LAWTON URBAN HOMESTEADING AGENCY (LUHA) SPECIAL MEETING
FEBRUARY 22, 2011 - 6:00 P.M.
WAYNE GILLEY CITY HALL COUNCIL CHAMBER
The meeting was called to order at 6:00 p.m. by Chairman Fred L. Fitch, Notice of meeting and agenda
were posted on the City Hall notice board as required by State Law.
PRESENT: Bill Shoemate, Michael Tenis, Janice Drewry, Jay Burk, Robert Shanklin, Richard Zarle,
Stanley Haywood, Doug Wells.
ABSENT: None.
ALSO PRESENT: Larry Mitchell, City Manager; Frank V. Jensen, City Attorney; Traci Hushbeck, City
Clerk, COL Fred Erst, Fort Sill Liaison.
CONSIDER APPROVAL OF THE MINUTES OF THE JULY 27, 2010 SPECIAL MEETING OF THE
LAWTON URBAN HOMESTEADING AGENCY (LUHA).
MOVED by Drewry, SECOND by Burk, to approve the minutes of July 27, 2010. AYE: Tenis, Drewry,
Burk, Shanklin, Zarle, Haywood, Wells, Shoemate. NAY: None. MOTION CARRIED.

BUSINESS ITEMS:
1. Pursuant to Section 307B.4, Title 25, Oklahoma Statutes, consider convening in executive session
to discuss filing a foreclosure law suit, in the Comanche County District Court to be styled as
Lawton Urban Homesteading Agency & the City of Lawton v. April Burkholder, et al. Exhibits:
None.
The Mayor and Council convened in executive session at 6:01 p.m. and reconvened in regular, open
session at 6:17 p.m. Roll call reflected all members present.
Jensen read the title of item #1.
MOVED by Haywood, SECOND by Drewry, to authorize the City Attorney (1) to initiate and prosecute a
foreclosure suit against April Burkholder and the real property located at 1730 SW 14th Place, Lawton,
Oklahoma for all sums now due under the Promissory Notes and Mortgages dated February 4, 2005, and
(2) to name as a party in this suit any person or entity having an interest in the property as may necessary;
and further to authorize payment of the property’s the past due property taxes for the 2007 tax year from
the City Council Contingency Fund.” AYE: Shanklin, Zarle, Haywood, Wells, Shoemate, Tenis,
Drewry, Burk. NAY: None. MOTION CARRIED.
There was no further business to consider and the meeting adjourned at 6:19 p.m. upon motion, second
and roll call vote.

"The City of Lawton encourages participation from all of its citizens. If participation at any public meeting is not
possible due to a disability, notification to the city Clerk at (580) 581-3305 at least 48 hours prior to the scheduled
meeting is encouraged to make the necessary accommodations. The City may waive the 48 hour rule if interpreters
for the deaf (signing) is not the necessary accommodation."
