Public Hearings Business Meeting Approval of Minutes There were no minutes to approve. Planner's Report New Business 140312 BOBA Appeal - Condemnation Notice: 210 W. Berkshire Avenue Resolution pursuant to the provisions of Section 32.021 et. seq. of the Village Code and per Village Counsel’s direction at the September 9, 2014 Board of Building Appeals (BOBA) meeting relative to a condemnation notice issued by the Village of Lombard. (DISTRICT #1) Village of Lombard Page 1 Board of Building Appeals Minutes September 18, 2014 William Heniff, Community Development Director, whose duties including serving as the Building Commissioner, re-introduced the petition. He referenced the last meeting of BOBA on August 9, 2014, BOBA heard a requested appeal of a condemnation notice issued by the Village. At the August 9 meeting, Mallory Milluzzi of Klein, Thorpe and Jenkins, the Village’s legal counsel, stated that pursuant to the provisions of Section 32.021 et. seq. and Open Meetings Act, any dismissal of an appeal must be done in a separate meeting, with due notice provided, and must be done in the form of a resolution. Mr. Heniff then reviewed the draft resolution for consideration. The resolution considered the testimony and materials submitted at the meeting and offered findings of fact based upon the representations. Staff asked BOBA to review the draft recommendations, offer any changes deemed appropriate and then vote on the resolution. The BOBA members discussed the request and each of the attending members found that the actions taken by staff were appropriate. They also stated that the appellant’s non-participation in the matter can also be considered in the matter, particularly given the opportunities offered to her, and that it can be deemed that she does not want to pursue the matter further. As such, her actions constitute a default. On a motion by Flint and a second by Igoe, by a unanimous vote of the five BOBA members present, BOBA approved Resolution 35-14 dismissing the appeal relative to the building conditions at 210 W. Berkshire Avenue. On a motion by Stephen Flint and a second by Marty Igoe, by a unanimous vote of the five BOBA members present, BOBA approved Resolution 35-14 dismissing the appeal relative to the building conditions at 210 W. Berkshire Avenue. Unfinished Business Other Business Adjournment A motion was made by Maurice Bernardi, seconded by Marty Igoe, to adjourn the meeting at 6:50 p.m. The motion passed by a unanimous vote.
