150 West Jefferson Street City of Joliet Joliet, IL 60432 Zoning Board of Appeals Meeting Minutes Board Members Ed Hennessy Vincent Alessio Charles McCauley Bob Nachtrieb Jim Riggs Colette Safford Brigette Roehr Thursday, January 21, 2021 2:00 PM City Hall, Council Chambers The Governor’s Office and the Illinois Department of Public Health activated a Tier 3 mitigation plan for all regions of the State of Illinois, effective Friday, November 20, 2020. In an effort to support these mitigation measures, the City of Joliet is limiting in person attendance in the council chambers to 10 people. During meetings, groups of 10 people will be staged in various locations within city hall. These groups will wait in areas with a live feed to the meeting until the Citizens to Be Heard on Agenda items section, the Public Hearing has commenced or the Public Comments section of the meeting has commenced. Speakers will be rotated into Council Chambers to allow everyone an opportunity to speak. Pursuant to the Illinois Department of Commerce & Economic Opportunity’s Guidelines, it is recommended that any individual appearing in-person wear a face-covering to cover their nose and mouth. Citizens who are unable to attend the meeting can email comments in advance of the meeting to publiccomment@joliet.gov OR register “To Be Called To Speak”. The motion carried by the following vote: Aye: Hennessy, Alessio, Nachtrieb, Safford and Roehr Absent: McCauley and Riggs December 17, 2020 Zoning Board of Appeals Minutes TMP-0807 Attachments: 12172020 Draft A motion was made by Bob Nachtrieb, seconded by Brigette Roehr, to approve the December 17, 2020 Zoning Board of Appeals Minutes. Petition 2021-01: A Variation of Use (No. 7912) to expand the TMP-0815 previously permitted use (automobile service garage) to include light truck/ tractor cab tire repair, a B-3 (General Page 2 of 7 Zoning Board of Appeals Meeting Minutes January 21, 2021 Business) use, in an R-2 (Single Family Residential) zoning district, located at 1101 N. Broadway Street. Petition 2021-02: A Special Use Permit for a light truck/ tractor cab tire repair and maintenance, located at 1101 N. Broadway Street. Attachments: ZBA 2021-01 02_1101 N. Broadway_staff report packet Ms. Jayne Bernhard read the staff report into the record. Chairman Hennessy swore in Mr. Joe Mazzone, 3033 W. Jefferson St., Suite 208, Joliet, IL. Mr. Mazzone appeared on behalf of the petition. Mr. Mazzone explained that there will not be any mechanical work at this location, only tire repair and replacement. Mr. Mazzone talked about how tires will be disposed of. Mr. Mazzone explained the petitioner has done everything required of him by the City of Joliet Staff . Mr. Nachtrieb spoke about his concerns for traffic in the area due to the high volume of traffic on Broadway Street. Mr. Nachtrieb was also concerned about noise issues with the large trucks in the immediate area. Mr. Mazzone talked about the businesses nearby that also have trucks and trailers. Mr. Mazzone stated the business owner spoke with nearby neighbors and addressed their concerns. Mr. Mazzone explained there is alot of noise already with traffic on Broadway Street. Chairman Hennessy swore in Ms. Rita Zorba, 1119 N. Broadway St., Joliet, IL. Ms. Zorba called in in opposition to this petition. Ms. Zorba stated there is enough noise, traffic and accidents on Broadway Street. Ms. Zorba explained the traffic will be horrific going in and out of a business at 1101 N. Broadway Street. Ms. Zorba also stated there is a lot of on street parking on the residential street near this proposed business. Mr. Mazzone noted they will only service tractors only, they will not have trailers attached. Chairman Hennessy swore in Abraham Garcia, 545 Canyon Drive, Romeoville, IL. Mr. Garcia is the petitioner for this petition. Mr. Garcia explained his business will not add to the noise because Illinois Route 53 is a truck route. Mr. Garcia also said that he has purchased equipment and upgrades to make sure his business won't add much additional noise. Mr. Garcia soundproofed the compressor room to prevent outside noise. Mr. Garcia said he will only service newer trucks from fleets in the area. Mr. Garcia stated it wil be a good business for Joliet with additional tax dollars. Mr. Gracia also stated he has more than enough room to allow the semis on his propoerty without using Hutchins Street. Chairman Hennessy stated that this ordinance states there must be a hardship, Chairman Hennessy does not feel this particular case is based on hardship, it is to enhance the current business. Mr. Mazzone responded to Chairman Hennessy's statement. A motion was made by Brigette Roehr, seconded by Vincent Alessio, to deny Petition 2021-01: A Variation of Use (No. 7912) to expand the previously permitted use (automobile service garage) to include light truck/ tractor cab tire repair, a B-3 (General Business) use, in an R-2 (Single Family Residential) zoning district, located at 1101 N. Broadway Street. Petition 2021-02: A Special Use Permit for a light truck/ tractor cab tire repair and maintenance, located at 1101 N. Broadway Street. The motion carried by the following vote: Aye: Hennessy, Alessio, Nachtrieb, Safford and Roehr Absent: McCauley and Riggs PETITION 2021-03: A Variation of Use to allow an Airbnb, a TMP-0812 B-2 (central business) district use in a B-1 (neighborhood business) district, located at 914 Plainfield Road Attachments: 2021-03 - 914 Plainfield Road - Combined Copy Ms. Jayne Bernhard received a request to table this position from a City Council Member. City Council and Staff would like more time to further discuss and review the ordinances for short-term rental properties in the City of Joliet. A motion was made by Bob Nachtrieb, seconded by Brigette Roehr, to table PETITION 2021-03: A Variation of Use to allow an Airbnb, a B-2 (central business) district use in a B-1 (neighborhood business) district, located at 914 Plainfield Road. The motion carried by the following vote: Aye: Hennessy, Alessio, Nachtrieb, Safford and Roehr Absent: McCauley and Riggs PETITION 2021-04: A Special Use Permit for a tank truck and TMP-0813 tank trailer repair facility with ancillary tank trailer and equipment sales. Attachments: ZBA 2021-04 (SW Route 6 and Patricia Lane)_ Staff Report Packet Ms. Jayne Bernhard read the staff report into the record. Chairman Hennessy swore in Mr. Nate Washburn, 111 N. Ottawa Street, Joliet, IL. Mr. Washburn appeared on behalf of the petition. Mr. Washburn explained they area currently relocating an existing business from Rockdale, IL to allow more space. Chairman Hennessy swore in Mr. Brian Edminson, Mt. Vernon, IL. Mr. Edminson is an Architect for the petitioner. Mr. Edminson went over some of the details of the project and why they want to move to Joliet. Page 4 of 7 Zoning Board of Appeals Meeting Minutes January 21, 2021 Chairman Hennessy wore in Thomas Carroll, 1207 Cedarwood Drive, Crest Hill. Mr. Carroll went over the IDOT permit the current owner received regarding traffic. Mr. Nachtrieb asked is the road would be widened. Mr. Carroll said there are no current plans. Chairman Hennessy swore in Mayor Missey Moorman-Schumacher, 24555 S. Navajo Drive, Channahon. Mayor Moorman-Schumacher called in support of the design and layout of the project. Mayor Moorman-Schumacher explained her concerns about traffic on Route 6. Mayor Moorman-Schumacher wanted to know the date of the IDOT report and if a copy could be submitted to her office . Mayor Moorman-Schumacher stated that in 2006 IDOT released a report stating Route 6 needed to be four lanes. Mayor Moorman-Schumacher was concerned about the extra cars on the road before business hours. Mayor Moorman-Schumacher would like to know what Joliet plans on doing to accommodate extra traffic. Mr. Carroll stated they traffic study was completed some time between fall of 2019 and spring of 2020. The study was given the petitioner in February of 2020. Mr. Carroll explained the new entrance was approved and installed in spring of 2020, before the current owner marketed the property. Chairman Hennessy asked if the study was submitted to the City of Joliet, Mr. Carroll was unsure. Ms. Bernhard stated city staff did receive and signed-off on an acknowledgement that it did get reviewed by IDOT. Mr. Washburn stated that the approval was given to the current property owner and PSC Custom, LLC, does not have a copy or the right to give a copy out. Mr. Washburn stated he will make a request to have a copy given to the City of Joliet and the Village of Channahon. Chairman Hennessy swore in Mr. Thomas Durkin, 24555 Navajo Drive, Channahon, IL. Mr. Durkin asked questions about the traffic study. Mr. Carroll stated the petitioner will work with the current owner to get authorization to receive & release the report. Mr. Durkin asked why the current owner didn't wait for a potential buyer to apply for the IDOT permit. Mr. Carroll explained that the current owner wanted to make the property marketable. Mr. Durkin explained his concern with the City of Joliet Administration not requesting the IDOT information to find out if any additional work was necessary. Mr. Washburn gave a summary of the project on behalf of the petitioner. Mr. Washburn believes this facility would not cause a burden on local roads and traffic. Mr. Washburn asked the board to follow the staff recommendation and approve this project. Chairman Hennessy asked if any one else would like to speak on behalf of this petition. No one came forward. Chairman Hennessy swore in Mr. John O'Lear, 128 E. Seventh Street, Lockport, IL. Mr. O'Lear is the petitioner for the petition tabled earlier in the meeting at 914 Plainfield Road, Petition 2021-03. Mr. O'lear stated he was invited to attend the meeting only for the petition to be tabled, he just wanted clarification on why the petition was tabled before discussion . Ms. Bernhard explained that she received the request to table the petition ten minutes before the meeting, this petition will be heard at the April 15th, 2021 Zoning Board of Appeals meeting. Ms. Bernhard explained that staff needed additional time to review the ordinances currently in place. Mr. O'Lear asked if there is anything he can do to expedite the process because it is costing him more money. Ms. Bernhard explained the deadline has already came and gone for the February meeting. Ms. Bernhard explained the ordinance update must go through approval before it can be enforced. Ms. Roehr asked if there is a solution while the ordinance is worked on. Chairman Hennessy said the ordinance must be passed first. Ms. Bernhard was not sure if it would be Municipal Code or Zoning Ordinance approval. Mr. O'Lear explained the background and why he applied for the Variation of Use. Ms. Roehr explained that no policy is on the books, so it is fair to delay the petition. Ms. Bernhard let Mr. O'Lear know staff will be in touch. ADJOURNMENT A motion was made by Brigette Roehr, seconded by Vincent Alessio, to adjourn the meeting.
