AGENDA SPECIAL MEETING CITY OF LAWTON PENSION TRUST COMMISSION CITY HALL 3rd FLOOR CONFERENCE ROOM FRIDAY AUGUST 16, 2024 9:00 A.M. Chairman Bayones called the meeting to order at 9:00 A.M. in the third-floor conference room of City Hall. ROLL CALL PRESENT: Paul Ellwanger, *Richard Rogalski, James Apple, Ed Petersen, Teri Bayones ABSENT: Christine James (excused) ALSO PRESENT: Larry Burk, City Manager’s Office; Tammy Branstetter, City Clerk’s Office; Ashton Wall, City Clerk’s Office; Tim Wilson, City Attorney’s Office; Craig Akard, Human Resources *Arrived at 9:03AM STATEMENT OF COMPLIANCE WITH OKLAHOMA OPEN MEETING ACT, 25 O.S. 301-314 Notice of meeting and agenda were posted by the City Clerk’s Office as required by law. INTRODUCTION OF GUESTS None. III. New Business A. Consider approving the minutes of the March 13, 2024 special meeting. Motion by Apple, Second by Ellwanger, to approve the minutes of the March 13, 2024 special meeting. AYE: Ellwanger, Apple, Petersen, Bayones. NAY: None. MOTION PASSED. IV. Executive Session A. Pursuant to Section 307B.4, Title 25, Oklahoma Statutes, consider convening in executive session to discuss the status of an ongoing investigation concerning pension calculations, and, if necessary, take appropriate action in open session. Motion by Apple, Second by Petersen, to convene in executive session. AYE: Ellwanger, Apple, Petersen, Bayones. NAY: None. MOTION PASSED. The Commission convened in executive session at 9:02AM. Rogalski arrived at 9:03AM. The Commission reconvened in regular, open session at 9:58AM. Roll call reflected all members present. Wilson read the item title as follows: “Pursuant to Section 307B.4, Title 25, Oklahoma Statutes, consider convening in executive session to discuss the status of an ongoing investigation concerning pension calculations, and, if necessary, take appropriate action in open session.” A motion was made by Apple to grandfather the overpaid retirees who are paid under the 78-pay period method for determining their monthly average pay. Petersen seconded the motion. Wilson said we might need to say we recommend to the City Council. He said we might need to go back into executive session for further discussion. Petersen withdrew his second for Apple’s motion. Larry Burk, City Manager’s Office, said we need to go back into executive session. Motion by Ellwanger, Second by Apple, to convene in executive session. AYE: Ellwanger, Apple, Rogalski, Petersen, Bayones. NAY: None. MOTION PASSED. The Commission convened in executive session at 10:00AM and reconvened in regular, open session at 10:11AM. Roll call reflected all members present. Wilson read the item title as follows: “Pursuant to Section 307B.4, Title 25, Oklahoma Statutes, consider convening in executive session to discuss the status of an ongoing investigation concerning pension calculations, and, if necessary, take appropriate action in open session.” Wilson said when we first came out of executive session, we had a motion. The motion had a second, but Petersen withdrew his second. Chairman Bayones asked if there are any new motions. Apple said he has a new motion. Motion by Apple, Second by Ellwanger, to recommend to grandfather the overpaid retirees who are paid under the 78 pay period method for determining their final average monthly pay. AYE: Ellwanger, Apple, Rogalski, Petersen, Bayones. NAY: None. MOTION PASSED. Chairman Bayones asked if there are any other motions. Motion by Apple, Second by Rogalski, to recommend that any underpaid retirees have their benefits corrected as set forth in City Code to include utilizing the calendar year method in City Code for calculating their final average monthly pay. AYE: Ellwanger, Apple, Rogalski, Petersen, Bayones. NAY: None. MOTION PASSED. V. Adjournment Motion by Apple, Second by Ellwanger, to adjourn the August 16, 2024 meeting. AYE: Ellwanger, Rogalski, Apple, Petersen, Bayones. NAY: None. MOTION PASSED. There being no further business, Chairman Bayones adjourned the meeting at 10:13 A.M.

VI. Adjournment "The City of Lawton encourages participation from all of its citizens. If participation at any public meeting is not possible due to a disability, notification to the City Clerk at (580) 581-3305 at least 48 hours prior to the scheduled meeting is encouraged to make the necessary accommodations. The City may waive the 48-hour rule if interpreters for the deaf (signing) is not the necessary accommodation."
