MINUTES PROTECTION & WELFARE COMMITTEE Monday, January 8, 2018 City Hall, Room 207 5:00 p.m. MEMBERS PRESENT: Chairperson Randy Scannell, Vice Chairperson Barbara Dorff, Ald. Bill Galvin, Ald. Guy Zima MEMBERS EXCUSED: None MEMBERS ABSENT: None OTHERS PRESENT: Deputy City Atty. Joanne Bungert, Captain Todd LePine, Ald. David Nennig, and other interested parties. 1. Roll Call. All members were present. Chairperson Scannell called the meeting to order at 5 p.m. 2. Approval of the Agenda. A motion was made by Ald. Dorff and seconded by Ald. Galvin to amend agenda and move item 5 before item 4. There were no objections and motion carried. A motion made by Ald. Zima and seconded by Ald. Dorff to approve agenda as amended. There were no objections and motion carried. 3. Approval of the minutes from the December 11, 2017 meeting. A motion was made by Ald. Dorff and seconded by Ald. Galvin to approve the minutes. There were no objections and motion carried. 4. Request by the owners of St. Brendan’s Inn, 234 S. Washington Street, to hold outdoor events on March 9 to 11 and March 17 and 18, 2018. The Police and Law departments had no objections. A motion was made by Ald. Galvin and seconded by Ald. Dorff to approve request by owners of St. Brendans’s Inn, 234 S. Washington Street, to hold outdoor events on March 9 to 11 and March 17 and 18, 2018. There were no objections and motion carried. 5. Request by Chief Smith, to refer to the Protection and Welfare Committee the communication to conduct prehearings pursuant to Green Bay Municipal Code 33.07(4) for the alleged liquor law violations by the following: A. GCS East, 1593 E. Mason Street, Daniel Pamperin, Agent Deputy City Atty. Bungert stated this item was held over from last month’s meeting as licensee was not present at that time. A second notice was issued to the accused licensee. Deputy City Atty. Bungert explained that tonight’s hearing is informal. The police department will present the allegations and the licensee will have an opportunity to respond. The committee can then make a determination whether to issue a letter of warning, take no action, or recommend that a full hearing be held. Captain LePine stated there were two violations at this establishment. The police did random compliance checks on March 30, 2017 and November 7, 2017. In both incidents alcohol was sold to an underage person. There were different clerks in each occurrence and ID was not checked in each occurrence. Motion made by Ald. Dorff and seconded by Ald. Galvin to open the floor for discussion. Motion carried. Jacob Anderson was present to speak on behalf of Grand Central Station. Mr. Pamperin was unable to attend the meeting. Mr. Anderson said he was unaware of the March 30 th incident but is aware of the November 7th incident. He stated they have a zero tolerance policy. The clerk failed to check the individual’s ID and the clerk was terminated the same day. The cash registers require that a birth date be entered. They are looking at investing in scanners to check the IDs. They have hired a full time training manager to enforce the company’s policies. Motion made by Ald. Galvin and seconded Ald. Dorff to close the floor. Motion carried Ald. Dorff stated she feels they are doing everything possible to avoid selling alcohol to underage and unfortunately a mistake was made that cost someone their job. Ald. Scannell feels that GSC is on top of the issue with the training they do and with the consequences they have in place. He is fine with report and to receive and place on file. A motion was made by Ald. Dorff and seconded by Ald. Galvin to take no action. Ald. Zima stated there are two violations in a year. In previous cases a letter of warning was sent. He feels GSC should be sent a letter of warning. It puts it on their record but does not prevent GSC from operating. A motion was made by Ald. Zima amend motion to issue a letter of warning to GCS. Ald. Scannell stated that the incident would still be on their record. Ald. Galvin stated Ald. Zima makes a good point that the other cases all had two violations too. But the other cases didn’t have some of the same policies in place as GCS such as the training and the training manager. They also have a zero tolerance policy. Ald. Galvin is willing to take no action at this time based on the policies in place. If GCS were to get another violation he would consider issuing a letter at that time. Ald. Dorff believes GCS has gone above and beyond taking steps to prevent these violations from happening. At this point she does not feel a letter is necessary. Motion made by Ald. Dorff and seconded by Ald. Galvin to open the floor for discussion. Motion carried. Jacob Anderson from GCS stated he thought that the November 7th incident was the first violation and the March 30th incident was a different location. Committee members reviewed documents provided by the police department and determined both violations occurred at the same store location. Motion made by Ald. Dorff and seconded Ald. Galvin to close the floor. Motion carried A motion by Ald. Zima to issue letter of warning failed. No second. A vote was then taken on the motion to take no action. There were no objections and motion carried. Motion made by Ald. Zima seconded by Ald. Dorff to adjourn. Meeting adjourned at 5:20pm.
