WHEREAS, migratory birds are some of the most beautiful and easily observed
wildlife that share our communities; and
WHEREAS, many citizens recognize and welcome migratory songbirds as
symbolic harbingers of spring; and
WHEREAS, these migrant species also play an important economic role in our
community, controlling insect pests and generating millions in recreational dollars
statewide and
WHEREAS, migratory birds and their habitats are declining throughout the
Americas, facing a growing number of threats on their migration routes and in both their
summer and winter homes; and
WHEREAS, public awareness and concern are crucial components of migratory
bird conservation; and
WHEREAS, since 1993 World Migratory Bird Day (WMBD) has become a primary
vehicle for focusing public attention on the nearly 350 species that travel between
nesting habitats in our communities; and
WHEREAS, WMBD is held each year on the second Saturday in May; and
WHEREAS, within the 2023 Glen Ellyn Comprehensive Plan, preserving wildlife
habitats is listed as an objective.
NOW, THEREFORE, I, JAMES BURKET, President of the Village of Glen Ellyn,
Illinois, on behalf of the Village Board, do hereby proclaim the Village’s observance of
World Migratory Bird Day and support the efforts to protect and conserve migratory
birds and their habitats in our community and the world at large.

Chairperson Miekina gave an update on the Committee’s planning to date. He spoke
about the fundraising effort and forming a 501 3(c) non-profit organization with a
portion of this year’s donations. He continued with plans for the parade and fireworks.
He also introduced the Grand Marshal for this year, Jonathan Charbonneau.
Trustee Kalinich asked for clarification on the non-profit in relation to donations.
Mr. Miekina replied.
2) Proclamation in Honor of Autism Awareness and Acceptance Month (Economic
Development & Communications Director Hannah)
Community Relations Commission Chairperson Nancy McKee read the
Proclamation.

Trustee Kalinich asked if there was retail to be included in this business. Christi
Rantis, the business owner, replied there was to be retail and that she plans to
expand such offerings.
Terry Lally, the property owner, spoke in support of granting this special use
permit and the issues with renting the space for retail use.
Barb Lemme, President of the Business Alliance, spoke in opposition to granting
the special use permit, with the concern about the number of these that have
been granted. She then gave her reasons for Alliance opposition. The Alliance did
not have negative issues with the business in general.
Anne Gould, resident, spoke about her concern with the numerous special use
permits that have been granted and their effect on the Central Business District
(CBD). She included actions that could be taken to help fill the retail space.
Christi Rantis, business owner, spoke about why her business should be granted
the special use permit. She detailed her plans to expand her retail space and cater
more to the wedding sector in the new location.

Trustee Simon stated that the zoning code and Business Alliance should be
supported. She felt it was clear that this sets up the competing interests in the
CBD.
Trustee Christiansen said that the Plan Commission approved this and noted that
the previous business in the location was also a service-based business. She added
that the service sector is growing more quickly than the retail sector and this
should be considered.
Trustee Kalinich asked Ms. Rantis about her current space compared to the new
space. Ms. Rantis replied. Trustee Kalinich asked for clarification on the hosting
of bridal business at her proposed location. Ms. Rantis replied.
Trustee Kalinich asked for further detail on the expansion of the retail space. Ms.
Rantis replied.
Trustee Bhagwakar asked about how the make-up line fits into the new space.
Ms. Rantis replied.
Trustee Bhagwakar asked Mr. Tally about the challenge of renting to retail in this
space. Mr. Tally replied. President Burket added his thoughts on the challenges of
the space.
Community Development Director Henaghan gave a recap of the Plan
Commission’s review and approval of the special use request.
Trustee Kalinich felt that this business met the criteria of the Village to help
current businesses grow and stay in the Village. Trustee Thompson agreed.
Trustee Duncan thanked everyone who spoke out in opposition and that the
special use permit should not be considered lightly but felt there was a
compelling case to approve this request.
Trustee Bhagwakar felt that the business would be a good fit and appreciated the
comments as well.
Trustee Simon said she would vote no in support of the Alliance and that careful
scrutiny should be carried out when granting special use.
Trustee Christiansen thought that perhaps zoning code boundaries should be
reconsidered. Trustee Simon added that if this was done, the Alliance should be
included in the process.
17) Adopt Resolution No. 26-35, A Resolution Approving an Independent Contractor

The Council's mission is to promote sound environmental legislation emphasizing conservation of
state natural resources, sponsoring environmental educational initiatives in support of this. The
intent of a Bird City designation is to encourage all communities in Illinois to implement sound bird-
conservation practices by offering public recognition to those that succeed in enhancing the
environment for birds and educating the public about the relationship between birds and people as a
contribution to a healthy community.
Budget Impact:
The application fee of $200 was approved by the Environmental Commission on February 24, 2026.
The fee will be paid from the Environmental Commission's annual approved budget.

A Resolution Authorizing the Submittal of An Application with the
Audubon Council of Illinois to Recognize the
Village of Glen Ellyn as an Illinois Bird City
WHEREAS, birds are some of the most beautiful, easily observed wildlife sharing our
communities; and
WHEREAS, many Village of Glen Ellyn (“Village”) residents recognize and value birds
that are residents and those that pass through their migration seasons; and
WHEREAS, in furtherance of such recognition and value, the Village’s Environmental
Commission adopted a motion at its February 24, 2026 meeting recommending that the Village
pursue recognition by the Audubon Council of Illinois to recognize the Village as an “Illinois Bird
City;” and
WHEREAS, Bird City Illinois is an initiative to build relationships with local
municipalities and citizens of the community for a call to action to protect and conserve birds; and
WHEREAS, public education, awareness, and concern are crucial components of bird
conservation and are part of the Illinois Bird City initiative; and
WHEREAS, the Village Board is in receipt of the Environmental Commission’s
recommendation and adopts the Resolution pursuant to said recommendation.
NOW, THEREFORE BE IT RESOLVED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF GLEN ELLYN, DUPAGE COUNTY, ILLINOIS, in
the exercise of its home rule powers, as follows:
Section 1. Recitals Incorporated. The foregoing Recitals are substantive and are
incorporated herein as though fully set forth.
Section 2. Authorization to Submit an Application. The Village Manager or the
Manager’s is authorized to submit an application with the Audubon Council of Illinois to recognize

Analysis:
Each year the Village receives a share of the State of Illinois revenue generated by the Motor Fuel
Tax (MFT) based on the population of the Village. The money from this tax can only be utilized by
the Village for authorized expenditures as required by the Illinois Department of Transportation
(IDOT). Certain recordkeeping requirements are necessary to justify to the state auditors that the
money is spent accordingly. The Illinois Highway Code requires that the Village approve, by
resolution, the expenditure of these funds according to IDOT guidelines on the appropriate IDOT
form on a calendar year basis. This resolution is for expenditures spent in 2024.
Each year the Public Works Department must compile data to document the expenditures that meet
IDOT criteria to validate the use of MFT funds. The department tracks the expenditures that are
listed in the MFT fund (electricity for streetlights, bulk road salt for street snow removal, tree
planting in Right of Way (ROW), and work and asset management software licensing) as well as
labor costs for operational tasks that are MFT eligible (i.e., street sweeping, snow removal, sign
fabrication/installation, etc.). MFT funds are transferred to the General Fund matching the
budgeted transfer amount; Glen Ellyn is required to show that these transferred funds have been
spent on MFT-eligible items. The total transferred, $602,803.38, represents $230,111.49 labor dollars
and $372,691.89 material/contract/commodity dollars.

Statement of the Issue:
As part of its overall responsibilities, the Equipment Services Division (ESD) of the Public Works
Department annually evaluates the fleet of vehicles and equipment used by the Department.
Following the Village Board's past approvals to purchase new vehicles during the period 2024 to
February 2026, staff recommends the adoption of the Ordinance. This would declare the retired
vehicles as surplus and authorize the Village Manager to sell them through an online auction.
Analysis:Pursuant to Village policy and section 11-76-4 of the Illinois Municipal Code, (65
ILCS5/11-76-4), the Village may, by ordinance, authorize the disposition of designated surplus
property to dispose of vehicles and equipment no longer useful to the Village. At Village Board
meetings since early 2024, the Board has approved the purchase of multiple vehicles and equipment
to replace existing units. The old units are planned to be sold via online auctions later this year.
The Village has transitioned from using live public auctions that are held locally to internet-based
public auctions that are accessible globally. This gives the Village exposure to a greater number of
bidders and increases the total financial return as a result of higher bids and lower sales
commissions.
ESD has researched and estimated the current value of each vehicle based on recent sales of similar
equipment or through information found in published used car guides. The vehicles listed below
have reached the end of their useful life and are no longer cost-effective to maintain. All usable
parts and Village decals would be removed prior to sale. Disposal would occur via public auction
(online) to ensure the best possible value return and transparency. If the items are not sold, they will
be disposed of or donated.

“as-is” by the Village Manager or the Manager’s designee pursuant to an internet auction, upon
the execution of the Bill of Sale, attached hereto and incorporated herein by reference.
Section 4. Severability and Repeal of Inconsistent Ordinances. If any section,
paragraph, clause, or provision of this Ordinance shall be held invalid, the invalidity thereof shall

Statement of the Issue:
The proposed Intergovernmental Agreement (IGA) would resolve jurisdictional conflicts that have
been identified by the Village of Glen Ellyn and the City of Wheaton, and in particular, the property
owned by Wheaton College located at the northeast corner of Pennsylvania Avenue/College Avenue
and Glencoe Street. The proposed IGA is substantively the same as the draft IGA that was
discussed at its February 23, 2026 Special Workshop Meeting, the materials for which can be viewed
here.
Analysis:Currently, there is no formal boundary agreement between Glen Ellyn and Wheaton, the
most recent Boundary Agreement having expired in 2017. Although the 1997 Agreement addressed
most of the previous jurisdictional conflicts, there were a few locations that were not addressed, with
one being the property located at the northeast corner of Pennsylvania Avenue/College Avenue and
Glencoe Street (Wheaton College Property).
The Wheaton College Property is made up of a total of nine (9) parcels, shown as “Parcel 1” in the
following map. Four (4) of the nine (9) parcels are in Glen Ellyn and five (5) in Wheaton. The
Prpoerty is currently owned by Wheaton College and College representatives have expressed a desire
to consolidate the property under one municipal jurisdiction. Wheaton College believes this will be
beneficial for redevelopment of the property by providing clarity for utilities, flood plain and storm
water regulations, public safety response, and zoning and permitting. This request from Wheaton
College drove the consideration of a new IGA between the two communities which has been
informed by numerous Village Board workshops, meetings with the residents of Anthony Street
who live immediately near the Wheaton College Property, a stormwater engineering assessment
completed by the Village, and engineering assessments performed by a prospective developer.

Previous IGA Discussions
In 2023, the Village Board discussed the potential IGA with Wheaton with respect to jurisdictional
boundaries at two different Village Board workshops on June 20 and October 16. During those
discussions, the Village Board directed staff to complete a stormwater assessment of the area around
Anthony Street, west of Kenilworth Avenue. The purpose of the study was to better understand the
challenges and potential benefits if the Wheaton College Property were to be redeveloped in the
future. The Village contracted with Engineering Resources Associates (ERA) to perform a
stormwater engineering assessment to include potential improvements to reduce the depth of
ponding in Anthony Street as well as potential private property improvements to protect homes
from flooding.
ERA completed its report and the Village shared the results with Wheaton, DuPage County, and the
neighbors in the Anthony Street area via a meeting in late August 2024. The Glen Ellyn Village
Board discussed the proposed IGA, as well as the results of the ERA study, in another workshop
session on September 16, 2024. (See link to the September 16, 2024 Village Board Workshop). Over
the last year, a developer has expressed interest in the Wheaton College Property and has used the
results of the ERA study to begin its engineering assessment of the Property.
With this detailed information, staff developed specific terms to incorporate into the final version of
the IGA. These provisions are outcome-driven, so if the Wheaton College Property is developed,
then certain stormwater outcomes must be met regardless of the specific developer. The IGA allows
the Glen Ellyn Village Engineer to evaluate and ensure that those stormwater outcomes are included
in the final development plans in compliance with the IGA. In addition, both Glen Ellyn and
Wheaton have agreed to keep the Anthony Street properties within Glen Ellyn to align more
effectively with the existing single-family development along Anthony Street.

Intergovernmental Agreement (IGA) Summary
While the discussions with respect to the IGA have focused primarily on the Wheaton College
Property, there are other aspects included in the updated draft IGA. The key provisions of the draft
IGA are as follows:
1. Term: The IGA would have a term of twenty (20) years from the date of execution. The
parcels that are disconnected and annexed would remain with their new jurisdictions
following the expiration of the IGA.
2. Right-of-Ways: Two areas for right-of-way maintenance clarification and ownership of
utilities have been identified: Ott Avenue and Harwarden Street.
3. Wheaton College Property: Section 3 of the IGA provides for the disconnection of the
portion of the Wheaton College Property currently in Glen Ellyn from Glen Ellyn, followed
by annexation to Wheaton. The portion of the Wheaton College Property that fronts onto
Anthony Street would remain in Glen Ellyn for eventual resubdivision into two single-family
lots. Any development of the Property would be required to:
• Be residential in nature or a use permitted by Wheaton’s current institutional
zoning district;
• Prohibit any roadway connectivity to Anthony Street;
• Be developed in conformance with the DuPage County Countywide Stormwater
and Floodplain Ordinance, as amended by Wheaton;
• Be developed in such a manner that shall not cause any negative impacts to any
downstream and upstream properties and shall lower the 100-year critical duration
storm event, or Full Equations (FEQ) Model flood elevation, in Anthony Street to
no greater than 756.61;
• Include construction of an overland drainage path from the lowest top of curb
elevation at the west of Anthony Street down into and through Parcel 1;
• Provide any approved plans to the Glen Ellyn Village Engineer, who shall limit
review of the plans to determining whether the plans comply with the
requirements of paragraph 3(a)(iv) of the agreement; and
• Any future Wheaton municipal property tax generated by any development of
Parcel 1 shall be shared with Glen Ellyn based upon Parcel 1 equalized assessed
value and Wheaton’s annual tax rate. One-third (1/3) of the property tax generated
by Parcel 1, if any, shall be remitted to Glen Ellyn no later than August 1st of each
year. The obligation to share a portion of the property tax generated by Parcel 1
shall begin when the development of Parcel 1 is completed and all final certificates
of occupancy are issued by Wheaton and shall terminate after 20 years of property
tax revenues have been paid by Wheaton to Glen Ellyn.
4. Roosevelt/Taft Boundary Line: Two parcels are currently located in Wheaton but are in shared
ownership with the property to the east at 285 Roosevelt Rd. in Glen Ellyn. These properties, which
are identified as Parcel 2 on the City of Wheaton Boundary Map with the IGA, serve as required
parking for the retail development anchored by Northwestern Medical. As part of the IGA, these
parcels would be disconnected from Wheaton and annexed to Glen Ellyn.

The City of Wheaton approved the IGA at its City Council Meeting on Monday, April 20, 2026. If
the Village Board approves the IGA, public hearings will be necessary to complete the
disconnections and annexations through a full public review process.
Budget Impact:
If the IGA is approved and the Wheaton College Property is developed, the Village would receive
one-third (1/3) of the municipal tax generated by the site for twenty (20) years from the date all final
Certificates of Occupancy are issued by Wheaton for the development. In addition, the Village
owould retain the two residential lots on Anthony Street that would contribute to the property tax
base in perpetuity. Lastly, the municipal portion of the property taxes generated by the two parcels
on Taft Avenue would be paid to the Village once annexed to the Village.

An Ordinance Approving an Intergovernmental Agreement Between the
Village of Glen Ellyn and the City of Wheaton Regarding
Jurisdictional Boundaries and Authorizing its Execution
WHEREAS, the Village of Glen Ellyn (“Glen Ellyn”) is a home rule unit of government
as provided by the provisions of Article VII, Section 6 of the Illinois Constitution of 1970; and
WHEREAS, Article VII, Section 10, of the Illinois Constitution of 1970, Ill. Const., art.
VII, sec.10(a) (“Section 10(a)”), provides that in furtherance of the exercise of their powers, units of
local government may contract or otherwise associate among themselves to obtain or share services
and to exercise, combine, or transfer any power or function, in any manner not prohibited; and
WHEREAS, the Intergovernmental Cooperation Act provides that a public agency may
jointly exercise or combine any power, privilege, function or authority with other public agencies, 5
ILCS 220/1 et seq.; and
WHEREAS, Glen Ellyn and the City of Wheaton (“Wheaton”) are units of local government
under Section 10(a) of the Illinois Constitution and public agencies as that term is defined in Section
2 of the Intergovernmental Cooperation Act, 5 ILCS 220/2; and
WHEREAS, Section 11-12-9 of the Illinois Municipal Code, 65 ILCS 5/11-12-9, provides
that municipalities may enter into jurisdictional boundary line agreements; and
WHEREAS, since 1963, Glen Ellyn and Wheaton have cooperated in the establishment
of certain boundary lines for municipal planning, subdivision and annexation; and
WHEREAS, Glen Ellyn and Wheaton have previously entered into a Boundary
Agreement dated July 16, 1979 and a Boundary Agreement dated January 27, 1997; and
WHEREAS, the January 27, 1997 Boundary Agreement expired on January 27, 2017; and

WHEREAS, Glen Ellyn and Wheaton now desire to enter into the Intergovernmental
Agreement Regarding Jurisdictional Boundaries attached hereto and incorporated herein by
reference which will supersede the prior two Boundary Agreements and set forth a revised
boundary line, west of which Glen Ellyn will not annex and east of which Wheaton will not annex,
which will mark the boundary of the jurisdictions of Glen Ellyn and Wheaton except as modified
by the Agreement; and
WHEREAS, on March 20, 2026, Glen Ellyn published notice of its intent to consider the
Boundary Agreement at its April 20, 2026 meeting pursuant to Section 11-12-9 of the Illinois
Municipal Code, 65 ILCS 5/11-12-9, in the Daily Herald, a newspaper of general circulation
within Glen Ellyn and Wheaton; and
WHEREAS, Wheaton approved the Intergovernmental Agreement at its City Council
meeting on April 20, 2026 and has executed the Agreement as a result of said approval.
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE PRESIDENT AND
BOARD OF TRUSTEES OF THE VILLAGE OF GLEN ELLYN, DUPAGE COUNTY,
ILLINOIS, in the exercise of their home rule powers, as follows:
Section 1. Recitals Incorporated. The foregoing recitals and all exhibits attached to
this Ordinance are incorporated as though fully set forth in this Section 1.
Section 2. Intergovernmental Agreement Approved. The Intergovernmental
Agreement between the Glen Ellyn and the Wheaton Regarding Jurisdictional Boundaries
(“Intergovernmental Agreement”) is approved in substantially the form attached subject to the
review and approval of the Village Attorney.
Section 3. Authorization to Execute the Intergovernmental Agreement and Other
Documents. The Village President is authorized and directed to execute the Intergovernmental

Agreement referenced herein on behalf of Glen Ellyn in substantially the form attached and all
other documents as may be necessary to effectuate the Intergovernmental Agreement and the
Village Clerk is authorized and directed to attest the signature of the Village President.
Section 4. Recording of Ordinance and Intergovernmental Agreement. This
Ordinance and the Intergovernmental Agreement approved herein shall be recorded with the
DuPage County Recorder of Deeds as required by Section 11-12-9 of the Illinois Municipal Code,
65 ILCS 5/11-12-9.
Section 5. Severability and Repeal of Inconsistent Ordinances. If any section,
paragraph, clause, or provision of this Ordinance shall be held invalid, the invalidity thereof shall
not affect any of the other provisions of this Ordinance. All ordinances in conflict herewith are
hereby repealed to the extent of such conflict.
Section 6. Effective Date. This Ordinance shall be in full force and effect after its
approval, passage and publication as provided by law.

WHEATON REGARDING JURISDICTIONAL BOUNDARIES
THIS INTERGOVERNMENTAL AGREEMENT (hereinafter referred to as the “Agreement”) is
entered into this _____ day of May, 2026, by and between the VILLAGE OF GLEN ELLYN, DuPage County,
Illinois, an Illinois home rule Municipal Corporation (hereinafter referred to as “Glen Ellyn”) and the CITY
OF WHEATON, DuPage County, Illinois, an Illinois home rule Municipal Corporation (hereinafter referred
to as “Wheaton”) (The Parties to this Agreement may also be referred to herein as a “Party” and
collectively as the “Parties”).
WHEREAS, Glen Ellyn and Wheaton recognize the need to provide for logical municipal
boundaries in areas of municipal authority between their respective municipalities; and
WHEREAS, Glen Ellyn and Wheaton are units of local government as defined by Article VII, Section
10 of the Constitution of the State of Illinois; and
WHEREAS, units of local government are enabled by Article VII, Section 10 of the Constitution of
the State of Illinois to enter into agreements among themselves to obtain or share services and to exercise,
combine, or transfer any power or function, in any manner not prohibited by law or ordinance; and
WHEREAS, the Intergovernmental Cooperation Act, 5 ILCS 220/1 et seq., further authorizes units
of local government to jointly exercise any power, privilege, or authority which may be exercised by a unit
of local government individually, and to enter into contracts for the performance of governmental
services, activities, and undertakings; and
WHEREAS, Glen Ellyn and Wheaton are units of local government under the Intergovernmental
Cooperation Act, 5 ILCS 220/2; and

WHEREAS, Glen Ellyn and Wheaton have given consideration to the natural flow of storm water
drainage and single tracts having common ownership within the jurisdictions of Glen Ellyn and Wheaton;
and
WHEREAS, Glen Ellyn and Wheaton have previously entered into a Boundary Agreement dated
July 16, 1979 and a Boundary Agreement dated January 27, 1997; and
WHEREAS, the January 27, 1997 Boundary Agreement expired on January 27, 2017; and
WHEREAS, Glen Ellyn and Wheaton now desire to reestablish a Boundary Agreement which will
supersede the prior two Boundary Agreements and set forth a revised boundary line, west of which Glen
Ellyn will not annex and east of which Wheaton will not annex, which will mark the boundary of the
jurisdictions of Glen Ellyn and Wheaton except as modified by this Agreement; and
WHEREAS, Glen Ellyn and Wheaton also desire to utilize this Agreement to memorialize and clarify
responsibilities for infrastructure along Anthony Street, Ott Avenue, Harwarden Avenue, as well as for

two potable water main interconnections; and
WHEREAS, Glen Ellyn and Wheaton have authorized the execution of this Agreement as an
exercise of their respective authority and as an exercise of their intergovernmental cooperation authority
under the Constitution of the State of Illinois and the Intergovernmental Cooperation Act.
NOW, THEREFORE, for and in consideration of mutual promises contained herein and upon the
further consideration of the recitals hereinabove set forth, it is hereby agreed between Glen Ellyn and
Wheaton as follows:
1. Recitals. The recitals set forth above are hereby restated and incorporated as if fully set forth
herein.
2. Boundary Maps. Except as modified in this Agreement and as depicted in pages 1 through 6 of
the maps which are collectively attached hereto and made a part hereof as Exhibit A, the
jurisdictional boundary line between Glen Ellyn and Wheaton for municipal planning, subdivision
control and annexation shall be as depicted in Exhibit A.
3. Wheaton College Properties. With respect to the parcels of land lying east of Glencoe Street,
west of Kenilworth Avenue, and north of College Avenue/Pennsylvania Avenue, depicted in
Exhibit A as “Parcel 1” (hereinafter referred to as “Parcel 1”) to permit the orderly development
and provision of efficient municipal services including but not limited to public safety, utilities and
zoning, it is the desire of the current owner, the Trustees of Wheaton College (hereinafter referred
to as “Wheaton College”), to develop Parcel 1 within Wheaton. Wheaton College has expressed
interest in filing a petition with the respective municipal clerks requesting Parcel 1, currently
within the jurisdiction of Glen Ellyn (P.I.N.s 05-10-408-011, 05-10-408-003, 05-10-408-002, and
05-10-408-020) and owned by Wheaton College, be disconnected from Glen Ellyn as provided for
in Section 7-1-24 of the Illinois Municipal Code, 65 ILCS 5/7-1-24, and then annexed to Wheaton.
Glen Ellyn shall immediately process such a petition after receipt from Wheaton College in
accordance with applicable law. The boundary line of that part of Parcel 1 that is to remain in
Glen Ellyn shall be governed by the future disconnection and annexation ordinances. All
subdivision level development for Parcel 1 shall be reviewed, approved, and inspected by
Wheaton. Any subsequent development of that part of Parcel 1 to remain in Glen Ellyn, shall be
reviewed, approved, and inspected by Glen Ellyn.
a. Any “development,” as defined in the DuPage County Countywide Stormwater and
Floodplain Ordinance, of Parcel 1, whether independently or collectively, shall be
reviewed and approved by Wheaton. Any development reviewed and approved by
Wheaton shall:
i. Be residential in nature or a use permitted by Wheaton’s current institutional
zoning district;
ii. Prohibit any roadway connectivity to Anthony Street;
iii. Be developed in conformance with the DuPage County Countywide Stormwater
and Floodplain Ordinance, as amended by Wheaton;
iv. Be developed in such a manner that shall not cause any negative impacts to any
downstream and upstream properties and shall lower the 100-year critical
duration storm event, or Full Equations (FEQ) Model flood elevation, in Anthony
Street to no greater than 756.61 with an acceptable deviation of plus or minus

0.1 feet, North American Vertical Datum 1988 – feet (NAVD88-ft) as depicted in
Exhibit B attached hereto and incorporated herein as if fully set forth. Any
development of Parcel 1 shall include construction of an overland drainage path
from the lowest top of curb elevation at the west of Anthony Street down into
and through Parcel 1 as per Wheaton City Code Section 34-99(a) with bridges or
open ended box culverts to not be considered storm sewers as per Section 34-
99(a). The overland drainage path shall be located within the property to be
annexed into Wheaton.; and
v. Address the stormwater requirements set forth in paragraphs 3(a)(iv). Wheaton
shall provide any approved plans to the Glen Ellyn Village Engineer, who shall limit
his review to whether the plans comply with the requirements of paragraph
3(a)(iv) above. The Glen Ellyn Village Engineer shall review said plans and provide
approval or disapproval to Wheaton within sixty (60) days of receipt of the plans.
If he fails to do so, the plans shall be considered approved.
b. Any future Wheaton municipal property tax generated by any development of Parcel 1
shall be shared with Glen Ellyn based upon Parcel 1 equalized assessed value and
Wheaton’s annual tax rate. One-third (1/3) of the property tax generated by Parcel 1, if
any, shall be remitted to Glen Ellyn no later than August 1st of each year. The obligation
to share a portion of the property tax generated by Parcel 1 shall begin when the
development of Parcel 1 is completed and all final certificates of occupancy are issued by
Wheaton and shall terminate after 20 years of property tax revenues have been paid by
Wheaton to Glen Ellyn. This provision shall survive the expiration of this Agreement, but
only until Wheaton has made the 20th payment of property taxes to Glen Ellyn.
4. Anthony Street. West of Kenilworth Avenue, the Anthony Street right-of-way and associated
public improvements including the roadway pavement, roadway curb and gutter, public sidewalk,
driveway approaches, water main, sanitary sewer, street signage, and public trees contained in
the right-of-way in Glen Ellyn shall be the sole responsibility of Glen Ellyn to own, operate, and
maintain. The storm sewer structures, pipe, curb and gutter, pavement, and sidewalk around the
storm sewer structures draining the west end of Anthony Street as well as the sidewalk at the
west end of Anthony Street (and any future storm sewer draining south from Anthony Street
through Parcel 1) shall be the sole responsibility of Wheaton to own, operate, and maintain.
5. Ott Avenue. The Ott Avenue right-of-way and associated public improvements including the
roadway pavement, roadway curb and gutter, public sidewalk, driveway approaches, water main,
sanitary sewer, street signage, and public trees contained in Glen Ellyn from a point south of the
Harwarden Street/Ott Avenue intersection to a point south of the Evergreen Street/Ott Avenue
intersection shall be the sole responsibility of Glen Ellyn to own, operate, and maintain except
that the public improvements west of the back of curb on the west side of Ott Avenue including
the driveway approaches, public trees, street signage as well as the existing water main owned
by Wheaton serving properties within Wheaton adjacent to the Ott Avenue right of way, and the
storm sewer in the Ott Avenue right of way including any connecting catch basins shall be the sole
responsibility of Wheaton to own, operate and maintain. Glen Ellyn currently plans to construct
roadway and utility improvements at Ott Avenue in 2026. As part of Glen Ellyn’s improvement of
Ott Avenue, Wheaton shall complete all repairs, replacements, and adjustments of its
infrastructure within Ott Avenue. Wheaton also shall fund the construction of sidewalk ramps,
including all restoration work, on the west side of Ott Avenue at its intersections with Illinois

Street, and East Liberty Drive/Fairview Avenue. Said ramps shall be constructed as part of Glen
Ellyn’s Improvement of Ott Avenue and Wheaton shall reimburse Glen Ellyn upon its completion
and payment by Glen Ellyn to its Contractor for the work.
6. Harwarden Street. That portion of the vacated Harwarden Street thirty-three foot (33’) right of
way on 200 Lorraine Road, Glen Ellyn, (P.I.N. 05-15-211-039) now exists as a Public Walkway and
Utility Easement which grant rights for Wheaton to maintain an existing concrete public sidewalk,
storm sewer main and water main on 200 Lorraine Road, Glen Ellyn. As said easement lies on
property under Glen Ellyn’s jurisdiction, Glen Ellyn shall within its rights assist Wheaton with
ensuring the owner of 200 Lorraine Road does not interfere with Wheaton’s exercise of all
necessary work within said easement to maintain the existing water and storm sewer mains as
well as the public sidewalk. At the intersection of Lorraine and Harwarden, storm sewer and catch
basins serving Lorraine north of Harwarden shall be the responsibility of Glen Ellyn. The public
improvements on Harwarden between Lorraine and Ott, including the roadway pavement,
roadway curb and gutter, public sidewalk, driveway approaches, water main, street signage, and
public trees shall be the responsibility of Wheaton to own, operate, and maintain except those
public improvements including the driveway approaches and parkway trees located north of the
back of curb on the north side of Harwarden as well as the existing Village of Glen Ellyn water
main serving properties within Glen Ellyn adjacent to the Harwarden right of way shall be the
responsibility of Glen Ellyn to own, operate, and maintain.
7. On-Site Parking Facility. The properties (P.I.N. 05-22-200-028 and P.I.N. 05-22-200-027) on the
north side of Taft Avenue, depicted on page 3 of Exhibit A as Parcel 2, currently used as on-site
parking for the property (P.I.N. 05-22-201-037) adjacent and east of said properties, shall be
disconnected from Wheaton as provided for in Section 7-1-24 of the Illinois Municipal Code, 65
ILCS 5/7-1-24, and then annexed to Glen Ellyn.
8. Emergency Water Connections. The Glen Ellyn and Wheaton potable water systems are
interconnected at two locations to provide emergency stand by water supplies in the event of
system failures in either community. The unmetered interconnections are located at Lorraine and
Harwarden and Evergreen and Ott and would be activated only by agreement by the Public Works
Directors of both Glen Ellyn and Wheaton.
9. Planning Jurisdiction. This Agreement shall not be construed to limit or adversely affect the right
of either party to file a statutory objection to a proposed zoning application by DuPage County
within one and one-half (1-1/2) miles of its corporate limits.
10. Terms and Assigns. This Agreement shall inure to the benefit of and be binding upon the parties,
their respective successors and assigns for a term of twenty (20) years or when 20 years of
property tax revenue is paid by Wheaton to Glen Ellyn.
11. Law and Venue. This Agreement shall be construed in accordance with the laws of the State of
Illinois and venue shall only be in the Circuit Court of DuPage County, Illinois.
12. Recordation. Wheaton shall record this Agreement with the DuPage County Recorder of Deeds
at its own expense.

13. Invalidity. If any section, paragraph, subdivision, clause, sentence, or provision of this Agreement
shall be adjudged by any court of competent jurisdiction to be invalid, such judgement should not
affect, impair, invalidate, or nullify the remainder thereof, which remainder shall remain and
continue to be in full force and effect.
14. Authorization. Upon execution of this Agreement by the corporate authorities of Glen Ellyn and
Wheaton, the municipal clerk of the respective municipality shall each affix their official seal to
this Agreement.
15. Agreement to be on File. Copies of this Agreement shall be placed on file with the municipal
clerks of Wheaton and Glen Ellyn and shall be made available in the offices of said municipal
clerks.
16. Counterparts. This Agreement may be executed in counterparts each of which shall be
considered an original and together shall be considered one and the same Agreement.
17. Headings and Titles. The headings and titles of any provisions of this Agreement are for
convenience and reference only and not to be considered in construing this Agreement.
18. Notice. Any notice required to be given by this Agreement shall be deemed sufficient if made in
writing and sent by certified mail, return receipt requested, by personal service, or by electronic
mail to the persons and addresses indicated below or to such other addresses as either party
hereto shall notify the other party of in writing pursuant to the provisions of this subsection:

shall be deemed to have been given at the time of mailing. Notice by email transmission shall be
effective as of date and time of email transmission, provided that the notice transmitted shall be sent
on business days during business hours (9:00 a.m. to 5:00 p.m. Chicago time). In the event email
notice is transmitted during non-business hours, the effective date and time of notice is the first hour
of the first business day after transmission.

19. Effective Date. The effective date of this Agreement shall be the last date of its execution by one
of the parties as reflected below.

Statement of the Issue:
The Glen Ellyn Park District has applied for a Class K liquor license to sell beer and wine at Holes
& Knolls Miniature Golf Course which it operates. Class K is an existing liquor license classification
that requires the Village Board to increase the number of licenses in the Code from none (0) to one
(1) permitted.
Analysis:
The Village's Class K Liquor License authorizes the retail sale of beer and wine on a specific
premises owned by a park district within a building and the immediate adjacent open space of a
miniature golf course for consumption only in the building and the immediate adjacent open space
where the product is sold.
Budget Impact:
The applicant has paid the $500 initial application fee and the pro-rated fee of $50 for the remainder
of this Liquor License schedule.

An Ordinance to Amend Title 3 (“Business Regulations”), Chapter
19 (“Liquor Control Code”), Section 3-19-12 (“Restriction on
Number of Licenses”) of the Glen Ellyn Municipal Code to Amend
the Number of Permitted Liquor Licenses
WHEREAS, the Village of Glen Ellyn (“Village”) is a home rule unit of government as
provided by the provisions of Article VII, Section 6 of the Illinois Constitution of 1970; and
WHEREAS, as a home rule unit of government, the Village is expressly empowered to
perform any function pertaining to its government and affairs, including, but not limited to the
power to regulate for the protection of the public health, safety, morals and welfare; and
WHEREAS, pursuant to the Illinois Liquor Control Act, 235 ILCS 5/1-1 et seq., and the
Village’s home rule powers, the Village has established various classes of liquor licenses for the
retail sale of alcoholic liquor in the Village and the number of permitted licenses within each class,
as set forth in Title 3 (“Business Regulations”), Chapter 19 (“Liquor Control Code”) of the Village
Code of the Village of Glen Ellyn; and
WHEREAS, the Village’s Board of Trustees deem it to be in the best interest of the Village
to periodically review and update the Liquor Control Code of the Village and to amend the number
of permitted liquor licenses in various classifications; and
WHEREAS, the Board of Trustees have determined that it is in the best interest of the
Village to amend the number of Class K permitted liquor licenses to one (1) as set forth in this
Ordinance.
WHEREAS, the Village President serving as the Local Liquor Control Commissioner is
in support of this Ordinance.
NOW THEREFORE, be it ordained by the President and Board of Trustees of the Village
of Glen Ellyn, DuPage County, Illinois, in the exercise of their home rule powers, as follows:

conclusions set forth above are hereby adopted by the President and Board of Trustees as the
findings of fact and conclusions of the corporate authorities of the Village of Glen Ellyn and are
incorporated herein by reference as though fully set forth.
Section 2. Village Code Amended. Title 3 (“Business Regulations”), Chapter 19
(“Liquor Control Code”), Section 3-19-12 (“Restriction on Number of Licenses”) of the Glen
Ellyn Village Code is amended by deleting the overstricken language and adding the underlined
language to read as follows:
3-19-12. Restriction on number of licenses.
The Local Liquor Control Commissioner shall not issue more than the number of licenses set forth
hereinbelow for each class.

Section 3. Severability and Repeal of Inconsistent Ordinances. If any section,
paragraph, clause or provision of this Ordinance shall be held invalid, the invalidity thereof shall

Section 4. Effective Date. This Ordinance shall be in full force and effect after its
approval, passage and publication as provided by law.

Statement of the Issue:
The Executive Oversight Committee of the Glenbard Wastewater Authority (GWA) approved a
design-build contract with Trotter and Associates, Inc.(TAI) and, as part of that approval, the GWA
requests that the village boards of Glen Ellyn and Lombard take formal action to support the
contract and the design-build process.
Analysis:
In 2018, the Glenbard Wastewater Authority (GWA) completed a Facility Plan that identified and
prioritized major capital improvement needs. Among the projects outlined in the plan was the Final
Clarifier Improvements Project (Project). The Authority selected Trotter & Associates, Inc. as the
design consultants through a competitive selection process. This Project was originally planned to
follow a traditional design bid build approach, but during design of the Project, due to the technical
complexity of the work and the efficiencies gained through economies of scale, GWA staff sought
approval to deliver the Project using a design-build delivery method. Design-build delivery
benefits:The design-build delivery method offers several advantages for this Project:
• Lump Sum Pricing: Establishes a guaranteed lump sum price prior to Project kickoff,
significantly reducing the risk of change orders to GWA.
• Accelerated Schedule: Reduces the overall Project schedule by approximately thirty
percent (30%) by allowing long lead-time equipment to be ordered immediately and enabling
construction activities to begin while final design details are completed. This approach is
expected to result in an estimated ten-month earlier Project completion and a savings of
$485,000 in price escalation.
• Reduced Engineering Costs: Eliminates the need for bidding-level plans and
specifications, the formal bid process, and allows design and construction engineering to
occur concurrently. This delivery method is estimated to reduce design and construction
engineering costs by approximately $300,000.

With the conversion to a design-build approach, a new contract was requested from TAI that
consisted of an entire design build team (i.e., design engineers, a general contractor, and
subcontractors). Since a competitive selection process was used to select TAI, a formal request for
proposals was not sent out for the design build contract, and instead, the waiving of competitive
bidding was requested. Because of the high dollar amount and lack of a competitive selection
process for the design-build approach, the GWA’s legal counsel suggested that in addition to the
GWA's Executive Oversight Committee approving the waiver of a competitive selection process
and authorizing the GWA to enter into a design-build contract with TAI, formal award would only
be given pending formal approval by the Board of Trustees of the Village of Glen Ellyn and the
Board of Trustees of the Village of Lombard. At the Authority’s April 13, 2026 public EOC
meeting, the EOC approved to waive a competitive selection process and authorize the Authority to
enter into a design-build contract with TAI in an amount not to exceed $8,725,000 “pending formal
approval by the Board of Trustees of the Village of Glen Ellyn and the Board of Trustees of the Village of
Lombard.”
Budget Impact:
As this is a Glenbard Wastewater Authority project, there is no direct impact to the Village.

BE IT RESOLVED by the Village President and Board of Trustees of the Village of Glen
Ellyn, DuPage County, State of Illinois (“Village”), in the exercise of their home rule powers, that
the Village supports the Glenbard Wastewater Authority entering into a contract for design-build
services with Trotter and Associates, Inc. for the Final Clarifier Improvements Project as requested
of the Village by the Glenbard Wastewater Authority.
THIS RESOLUTION shall be in full force and effect from and after its adoption and
approval as provided by law.
