2. The City shall pay Grattan Raceway Park, Inc. a “not-to-exceed” amount of
$40,000 in return for use of the track for two years from December 31, 2022

hereby authorized to execute the agreement.

1. That the City Commission authorizes the acceptance of a grant award for
the benefit of traffic enforcement programs in the total amount of $36,504.
2. That the awarded grant between the City of Grand Rapids and the Office of
Highway Safety Planning be approved, and the Mayor is authorized to
execute said agreement and related documents upon approval as to form
by the City Attorney.

1. In 2002 the City entered into a 20-year lease with a 10-year extension to
lease the first floor of the Phinney Building located at 87-89 Monroe
Center, NW in the City and the lease permits the City to sublease all or any
portion thereof; and
2. The City’s current sublease agreement with the GRAAMA is set to expire
on December 31, 2022; therefore
RESOLVED that upon approval as to form by the City Attorney, the
Mayor and City Clerk are hereby authorized to execute a sublease agreement
on property located at 89 Monroe Center between the City and the Grand
Rapids African American Museum and Archives for the period of 6-months for
the lease rate of $2,132.17 a month and a six-month renewal option at the
same rate.

1. The City of Grand Rapids is part of the Water Research Foundation; and
2. The city receives a variety of services to improve water and wastewater
services to the public; and

3. Approval is needed for payment to the Water Research Foundation in the
amount of $51,407.30 to be charged to accounting codes 5910-536-1000-
9150 ($31,538.30) and 5900-527-1000-9150 ($19,869); therefore
RESOLVED that the Comptroller is authorized and directed to pay the
invoice under this resolution.

WHEREAS:
1. The City of Grand Rapids Strategic Plan includes strategies to “support the
creation, retention and growth of businesses;” and
2. A vibrant retail sector contributes to the overall well-being of the City and
its residents and businesses; and
3. Understanding of the current retail market and future retail growth potential
and reducing the first-floor retail vacancy rate within the City of Grand
Rapids are integral to developing and retaining retail businesses in
Downtown and in the City’s neighborhood commercial corridors; and
4. The Grand Rapids Area Chamber of Commerce, the City of Grand Rapids
Downtown Development Authority and the City have collaborated to
develop the Grand Rapids Retail Retention and Recruitment Initiative;
therefore
RESOLVED:
1. That the City of Grand Rapids is hereby authorized to enter into an
amended Services Agreement (the “Agreement”) with the Grand Rapids
Area Chamber of Commerce and City of Grand Rapids Downtown
Development Authority for the administration of the Grand Rapids Retail
Retention and Attraction Initiative in the amount “not-to-exceed”
$143,332.81 for the period of November 10, 2021, through June 30, 2024;
and
2. That the Mayor is hereby authorized to execute the Agreement on behalf of
the City in a form approved by the City Attorney; and
3. That payment for the contract will be made from the Economic
Development General Operating fund (1010-728-1000-8010); and
4. That all resolutions or parts of resolutions in conflict herewith shall be and
the same are hereby rescinded.

Baker Tilley US, LLP
Recommendation for award for executive recruitment services for the
Human Resources Department from GovHR, LLC for the position of Fire
Chief for the “not-to-exceed” amount of $23,500.00, and from Baker Tilley
US, LLP for the position of Director of Human Resources for the “not-to-
exceed” amount of $26,950.00.
3. Alexander Chemical
Increase to the annual “not-to-exceed” contract amount by $700,000.00, for
a new annual “not-to-exceed” amount of $1,077,000.00, for the “as-
needed” purchase of bulk liquid sodium hypochlorite (bleach) for the
Environmental Services Department and the Lake Michigan Filtration Plant
from Alexander Chemical Corporation.

Increase to the annual “not-to-exceed” contract amount by $20,000.00, for
a new annual “not-to-exceed” amount of $140,000.00, for landscape
maintenance services for Facilities Management, Environmental Services,
Parks & Recreation, Impound Lot and the Fire Department from Shawn
Sremba (dba Natural Landscapes).

services for a Falcon live-bottom asphalt truck for the Fleet Management
Department from AIS Construction Equipment for the total amount of
$13,999.02.
12. Dubois-Cooper
Purchase of two (2) Original Equipment Manufacturer (O.E.M.) Gorman-
Rupp lift suction pumps for the Environmental Services Department from
Dubois-Cooper for the amount of $12,496.00; freight charges will be added
at time of shipment.
13. Grand Arbor Group
Purchase of insecticide product for the upcoming 2023 season for the
Parks and Recreation – Forestry Department from Grand Arbor Group for
the total amount of $25,415.64.

WHEREAS:
1. The City of Grand Rapids (“City”) acquired the property identified as 617
Vries Street SW (the “Property”) involuntarily through the tax foreclosure
process on May 26, 1993; and
2. The adjacent property owner has submitted an offer to purchase the
Property and City Commission Policy 900-63 permits the sale; and
3. The City desires to return the Property to the private ownership of
responsible parties; therefore
RESOLVED:
1. That the sale and conveyance of the property commonly known as 617
Vries Street SW, permanent parcel number 41-17-01-158-070 which is
legally described as
LOT 32 ALSO ALL OF VAC CORDELIA CT ALLEY ADJ ON THE N ALSO
W 10 FT OF LOT 33 ALSO S 1/2 OF THAT PART OF VAC PORTION OF

for consideration of two thousand dollars and zero cents ($2,000.00) to

2. That the Mayor is authorized to sign a quitclaim deed on behalf of the City
to effectuate the conveyance; and
3. That the City accepts a public utility easement over the Property for the
public purpose of maintaining the existing utilities on the Property, which
easement will be recorded concurrent with the aforementioned quitclaim
deed; and
4. That all incidental costs associated with the conveyance will be paid by the
grantee and the proceeds of sale will be deposited to the Environmental
Services Department ($1,930) and the Property Management Fund ($70).

RESOLVED:
1. That the City Commission hereby authorizes the City Manager, or
designee, to submit two (2) Michigan Spark Grants applications to the
Michigan Department of Natural Resources requesting $1,000,000 each for
improvements to the playground and surrounding areas at Richmond Park
and Martin Luther King Park, and to provide any additional information that

may be required with respect to the project; and
2. That, contingent upon execution of an agreement with the Michigan
Department of Natural Resources, the City will provide matching funds to the
Richmond Park project in the amount of $600,000 (38%), for an estimated
total eligible project cost of $1,600,000 with source of said matching funds to
be $20,000 in private donations from the Mitten Foundation and $580,000 in
Parks Millage during fiscal years 2023 and 2024; and
3. That, contingent upon execution of an agreement with the Michigan
Department of Natural Resources, the City will provide matching funds to the
Martin Luther King Park project in the amount of $500,000 (33%), for an
estimated total eligible project cost of $1,500,000 with source of said
matching funds to be the Parks Millage during fiscal years 2023, 2024, and
2025.

WHEREAS:
1. Kent ISD owns real property located at 2930 Knapp Street, NE within the
City of Grand Rapids, Kent County, Michigan which consists of five parcels
of real property, four parcels which are located within the boundaries of the
City of Grand Rapids and one parcel which is located within Grand Rapids
Township.
2. As the largest constituent within the Knapp's Corner Drain Drainage
District, and in a cooperative effort with the Drain Commissioner to provide
a regional drainage solution, the City of Grand Rapids desires to acquire a
certain portion of Kent ISD’s property for public drainage purposes so as to
establish, construct, operate, improve, and maintain a drain and water
retention area/system and to acquire easements for underground
stormwater pipes and for other facilities, as well as ingress and egress to
the Kent ISD Property.
RESOLVED:
1. The City Commission authorizes the City to enter into an Agreement with
Kent ISD and KCDD providing for the acquisition of a portion of the Kent
ISD Property and related easements, upon the terms and conditions
detailed in the Agreement, for inclusion in the formation of a new drainage
district.
2. The City Commission authorizes the Mayor and City Clerk to execute the
Agreement upon the terms and conditions contained in the Agreement, to
make any revisions to the Agreement not inconsistent with this resolution,
and to take any other action necessary to provide the City with the
acquisition of a portion of the Kent ISD property and related easements, all

of which shall be subject to review and approval by the City’s legal counsel.
3. All resolutions and parts of resolutions insofar as they conflict with the
provisions of this resolution are hereby rescinded.

WHEREAS:
1. On February 22, 2022 (Proceeding No. 91438), the City awarded a
contract to Katerberg-Verhage, Inc. (Katerberg) for the following project:
Improvements to Heartside and Pekich Park
(hereinafter referred to as the “Project”); and
2. It is necessary to increase the scope of work and authorize expenditures
for the aforesaid contract; and
3. It is necessary to execute a Memorandum of Understanding (MOU) with
Edgar Hernandez for a basketball court mural.
RESOLVED:
1. That the scope of work for the contract with Katerberg, be increased at a
cost of $36,310 with total expenditures not to exceed $1,099,000 which
includes the costs of the construction contract, an MOU for a basketball
court mural by Edgar Hernandez, contingencies, and administration. Said
amount of $1,099,000 to be charged to the applicable codes currently
defined as follows: $11,815 to Code No. 2460-447-8000-8010 and
$1,087,185 to applicable Parks Millage Codes.
2. That the MOU with Edgar Hernandez be approved and that, upon approval
as to form by the City Attorney, the Mayor and City Clerk be authorized to
execute said MOU on behalf of the City.
3. That the City Engineer or his designee is hereby authorized to execute the
necessary change order to the aforesaid contract with Katerberg.
4. That the City Comptroller is hereby authorized and directed to make
payment, in amounts and to said payees, as the City Engineer or his
designee requests in connection with the Project.

WHEREAS, bids were received on November 22, 2022 for the
following project:
Replacement of Private Lead Service Lines Contract 2023-1
(hereinafter referred to as the “Project”)

and B & Z Company (B&Z) submitted a bid of $1,179,226, for which the
engineer’s estimate, is $1,552,240; therefore
RESOLVED:
1. That the bid of B&Z be accepted and that, upon approval as to form by the
City Attorney, the Mayor and City Clerk be authorized to execute the
contract documents for the Project on behalf of the City.
2. That total expenditures for the Project be authorized in an amount not to
exceed $1,528,300 which includes the costs of the construction contract,
engineering/inspection/administration, and contingencies. Said amount of
$1,528,300 to be charged to the applicable Water System Fund codes.
3. That the City Comptroller is hereby authorized and directed to make
payment, in amounts and to said payees, as the City Engineer or his
designee requests in connection with the Project.

WHEREAS, a Qualification Based Selection Process was used to
receive a proposal for professional services on August 11, 2022 for the
following project:
Improvements to Martin Luther King Park Lodge
(hereinafter referred to as the “Project”)
and Erhardt Construction Company (Erhardt) submitted a proposal of $30,000.
RESOLVED:
1. That the proposal of Erhardt be accepted and that, upon approval as to
form by the City Attorney, the Mayor and City Clerk be authorized to
execute the professional services agreement for the Project on behalf of
the City; and
2. That expenditures for the Project be authorized in an amount “not-to-
exceed” $30,000 which includes the costs of professional services
agreement and contingencies. Said amount of $33,000 to be charged to
the applicable Parks Millage Codes; and
3. That the City Comptroller is hereby authorized and directed to make
payment, in amounts and to said payees, as the City Engineer or his
designee requests in connection with the Project.

1. On December 13, 2020 (Proceeding No. 90286) the City approved a grant
application in connection with the Grand River Trails East – Leonard Street
to Ann Street (hereinafter referred to as the “Project”); and
2. On January 19, 2022 (Proceeding No. 91363) the City authorized final
design engineering services in connection with the Project; and
3. It is necessary to authorize a payment for a Temporary Grading Permit in
connection with the project; therefore
RESOLVED:
1. That a payment in the amount of $1,135.00 is hereby authorized to the
following property owner at the following property:

E. COMMITTEE OF THE WHOLE

WHEREAS Downtown Grand Rapids, Inc., Kendall College of Art and
Design of Ferris State University (KCAD) and the City of Grand Rapids have
collaborated on delivery of the annual ArtPrize event since 2009, and now
recommend entering into a Memorandum of Understanding for the
establishment of ArtPrize 2.0; therefore
RESOLVED:
1. That a memorandum of understanding between Downtown Grand Rapids,
Inc., Kendall College of Art and Design of Ferris State University and the
City of Grand Rapids for establishment of ArtPrize 2.0 is hereby approved;
and
2. That the Mayor and City Clerk are authorized to execute the MOU upon
approval by the City Manager as to content and by the City Attorney as to
form.

Licenses within the Downtown Development Area, as authorized by Public
Act 501 of 2006 (MCL 436.1521a(1)(b)); and
2. Gin Gin Lounge, LLC (d/b/a General Wood Shop), at 507 Bridge St. NW,
Grand Rapids, MI 49504, Kent County, has submitted an application for a
license under Section 521a(1)(b) of the Act; and
3. Gin Gin Lounge, LLC (d/b/a General Wood Shop), has supplied information
with their application which supports the required stipulations of the Act;
and
4. The City Assessor has submitted an affidavit stating the total amount of
public and private investment in real and personal property within the
Downtown Development Area is in excess of $200,000 over the preceding
five (5) year time period; and
5. The Downtown Development Authority adopted a resolution on November
9, 2022, recommending approval of the issuance of a new Class C
Redevelopment District Liquor License, at 507 Bridge St NW, Grand
Rapids, MI 49504, Kent County, above all others; therefore
RESOLVED that the request from Gin Gin Lounge (d/b/a General
Wood Shop) located at 507 Bridge St NW, Grand Rapids, MI 49504, Kent
County for a new Class C Redevelopment District Liquor License pursuant to

Areas within the designated Social Districts; and

Permit application; therefore
RESOLVED:
1. That the Social District Permit application from One Beer at a Time, LLC

the City Commission for consideration and approval by the Michigan Liquor
Control Commission; and
2. That the City Clerk is authorized and directed to provide the applicant with
a certification of this action in the form specified by the Michigan Liquor

7. The City shall reduce the employee pension contribution by 3.0% for
employees hired on or after December 20, 2011, in accordance with the
actuary study of September 16, 2022.
8. The City shall provide a $1,000 non-pensionable payment to each
employee on or before the last payroll in December of 2022.
9. The City shall add language to allow for work that does not require a sworn
police officer to perform be reorganized to another classification including
outside of the bargaining unit.
10. The City shall add Oversight and Public Accountability (OPA) language.
11. The City shall add the language incentive program to the bargaining
agreement; and
12. The City shall increase wages by 6.0% effective July 1, 2022, 2.0%
effective July 1, 2023, and 1.5% effective July 1, 2024.
FURTHER RESOLVED that:
1. Upon reduction of said understanding to an Agreement in a form approved
by the City Attorney, the Mayor and City Clerk are authorized to execute
the same on behalf of the City; and
2. The City Commission shall consider and act upon the Salary Ordinance
amendments necessary in order to effectuate this labor agreement.

Ordinance is receiving a rate of compensation higher than the maximum rate
herein established for their position shall receive the rate of compensation now
in effect and subsequent generally applied increases.

AN ORDINANCE TO AMEND SECTIONS 1.504, 1.505, 1.506, AND 1.507 OF
CHAPTER 11 OF TITLE I OF THE CODE OF THE CITY OF GRAND RAPIDS
ORDINANCE NO. 2022 - 51
THE PEOPLE OF THE CITY OF GRAND RAPIDS DO ORDAIN:
Section 1. That Section 1.504 of Chapter 11 of Title I of the Code of
the City of Grand Rapids be amended to read as follows:
“Sec. 1.504. Purchases Authorized.
(1) Purchases by the City, sales to the City, or authorizations for the purchase
of goods by the City involving expenditures of fifty thousand dollars
($50,000.00) or less, the appropriation for which has been approved by the
City Commission as part of the annual fiscal process and funds for which
are in the City's annual budget, may be made without formal, sealed
bidding by the Purchasing Agent, subject to any rules and policies that may
be established by the City Commission.
(2) The Purchasing Agent may delegate the authority and responsibility to
other City employees to obtain price quotations or bids or to make
purchases in an amount of up to ten thousand dollars ($10,000.00) for
goods not currently covered by a City contract, as long as the employee
complies with all applicable provisions of the City Charter and the City
Code and with all applicable City rules and policies. The Purchasing Agent
may withdraw a delegation previously granted when, in the sole judgment
of the Purchasing Agent, it is advisable to do so. The authority delegated
under this subsection may be used only by those employees specifically
empowered to do so by the City Manager. This Section shall be
implemented by a City Commission Policy.”
Section 2. That Section 1.505 of Chapter 11 of Title I of the Code of
the City of Grand Rapids be amended to read as follows:
“Sec. 1.505. Purchases of More than Ten Thousand Dollars.
No requisition or purchase of more than ten thousand dollars
($10,000.00) and up to one hundred thousand dollars ($100,000.00) shall be
made unless approved by the City Commission or City Manager or their
designee. No requisition or purchase of more than one hundred thousand
dollars ($100,000.00) shall be made unless authorized by the City Manager
and approved by the City Commission. In case of an emergency, wherein any
delay in purchasing would possibly result in the interruption or detriment to the

public service, the City Manager may approve a requisition or purchase up to
five hundred thousand dollars ($500,000.00) and shall apprise the City
Commission of the situation and purchase at its next regular meeting.”
Section 3. That Section 1.506 of Chapter 11 of Title I of the Code of
the City of Grand Rapids be amended to read as follows:
“Sec. 1.506. Purchases on Competitive Bidding.
For any purchases involving an expenditure of more than ten thousand
dollars ($10,000.00), requests for bids shall be advertised, which requests shall
establish the time and place for opening any bids received. The time for
opening of bids shall be not less than ten (10) days from the date of said
publication. This requirement may be expedited in cases of immediate need of
the materials or services. Two (2) or more publications may be authorized
where such has been the general practice of the City. In such cases where
publication is not necessary because letters may be sent to all who are known
able to bid, the Purchasing Agent may waive publication and send such
letters.”
Section 4. That Section 1.507 of Chapter 11 of Title I of the Code of
the City of Grand Rapids be amended to read as follows:
“Sec. 1.507. Advertisement for Bids.
The advertisement for bids shall be prepared by the Purchasing Agent
and published. Every such advertisement shall specify the place where the bids
will be received, the time of opening of same and a brief description of the
materials and supplies to be purchased.”

3. That the Comptroller is authorized and directed to issue a check to Plaintiff
Keyon Harrison in the amount of Thirty Thousand Dollars ($30,000.00); and
4. That the Comptroller is authorized and directed to issue a check to Plaintiff
Denishio Johnson in the amount of Thirty Thousand Dollars ($30,000.00);
and
5. That the Comptroller is authorized and directed to issue a check to the ACLU
Fund of Michigan in the amount of Two Hundred and Seventy Thousand
Dollars ($270,000.00).

Improvement District Board
2. Resolution approving the appointment of Rosalynn Bliss, Joe Jones, Erika Gonzalez and
Molly Clarin to the initial Seeding Justice GR Nonprofit Board.
B. FISCAL COMMITTEE The Committee considers and makes recommendations on matters
referring to bids, claims, and other financial matters of the City .
1. Resolution approving a professional services agreement with Grattan Raceway Park, Inc.
for the amount not-to-exceed $40,000
2. Resolution accepting the continuation of a grant award from the Office of Highway Safety
Planning (OHSP) in the amount of $36,504
3. 89 Monroe Center Sublease Renewal with the Grand Rapids African American Museum
and Archives at a lease rate of $2,132.17 a month
4. Resolution authorizing payment of $51,407.30 to the Water Research Foundation for the
Water System and Environmental Services Annual Membership Fee
5. Resolution approving an Amendment to the Services Agreement with the Grand Rapids
Area Chamber of Commerce and City of Grand Rapids Downtown Development
Authority for the Grand Rapids Retail Retention and Recruitment Initiative in the amount
of $11,833 for the City's share of performance payments, for a total contract amount not
to exceed $143,332.81
6. Resolution authorizing the City Treasurer’s office to work with The Rapid and Mesmerize
to promote GR PayIt on Rapid buses. The project cost is “not to exceed” $30,000 and
will be funded by the FY 23 Treasurer’s office budget.
7. Resolution authorizing an increase to the contract with PayIt, LLC to add Point-of-Sale
(POS) and Interactive Voice Response (IVR) payment channels for an amount not to
exceed $200,000, which brings the total contract award to $1.4M annually.
8. Resolution authorizing an agreement with Urban League of West Michigan in
collaboration with the Grand Rapids African American Task Force and the Michigan
Black Expo for an amount not to exceed $50,000

would be a motion to change the agenda.
Table, Lay on the This motion puts aside an item, and everything adhering to it, currently being
