CALL TO ORDER ROLL CALL Present Jason Cox, Jeff Crompton, Roberto Perez, Brigette Roehr, Marc Rousonelos, Dominic Orlando and John Dillon Absent John Kella and Jason Heath ALSO PRESENT: Planning Director James Torri, Interim Corporation Counsel Chris Regis, Deputy Director of Public Works Sean Mikos, and Planner Helen Miller Commissioner Rousonelos left at approximately 4:30 P.M. APPROVAL OF MINUTES Plan Commission Meeting Minutes-04/18/24 TMP-7330 Attachments: Plan Commission Meeting Minutes 4-18-24.pdf A motion was made by Dominic Orlando, seconded by Brigette Roehr, to approve Plan Commission Meeting Minutes-04/18/24. The motion carried by the following vote: Aye: Cox, Crompton, Perez, Roehr, Rousonelos, Orlando and Dillon Absent: Kella and Heath CITIZENS TO BE HEARD ON AGENDA ITEMS None OLD BUSINESS: PUBLIC HEARING None OLD BUSINESS None NEW BUSINESS: PUBLIC HEARING A-2-24: Annexation of 19535 NE Frontage Road, TMP-7292 Classification to R-5 (Multi-Family Residential) Zoning and Approval of an Annexation Agreement. PUD-3-24: Preliminary Planned Unit Development of The Preserve Townhomes. PUD-4-24: Final Planned Unit Development of The Preserve Townhomes. Attorney Mr. Nathaniel Washburn of KGG, LLC appeared on behalf of the petition. Commissioner Orlando asked a few questions. Mr. Washburn and Mr. Torri responded. Attorney Ms. Jodi Henniger of Clingen, Callow & McLean, LLC appeared on behalf of Prairie Ready Mix in opposition to the petition. Senior Manager for Lands & Environment at Votorantim Cimentos North America Mr. Mitch Mariotti appeared in opposition to the petition. There was a lengthy discussion in which Commissioner Roehr, Commissioner Perez, and Chairman Dillon asked questions. Ms. Henniger, Mr. Torri, and Interim Corporation Counsel Chris Regis responded. Ms. Margaret Harris Lawler, area resident, appeared in opposition to the petition. Mr. Robert Larson, area resident, appeared in opposition to the petition. Mr. Russ Erickson, area resident, raised concerns about the petition. There was a brief discussion regarding whether the units would be owner occupied or rented. Mr. Washburn responded to comments. Owner Bill Caton appeared in favor of the petition. A motion was made by Commissioner Orlando to deny A-2-24, PUD-3-24, and PUD-4-24. The motion failed for lack of second. A motion was made by Commissioner Cox to approve A-2-24, PUD-3-24, and PUD-4-24. The motion failed for lack of second. Commissioner Roehr seconded the motion to deny. There was a brief discussion regarding the motion procedure, in which Mr. Torri asked Mr. Regis if the motion to deny was done appropriately. Mr. Regis stated no it wasn't and there needed to be a first motion and a second motion. The motion carried by the following vote: Aye: Crompton, Perez, Roehr, Orlando and Dillon Nay: Cox Absent: Kella, Rousonelos and Heath ZO-2-24: Zoning Ordinance Amendments Related to Solar TMP-7319 Energy Systems Attachments: ZO-2-24 Solar Facilities Staff Report Zoning Ordinance Amendments Solar Energy Systems Mr. Torri read the staff report into the record. Mr. Torri and Deputy Director of Public Works Sean Mikos answered Commission’s questions. A motion was made by Brigette Roehr, seconded by Dominic Orlando, to approve ZO-2-24: Zoning Ordinance Amendments Related to Solar Energy Systems. The motion carried by the following vote: Aye: Cox, Crompton, Perez, Roehr, Orlando and Dillon Absent: Kella, Rousonelos and Heath NEW BUSINESS None NEW OR OLD BUSINESS, NOT FOR FINAL ACTION OR RECOMMENDATION None PUBLIC COMMENT None ADJOURNMENT A motion was made by Jason Cox, seconded by Dominic Orlando, to approve adjournment.
