150 West Jefferson Street City of Joliet Joliet, IL 60432 Zoning Board of Appeals Meeting Minutes Board Members Ed Hennessy Vincent Alessio Charles McCauley Bob Nachtrieb Jim Riggs Colette Safford Brigette Roehr Thursday, March 18, 2021 2:00 PM City Hall, Council Chambers Pursuant to Phase 4 of the Restore Illinois Plan, the Illinois Department of Commerce & Economic Opportunity's Guidelines recommend best practices that limit an in-person meeting to 50 people or less (Council Chambers allows for 18 members of the public) while adhering to social distancing guidelines. During meetings, any member of the public physically present in the Council Chambers in excess of the limit will be asked to wait in another room with live feed to the meeting until the Citizens To Be Heard on Agenda Items section or Public Comments section of the meeting has commenced. Speakers will be rotated into Council Chambers to allow everyone an opportunity to speak. Pursuant to the Illinois Department of Commerce & Economic Opportunity’s Guidelines, it is recommended that any individual appearing in-person wear a face-covering to cover their nose and mouth. Citizens who are unable to attend the meeting can email comments in advance of the meeting to publiccomment@joliet.gov. The motion carried by the following vote: Aye: Hennessy, Alessio, McCauley, Nachtrieb, Riggs and Safford Absent: Roehr CITIZENS TO BE HEARD ON AGENDA ITEMS NOTE: There is a new temporary procedure for public speaking. Details can be found on the Joliet.gov “Public Comments” web page. This section is for anyone wanting to speak regarding items listed on the agenda . Anyone speaking on an agenda item is entitled to speak for a maximum of 4 minutes. It is not a question and answer period and staff and the Zoning Board of Appeals do not generally respond to public comments. Please note speakers who engage in conduct injurious to the harmony of the Zoning Board of Appeals shall be called to order by the Presiding Officer and may forfeit the opportunity to speak. OLD BUSINESS: PUBLIC HEARING During the Public Hearing, members of the public will be allowed to present evidence and ask questions subject to the rules of the meeting. PETITION 2021-06: A Special Use Permit to allow a tire sales TMP-1129 and tire service facility, located at 1665 Terry Drive. Attachments: PETITION 2021-06 1665 Terry Drive - Combined staff report Mr. Jim Torri read the staff report into the record. Chairman Hennessy swore in Jonathan Jager, 1665 Terry Drive, Joliet, Mr. Jager appeared in support of the petition. Chairman Hennessy asked if any one else would like to speak on this petition. No one came forward. A motion was made by Vincent Alessio, seconded by Bob Nachtrieb, to approve: PETITION 2021-06: A Special Use Permit to allow a tire sales and tire service facility, located at 1665 Terry Drive with the following conditions: 1. That a Business License be applied for and approved prior to opening; Page 2 of 8 Zoning Board of Appeals Meeting Minutes March 18, 2021 2. That the Special Use granted shall herein terminate and lapse unless a building permit or certificate of occupancy is obtained not later than 365 days of the effective date of this ordinance and the erection or alteration of a building is started or the use is commenced within such period. The Board may grant an extension of this period, valid for no more than one hundred and eighty (180) additional days, upon written application and good cause shown without notice or hearing. Whether or not there is an intention to abandon the special use, if any special use is discontinued for a continuous period of one year, or if an intent to abandon the special use is evident in a shorter period of time, the special use for such use shall become void, and such use shall not thereafter be reestablished unless a new Special Use is obtained; and, 3. Should the property be declared a public nuisance, it shall be subject to a rehearing and a possible revocation of the Special Use Permit. The motion carried by the following vote: Aye: Hennessy, Alessio, McCauley, Nachtrieb, Riggs and Safford Absent: Roehr PETITION 2021-07: A Variation to increase the maximum TMP-1132 allowable wall height for a garage from 10 ft. to 12 ft., located at 2113 Glenwood Avenue Attachments: ZBA 2020-07 (2113 Glenwood) Staff Report Packet Mr. Jim Torri read the staff report into the record. Chairman Hennessy swore in the homeowner, Jose Ulloa, 2113 Glenwood Avenue, Joliet, IL. Mr. Ulloa appeared in support of the petition. Chairman Hennessy asked why Mr. Ulloa needs the extra two feet of wall height, Mr. Ulloa explained that he plans to add a car lift and store two cars stacked since he does to have the yard space to make the garage wider. There is a 20 ft. public utility and drainage easement along the rear property line that includes a sewer line. Mr. McCauley asked if the garage will be taller than the house, Mr. Ulloa said you may be able to see the roof. Mr. McCauley said the driveway seems really thin, Mr. Ulloa said it is what he has to work with. Mr. McCauley asked if the neighbors put up a fence would it be more difficult to get down the driveway, Mr. Ulloa replied that neighbors already have fences on both sides. Mr. Ulloa will not be driving large vehicles or his everyday cars on the new driveway. Chairman Hennessy asked if any one else would like to speak on behalf of this petition. Mr. McCauley asked why the foundation was already installed. The garage & driveway were previously approved by the Planning and Inspections Departments. There a permit issued, Mr. Ulloa just wanted to add to the wall height which warranted a Variation. A motion was made by Jim Riggs, seconded by Vincent Alessio, to approve: Page 3 of 8 Zoning Board of Appeals Meeting Minutes March 18, 2021 PETITION 2021-07: A Variation to increase the maximum allowable wall height for a garage from 10 ft. to 12 ft., located at 2113 Glenwood Avenue. The motion carried by the following vote: Aye: Hennessy, Alessio, Nachtrieb, Riggs and Safford Nay: McCauley Absent: Roehr PETITION 2021-08: An Amendment to Variation of Use (Ord. TMP-1133 10400) to allow the addition of a third housing unit within an existing two-family residential building, located at 1302 West Acres. ***WITHDRAWN BY PETITIONER*** Attachments: 2021-08 (1302 West Acres) Staff Report Packet This petition was withdrawn by the Petitioner before the Zoning Board of Appeals meeting. PETITION 2021-09: A Variation to reduce the front yard TMP-1130 setback from 30 ft. to 26 ft. for a front porch, located at 6616 O’Connor Drive. Chairman Hennessy swore Ms. Megan Elberts, 1137 Kenilworth Circle, Naperville, IL & Ms. Christy Davidson, Glen Ellyn of Gasperec Elberts Consulting who appeared in support of this petition. Chairman Hennessy asked how these house plans got approved without the correct setback. Mr. Torri replied the approved plans were for uncovered porches. Mr. Alessio asked if the variance process would need to happen each time one of the homes in this development finds out they don't have the correct setback, Mr. Torri said it should not happen again. Ms. Davidson said all of the houses in the subdivision have been reviewed. Chairman Hennessy asked if any one would like to speak on behalf of this petition. No one came forward. Chairman Hennessy swore in Victoria Enriquez, 621 Vine Street, Joliet, IL. Ms. Enriquez appeared on behalf of the petition. Chairman Hennessy asked Ms. Enriquez if she understood and agreed with all of the conditions, Ms. Enriquez said yes. Ms. Enriquez stated she will take care of all of the requirements before opening. Chairman Hennessy asked if any one would like to speak on behalf of the petitions. No one came forward. A motion was made by Vincent Alessio, seconded by Charles McCauley, to approve: PETITION 2021-11: A Special Use Permit to allow an auto repair and tire business, located at 550 N. Chicago Street with the following conditions: 1. That a landscape plan that references the conceptual site plan shall be submitted to and approved by the Planning Division within 45 days of ordinance approval detailing conditions # 2- # 7; 2. That the area of asphalt pavement located at the intersection of Chicago Street and Irving Street shall be removed and defined by barrier curbing per the City’s Landscape and Screening Regulations prior to May 31, 2021; 3. That all parking areas shall be patched, seal coated, and striped prior to May 31, 2021; 4. That the paved parkway along Irving Street be patched and seal coated prior to May 31, 2021; 5. That the 4’ wide public sidewalk along Irving Street shall be repaired prior to May 31, 2021; 6. That the parkway tree along Chicago Street shall be installed prior to May 31, 2021; 7. That the building shall be repainted prior to June 30, 2021; 9. That sign permits shall be submitted to Planning Staff for review and approval; 10. That no outside storage of customer vehicles shall be allowed on the City parkway or City streets; 11. Temporary outdoor storage of vehicles awaiting to be serviced or to be picked up shall be limited to ten (10) days; 12. No temporary or long-term outdoor storage of inoperable vehicles, boats, recreational vehicles, or parts (including tires) shall be permitted; 13. That off-street parking shall remain in the future; 14. That a City Business License shall be secured prior to opening; 15. That the Special Use granted shall herein terminate and lapse unless a building permit or certificate of occupancy is obtained not later than 180 days of the effective date of this ordinance and the erection or alteration of a building is started or the use is commenced within such period. Page 6 of 8 Zoning Board of Appeals Meeting Minutes March 18, 2021 Chairman Hennessy swore in Mr. Dave Brink, 7844 W. Central Avenue, Toledo, OH from Allen Industries. Mr. Brink appeared in support of this petition. Mr. Brink gave a brief overview of Belle Tire and explained that Joliet would be a new market for their company. Mr. Brink stated that due to the building being located on an inner lot, the additional signage will be necessary for visibility from Jefferson Street and Caterpillar Drive. Chairman Hennessy asked if any one else would like to speak of behalf of this petition. No one came forward. A motion was made by Vincent Alessio, seconded by Charles McCauley, to approve: PETITION 2021-12: A series of Variations for signage for a future Belle Tire business, located at 2526 W. Jefferson Street. Mr. Brink appeared in support of this petition. Mr. Brink explained that this petition is similar to Petition 2021-12 - 2526 W. Jefferson Street with the need to have additional signage. Chairman Hennessy asked if any one would like to speak on behalf of the petition. No one came forward.
