City and Borough of Juneau Building Code Board of Appeals Minutes Wednesday, January 30, 2013 – Noon City Hall Conference Room 224 Call to Order: Mike Story, Chair, called to Building Code Board of Appeals to order at Noon. Roll Call: Members Present: Todd Kollar, Brad Austin, Mike Story, Jeff Wilson, Darrell Wetherall (arrived at 12:30 p.m.) Members Absent: Randy Walling. Others Present: John Hartle, City Attorney; Laurie Sica, Municipal Clerk. Approval of Minutes: Hearing no objection, the Board approved the minutes of its January 3, 2013 meeting. Board Deliberation on Decision re: Ann Lee Appeal of Building Official’s Order to Demolish Structure at 9018 Long Run Drive. The Board took a few moments to review the meeting packet, which included the agenda and minutes, and a DRAFT decision prepared on the Board’s behalf by Mr. Hartle. Mr. Hartle said the Open Meetings Act did not apply when the Board was serving in its quasi-judicial function. As directed by the Board, he had prepared a draft decision of the appeal. He recommended the Board read it carefully, make any changes, and then make a final draft. The Board entered closed session at 12:18 p.m. and returned to open session at 12:29 p.m. MOTION, by Wilson, to deny the appeal of Ann Lee’s appeal of the Building Official’s Decision and to adopt the draft decision. Seconded by Kollar. Hearing no objection, it was so ordered. Mr. Austin suggested on line 11, amending “Building Code Official” to “Building Official.” Mr. Hartle said he would finalize the decision for Mr. Story’s signature. Mr. Austin asked for the decision to be delivered to Ms. Lee via a process server. Mr. Hartle said he did not forsee that would be a problem. During the entire process the Board took great efforts to protect Ms. Lee’s due process rights. Board Comments – Questions – None.
