CITY OF GRAND RAPIDS CITY COMMISSION MEETING TUESDAY, OCTOBER 4, 2022 7:00 PM Welcome to the Grand Rapids City Commission Meeting. This session is the final process in the consideration of the items listed on the following agenda. All of these agenda items have been thoroughly reviewed and discussed in the various Standing Committees of the City Commission which meet on Tuesday morning. Expected Meeting Procedures 1. Depending on the meeting there can be multiple opportunities for public comment. -The First is limited to items on the Commission’s agenda that are slated to be voted on -The Second is for specially scheduled required public hearings -The Third is for any issue you would like to bring to the attention of the Commission 2. You may only speak once on each issue. 3. All comments are to be limited to 3 minutes. 4. City Commission meetings are to be a safe place for everyone involved, as such: -No clapping, cheering, or holding up of signs -Please refrain from swearing, name calling and/or making derogatory comments directed toward a person’s race, religion, nation of origin, etc. 5. PETITIONS AND COMMUNICATIONS - Communications addressed to the City Commission are distributed to all members and are acknowledged for information, or are referred to a committee or staff for follow up. 1. Communication received from David Douglas et al. regarding racial justice in Grand Rapids 2. Communication received from Shannon Tanis regarding the Consolidated Annual Performance and Evaluation Report 3. Communication received from Tatum Hawkins, Director of Development & Communications at Grand Rapids Women's Resource Center, regarding the Consolidated Annual Performance and Evaluation Report 4. Communication received from Jackie Hunt expressing concerns regarding the Medicare Supplemental Trust Fund Ordinance 5. Communication from Kevin Judd regarding their resignation from the Mobile GR Commission VIII. REPORTS OF CITY OFFICERS - The City Manager, City Attorney, City Clerk, City Treasurer, and City Comptroller may submit reports or information directly to the City Commission for consideration. 1. Warrant Report August 24, 2022 thru September 20, 2022 2. Treasurer’s Report for Period of September 8, 2022 through September 21, 2022 IX. CONSENT AGENDA AND REPORTS OF STANDING COMMITTEES: A. COMMITTEE ON APPOINTMENTS The Committee considers and makes recommendations on appointments to the City's various boards and commissions. 1. Resolution confirming Mayor Bliss' appointment of Jason Osbourn to the Grand Rapids Police Civilian Appeals Board 2. Resolution confirming Mayor Bliss' appointment of Gary Mulder to the Grand Rapids Police Civilian Appeals Board 3. Resolution confirming Mayor Bliss' appointment of Bill DeJong to the Southtown Corridor Improvement Authority B. FISCAL COMMITTEE The Committee considers and makes recommendations on matters referring to bids, claims, and other financial matters of the City . 1. Resolution recognizing Albatross Aviary as a Local Civic Organization 2. Resolution authorizing advertisement with the Grand Rapids Griffins for $29,767 on behalf of Mobile GR 3. Resolution authorizing submission of documentation and execution of an agreement with the U.S. Department of Housing and Urban Development for a supplemental award of $169,393.01 in Emergency Solutions Grants Coronavirus (ESG-CV) funds 4. Resolution approving a professional services agreement with Disability Advocates of Kent County for technical assistance (not to exceed $10,000) 5. Resolution approving Grand Rapids Public Schools - PEG Grant Reimbursement in the amount of $23,315.00 6. Resolution authorizing an agreement with Tetra Tech for technical and support services in the amount of $395,000. 7. Resolution authorizing an agreement with American Rivers for continued Stormwater Credit Trading Program work in an amount not to exceed $35,000 8. Resolution approving a contract in the amount of $33,214.00 with PROACTIVE Project Inc., for the Get Out the Vote phase of the Participatory Budgeting Pilot 9. Resolution authorizing $60,000 in support of the recommendations of the SAFE Task Force 10. Resolution accepting a grant award from the Federal Emergency Management Agency (FEMA) and the U.S. Department of Homeland Security (DHS) 2021 Staffing for Adequate Fire and Emergency Response (SAFER) Grant Program – in the amount of $2,862,128.00 11. Resolution accepting the continuation of a grant award of $789,371 from the Auto Theft Prevention Authority (ATPA) 12. Resolution approving a contract with the National Civic League in the amount of $99,790 to conduct community feedback sessions to gather ideas for reforming police practices and community input structures - Add-On 13. COMMUNITY DEVELOPMENT COMMITTEE The Committee considers and makes recommendations on matters concerning public service, public improvements, streets, traffic and public buildings. 1. Resolution approving a Fireworks Discharge Permit for Pyrotechnico FX for an indoor special effects at the Van Andel Arena in connection with the Carrie Underwood concert on Oct. 18, 2022 2. Resolution setting October 18, 2022 as the date to consider an ordinance rezoning 101, 119 & 135 Garden Street SE 670 to SD-PRD (Special Districts–Planned Redevelopment District) for the redevelopment of an existing industrial building into a mixed-use development and the construction of sixteen detached homes 3. Resolution scheduling a public hearing for October 18, 2022 to consider a Brownfield Plan Amendment for the 280 Ann, LLC Redevelopment Project at 280 Ann Street NW 4. Resolution approving an agreement with the Michigan Department of Transportation for a Congestion Mitigation and Air Quality grant for the Traffic Management Operations Center with a total cost of $660,000. 5. Resolution approving a Construction Agreement in the amount of $65,000 and accepting Public Utilities Easements and a Sidewalk and Utilities Easement for HOM Flats at Maynard 6. Resolution approving an Easement Agreement at 11231 Lakeshore Drive, West Olive, Michigan for nominal consideration 7. Resolution approving an agreement with MDOT for the Improvements in Eastern Avenue from 44th Street to 28th Street, approving a cost sharing agreement with the City of Wyoming, and authorizing $2,247,723 for the local share of the project costs 8. Resolution approving an increase of $100,000 for Systematic Sidewalk Repairs at various Locations 2022-3 with a total project cost not to exceed $515,000 9. Resolution approving an increase of $302,000 for Water Main on the Relocation of the Eastside Trunk Sewer Project (Contract No. 1) with total project cost not to exceed $11,610,600 10. Resolution approving a Construction Agreement and accepting a Public Utilities Easement for Pfeiffer Pines Site Condominium - Phase 3 11. Resolution awarding a contract with Wyoming Excavators, Inc for Improvements to Cherry, Garfield and Midtown Green Parks in the amount of $563,280 with total amount not-to-exceed $662,000 D. COMMITTEE OF THE WHOLE The Committee considers all matters that are desired to be deliberated in committee by the full City Commission. Most ordinances and licensing matters are brought before this committee. 1. Resolution approving the request from Chelsea Moncion for a Liquor License to be located at 1919 Boston St SE, Grand Rapids, MI 49506 2. Resolution approving the request from Monsoon Vietnamese Cuisine for a Development District Liquor License to be located at 55 Monroe Center St NW, Suite 2. 3. Resolution approving a request for Mayor Bliss to attend the US Conference of Mayors Winter Meeting and Mayors Innovation Project's Winter Meeting in Washington, D.C., January 17 - 22, 2023. 4. Request for Commissioner Milinda Ysasi to attend the Local Government Hispanic Network Annual Membership Meeting in Chicago, Illinois on November 4, 2022. 5. Resolution Approving Collective Bargaining Agreement with the Grand Rapids Employees Independent Union 6. Resolution approving Collective Bargaining Agreement with the Association of Public Administrators X. ITEMS REMOVED FROM CONSENT 1. Resolution designating Social Districts where alcoholic beverages sold by multiple qualified Michigan Liquor Control Commission licensees may be consumed by purchasers pursuant to Public Act 124 of 2020, as amended - Removed from Consent 2. Ordinance amending Section 1 of the Budget Ordinance 2022-13 for Fiscal Year 2023 (Amendment No. 3) 4. Ordinance repealing Chapter 133 “Electrical Code” of the Grand Rapids City Code and replacing it with a new Chapter 133 XII. CITY COMMISSION RESOLUTIONS - Resolutions to be deliberated by the City Commission but which come directly to the City Commission rather than from one of the Standing Committees. 1. BARRONE v. CITY OF GRAND RAPIDS, et al City Commission resolution approving settlement - Add-On 2. FORD v. CITY OF GRAND RAPIDS City Commission resolution approving settlement - Add- On XIII. PUBLIC HEARINGS - Public hearings are scheduled to allow citizens to speak on subjects which will be before the City Commission for action at a future date. Speakers may address the Commission once on each hearing. 1. Public hearing to consider the establishment of a Neighborhood Enterprise Zone for the Lofts on Grove project located at 1359 and 1329 Plainfield Avenue NE 2. Public hearing to consider a Brownfield Plan Amendment for the Lofts on Grove Holdings, LLC Redevelopment Project at 1359 Plainfield Ave NE, 1329 Plainfield Ave NE and 1367 Grove Place NE 3. City Commission to hear appeals on Special Assessment Nuisance Roll 8772 XIV. PUBLIC COMMENTS - At the conclusion of the official business and public hearings, the agenda provides for public comment on any other matters citizens may wish to bring to the attention of the City Commission. There will be no separate discussion of these matters, and they will be enacted by one motion. Executive Session A meeting in which the proceedings are of a confidential nature. Only members and invited guests may attend, and all are honor-bound to maintain confidentiality. Motion A proposal that the Commissioners take a specific action or stand on an item being presented to the City Commission. Ordinance A piece of legislation enacted by a municipal authority. Postpone A motion to postpone is made if the City Commission needs more time to make a decision. A postponement cannot go beyond the next session. Quorum Number of voting members who must be present in order that business can be legally transacted. Recess Short intermission within a meeting. Recognize / Obtain the Floor Acknowledgement by the presiding officer of the City Commission that a member has the right to address the assembly. Rescind (Repeal) Allows the City Commission to repeal an action previously taken; i.e., ordinances, etc. Resolution A decision by the City Commission to do or not to do something. Robert’s Rules of Order A guide to fair and orderly meeting procedures. Suspend the Rules This motion is used when the City Commission wants to do something that violates its own rules. The motion does not apply to an organization’s bylaws, local, state, or national law; or fundamental principles of parlia-mentary law. An appropriate suspension of the rules, used on occasion by the City Commission, would be a motion to change the agenda.
