AUDITOR RECOMMENDED AMENDMENT
The legislation amends the Ordinance Code to provide for the option to publish certain required
notices by electronic methods permitted by law. We recommend that should a department of the
City decide to transition from newspaper advertising to electronic advertising (or vice versa) for
noticing, filing notice and a copy of the cost comparison required by Florida Statute 50.0311(3)
with City Council 30 days prior to the transition shall be required.
• Per section 50.0311(3), Florida Statutes, a governmental agency may use the publicly accessible
website of the county in which it lies to publish legally required advertisements and public notices
if the cost of publishing advertisements and public notices on such website is less than the cost of
publishing advertisements and public notices in a newspaper.
• Per section 50.0311(6), Florida Statutes, a governmental agency that uses a publicly accessible
website to publish legally required advertisements and public notices shall provide notice at least
once per year in a newspaper of general circulation or another publication that is mailed or
delivered to all residents and property owners throughout the government’s jurisdiction,
indicating that property owners and residents may receive legally required advertisements and
public notices from the governmental agency by first-class mail or e-mail upon registering their
name and address or e-mail address with the governmental agency.
• The governmental agency shall maintain a registry of names, addresses, and e-mail addresses of
property owners and residents who have requested in writing that they receive legally required
advertisements and public notices from the governmental agency by first-class mail or e-mail.
• Amends the Ordinance Code to allow any public notice or advertisement required under the
following Sections to be published by electronic methods permitted by law:

CONCERN

RULES AMENDMENT
1. Clarify posting and advertising a position is a precondition to the appointment of any person
not presently working for the City to a position appointed by a Board or Commission
2. Revise Code Sec. 129.112 (Council Related Salaries) to strike language regarding retroactive
pay increases and bonuses to be consistent with Florida Statutes and the language that is being
struck in Sec. 129.101 (Pay Grades, Salary Ranges, and Salaries) for Mayoral and Sheriff
appointed positions
3. Repeal Code Sec. 102.117 (Departmental residency audit) which is no longer applicable since
appointed employees confirmed by Council are not required to be Duval County residents (the
residency requirement was removed in 2014 and replaced with a preference for employment and
retention of persons residing within Duval County) and include copy of repealed code section as a
new exhibit
4. Remove repeal of Code Sec. 116.910 (Residence within City preferred)
5. Correct scrivener’s errors
• Amends the Ordinance Code to make the following changes:
- Clarifies functions of the Talent Management Division
- Changes the name of the Compensation and Benefits Division to the Benefits Division and
clarify functions of that division
- Strikes references to the $300 maximum for service raises as this item is collectively bargained
- Clarifies that positions that require appointment by a Board or Commission may be filled by
current City employees without the need to post or advertise the position
- Repeals Sec. 116.910 (Residence within the City Preferred) which provides for a preference in
employment and retention for Duval County residents
- Creates a new Sec. 116.910 regarding criminal history records checks for prospective and
current City employees
- Strikes the salary ranges by pay grade table and references that the information is available on
the City’s internal website
- Strikes the 3% limit on annual increases to salary ranges authorized by the Director of the
Employee Services Department
- Strikes language allowing the Mayor and Sheriff to authorize salary adjustments retroactive to
a date within the current fiscal year

AUDITOR COMMENTS/CONCERNS
1. There are no specifically stated penalties in the Redevelopment Agreement, besides general
default, to address a failure by DCFA to meet the development improvements, performance
schedule, or expected capital investment.
2. Per the Public Works Department, additional funding beyond what has been appropriated in
the CIP may be needed to complete the project since the budget estimate is several years old.
3. DCFA does not have to demonstrate the financial ability to construct the facility prior to
beginning construction.
4. The City could have invested millions of dollars into the facility and DCFA could abandon the
project during construction. The City’s only recourse is to sue for specific performance.
AUDITOR RECOMMENDED AMENDMENTS
1. We recommend that DCFA be required to demonstrate their financial capacity to construct the
DCFA Improvements within 60 days of the effective date of the RDA.
2. We recommend that DCFA be required to provide an irrevocable letter of credit in an amount
acceptable to the City for the demolition of the DCFA Improvements in the event the DCFA
Improvements are not completed.
• Authorizes a Redevelopment Agreement between the City and the Duval County Fair
Association (DCFA) for development of approximately 82.37 acres of City-owned property located
adjacent to and east of the Equestrian Center (DCFA Parcel) into the new site of the Greater
Jacksonville Agricultural Fair and DCFA corporate offices
• DCFA will construct a minimum 80,000 sq. ft. exposition hall, expo hall for exhibitors,
maintenance area, office space for fair administration, lobby, concession, and restroom facilities
for visitors, meeting and conference spaces, outdoor stage serving the amphitheater, support
spaces for the amphitheater, covered receiving dock and loading area for the amphitheater,
covered outdoor space at entrance of expo hall lobby, and all walkways, sidewalks, and concrete
surfaces within ten feet of buildings
• The City will, at no cost to DCFA, perform site clearing of the DCFA Parcel and rough grading
for buildings, and construct stormwater and utility infrastructure, extension of Finger Lakes
Street, all shared-use parking areas, fairgrounds midway areas (pedestrian paths, lighting, utility
hookups), amphitheater seating area, sidewalks and landscaping on the DCFA Parcel, up to 32
RV sites, and boundary fencing around the Fairgrounds Maintenance Parcel
• The City and DCFA must substantially complete the project by June 1, 2025
• Authorizes a Ground Lease with DCFA for a term of 40 years with three 10-year extension
options for $100/year with an option to lease an additional 60 acres adjacent to the DCFA Parcel
