AUDITOR COMMENTS
• As filed, this legislation authorizes an extension of the completion date from 6/30/23 to 9/30/23.
Since that date has passed, Council action will be required to authorize a new extension date.
• The DIA approved Resolution 2023-11-03 on 11/15/23 recommending that City Council amend
the performance schedule to:
1) establish a Recommencement of Construction date which shall be 90 days following the
effective date of the legislation, requiring evidence that a new general contractor has been engaged
to complete the project and has begun on-site work on the project and
2) extend the Completion of Construction date from 6/30/23 to one year following the
Recommencement of Construction date.
• As of 11/16/23, the Developer and Developer’s related entities have liens totaling $1,842,720.23
on their various parcels for the Ambassador Hotel, Independent Life, and 404 Julia Street/Central
National Bank projects.
• The Developer has not met the performance schedules in the original Council approved
redevelopment agreements for the Independent Life and 404 Julia Street/Central National Bank
projects.

• If FCNMHP sells, leases, or otherwise transfers the project or project parcel during the term of
the loan, the loan shall be due and payable at the closing of the sale
• If FCNMHP does not retain the retained jobs, and/or does not create and maintain a minimum
of 6 permanent jobs at an average wage of no less than $42,000 as of the new job creation
deadline, and maintain the retained jobs and permanent jobs from the new job creation deadline
for the remaining duration of the loan term, FCNMHP shall pay the City the entire remaining
principal balance of the loan (less any amounts forgiven), which will be amortized over a ten-year
period with 3% interest accruing annually, with payments due monthly
OED has not prepared an ROI calculation for this project.
Waives the NWJEDF Guidelines to authorize City funding in excess of 25% of the total project
costs.
