CALL TO ORDER ROLL CALL Present John Dillon, John Kella, Jason Cox, Jeff Crompton, Brigette Roehr, Marc Rousonelos, Jason Heath and Dominic Orlando Absent Roberto Perez APPROVAL OF MINUTES TMP-6280 Attachments: 072023 A motion was made by John Kella, seconded by Dominic Orlando, to approve the Plan Commission Minutes from July 20, 2023. The motion carried by the following vote: Aye: Dillon, Kella, Cox, Roehr, Rousonelos, Heath and Orlando Absent: Perez Abstain: Crompton CITIZENS TO BE HEARD ON AGENDA ITEMS This section is for anyone wanting to speak regarding agenda items and are allowed a maximum of 4 minutes. Mr. Joe Salmieri, Superintendent of Laraway School District, spoke in opposition to the petition for the Resubdivision of Lot 3 in Laraway Distribution Center Subdivision because of the allowance of truck traffic on the Rowell access point to the distribution center. Mr. Tom Osterberger, Attorney, 111 N. Ottawa Street, gave more information about the proposed project. Mr. Jay Gregory, resident adjacent to Rowell Avenue, appeared in opposition to the petition because of truck traffic. P-7-23: PRELIMINARY PLAT OF RESUBDIVISION OF LOT 3 IN LARAWAY DISTRIBUTION CENTER SUBDIVISION. FP-8-23: FINAL PLAT OF RESUBDIVISION OF LOT 3 IN LARAWAY DISTRIBUTION CENTER SUBDIVISION. TMP-6278 Attachments: P-7-23 FP-8-23 Staff Report Packet Mr. Torri gave the Planning Staff Report. Mr. Tom Osterberger, Attorney, appeared on behalf of the petition. Mr. Jason Cebulski, Jacob & Hefner Associates, civil engineer on the project. Mr. Cebulski gave further detail about the project. Mr. Luay Aboona, traffic engineer with KLOA, spoke about the traffic study that they performed. Mr. Dan Uebelhor, Cabot Properties, Inc., stated they are not changing anything along Rowell or Laraway for the subdivision. Chairman Dillon asked if there is paperwork from the City that states that no trucks are allowed on Rowell Avenue. Mr. Regis, Deputy Corporation Counsel, responded he has not seen anything and talked about the original annexation agreement. There was discussion regarding the current signage on Rowell. Commissioner Orlando had several questions that Mr. Uebelhor responded to. Mr. Joe Salmieri, Superintendent of Laraway Schools, appeared in opposition to the petition. He has no problem with them developing the parcel. They request they abandon the entrance and exit along Rowell Avenue to protect the children at school, employees and residents. Mr. Saul Brass, Vice-President of Laraway School Board, spoke about the history of the school where they were previously located and spoke in opposition to the petition. Mr. Regis reviewed documents that Mr. Gregory had with him pertaining to the past agreement. Page 2 of 4 Plan Commission Meeting Minutes - Final August 17, 2023 Mr. Sean Mikos, Deputy Director of Public Works, spoke about the traffic study. Mr. Regis said the original annexation agreement from 2004 says there will be truck access onto Rowell Avenue. There is a council memo from 2006 that deals with the annexation of the parcel and not the agreement and it states the subdivision will not have any access from Rowell Avenue. That is where the confusion is coming from. However, the annexation agreement is a binding recorded agreement and is still in effect until next year. Councilwoman Suzanna Ibarra, District 5, said she has received a lot of phone calls regarding the project. She said the subdivision will create more traffic and the City will not be able to enforce that. She would like to see an agreement reached to keep the children at Laraway School safe. Mr. Jay Gregory spoke again about the confusing documents from 2004 and 2006 pertaining to Rowell Avenue truck access. Commissioner Cox inquired about the access road by the ponds. Mr. Osterberger responded. A motion was made by Jason Cox, seconded by Marc Rousonelos, to recommend for approval by the City Council the Preliminary Plat of Resubdivision of Lot 3 in Laraway Distribution Center Subdivision and the Final Plat of Resubdivision of Lot 3 in Laraway Distribution Center Subdivision. The motion carried by the following vote: Aye: Dillon, Kella, Cox, Crompton, Rousonelos and Heath Nay: Roehr and Orlando Absent: Perez NEW BUSINESS None.
