Public Hearings
240377 PC 24-10: 324 Eisenhower Lane North - Outside storage of
equipment and materials for a landscaping business
The petitioner requests a conditional use pursuant to Section 155.420(C)
(10) of the Lombard Village Code to allow for a contractor equipment and
material storage yard associated with a landscaping business operating
on the subject property located within the I Limited Industrial District.
(DISTRICT #3)
Sworn in to present the petition was Anna Papke, Planning and Zoning
Manager, and Brian Baker on behalf of Davey Tree Expert Co., the
petitioner.
Chairperson Giuliano read the Plan Commission procedures and
asked if anyone other than the petitioner intended to cross examine
and, hearing none, she proceeded with the petition.
Mr. Baker presented the petition. He said that Davey Tree is a
landscape company providing services in the area. Davey Tree is
requesting a conditional use to allow outside storage on the subject
property. Davey Tree proposes to expand the paved surface to the rear
of the building to provide for additional parking areas as well as an area
to store materials and equipment. Mr. Baker said there would be two
concrete bins for storage of mulch and trees on the north side of the
site.

Chairperson Giuliano asked if any person would like to cross examine
or speak in favor or against this petition, or for public comment.
Bill LoPresto asked for clarification on the address and location of the
subject property and noted that he lives at 271 Arboretum immediately
behind the subject property. He was not for or against the petition but
had questions. He asked about the prior owner of the subject property.
Mr. Baker said the former owner was a landscape company called
Foliage Design.
Mr. LoPresto asked about hours of operation. Mr. Baker said crews
would arrive around 7:00 a.m., but noted that no work is done on site.
The crews would be gathering equipment and supplies and traveling to
job sites. The workday ends around 3:00 or 4:00 p.m.
Mr. LoPresto said he was concerned about noise. He said the
bedrooms in the Arboretum townhomes back up to the shared property
line with the subject property. Mr. Baker said that Davey Tree would not
generate much noise. He noted that no equipment will be run on site.
Mr. LoPresto asked about screening on the north side of the subject
property. Mr. Baker said there will be landscaping and fencing in that
area.
Mr. LoPresto asked about screening during the winter months when
trees lose leaves. Mr. Baker said there will be evergreen trees planted
in the landscape area.

or speak in favor or against this petition, or for public comment.
Hearing none, she asked for the staff report.
Ms. Papke presented the staff report, which was submitted to the public
record in its entirety. The subject property is an existing building in the
Yorkbrook Business Park on Eisenhower Lane, which is in the
Industrial District. The petitioner operates a landscaping business on
the property and proposes to expand the rear parking lot to allow for an
area for outdoor storage of materials. Outdoor material storage areas
are conditional uses in the I District.
Staff has reviewed the submitted plans and finds the petition is

consistent with the standards for conditional uses. Outdoor materials
storage yards are common in the I District and in the Yorkbrook
Business Park, which contains a mix of offices, warehousing, and
general industrial land uses. The property to the west at 328
Eisenhower Lane has an outdoor materials storage area similar to the
petitioner’s proposal for the subject property. Because the subject
property is adjacent to the Arboretum Townhomes to the north, the
Zoning Ordinance requires the north 30 feet of the subject property to
be a landscape buffer area. The submitted plans show this area will be
improved with a bioswale and other planting materials. A solid fence will
be provided along the north property line for additional screening.
Staff found the petition met the standards for conditional uses and
recommended approval of the petition subject to the conditions noted
in the staff report.
Chairperson Giuliano asked if there were any questions or comments
on the staff report.
Commissioner Spreenberg asked how the landscape buffer on the
subject property would compare to the landscaped area on the north of
the property at 328 Eisenhower, where a conditional use for outside
storage was previously approved by the Village. Ms. Papke said the
depth of the buffer on the subject property would be similar to the
landscape buffer on 328 Eisenhower.
Chairperson Giuliano asked if there were any questions or comments
on the staff report. Hearing none, she opened the meeting to
comments from the Commissioners.
Commissioner Invergo asked about lighting on the subject property.
Mr. Baker said he had submitted a code-compliant lighting plan for the
proposed parking area, and staff had no comments on it.
Commissioner Spreenberg asked if Davey Tree would be repairing
equipment on site. Mr. Baker said they may conduct minor
preventative maintenance on some of the equipment, but this would be
done indoors.
On a motion by Commissioner Invergo, and a second by Commissioner
Spreenberg, the Plan Commission voted 6-0 to recommend that the Village
Board approve the petition associated with PC 24-10 subject to the six (6)
conditions in the staff report:
1. That the petitioner shall satisfactorily address all comments noted within
the Inter-Departmental Review Committee Report;

2. That the petitioner shall develop the site in accordance with the plans
submitted as part of this petition and referenced in the Inter-Departmental
Review Committee Report;
3. That the materials stored outside shall be effectively screened by and not
visible above the level of either the fence along the north property line or the
concrete storage bins, as may be applicable; an exception shall be made for
trees that the petitioner may store on site in anticipation of off-site installation;
4. That the east and west perimeters of the parking lot shall be landscaped in
accordance with Section 155.706(C)(3);
5. That the petitioner shall apply for and receive building permits for the
proposed improvements; and
6. That this approval shall be subject to the commencement time provisions
as set forth within Section 155.103(F)(11).

The petitioner requests a conditional use pursuant to Section 155.420(C)
(39) of the Lombard Village Code to allow for an outside materials
storage area associated with a manufacturing business operating on the
subject property located within the I Limited Industrial District.

Sworn in to present the petition was Anna Papke, Planning and Zoning
Manager, and the following on behalf of the petitioner: Araceli
Rodriguez, business owner, and Mark Richards, project engineer.
Chairperson Giuliano read the Plan Commission procedures and
asked if anyone other than the petitioner intended to cross examine
and, hearing none, she proceeded with the petition.
Araceli Rodriguez, owner of Chicago Pallet, addressed the Plan
Commission. She said Chicago Pallet had recently moved to Lombard
from their Elk Grove Village location. She introduced project engineer
Mark Richards.
Mr. Richards presented the petition. He said the site is located at North
Avenue and Main Street. He said the petitioner proposed to add new
pavement to the north side of the property, which will include a

12,000-square-foot outdoor storage area. The outdoor storage area
requires a conditional use. There will be an eight-foot-tall fence around
the storage area. He noted there is existing landscaping along the west
side of the area that will be preserved. He said surrounding properties
included similar land uses as the subject property. He showed the
utility and drainage plans, and noted the plan complies with stormwater
regulations. No new curb cuts are proposed.
Chairperson Giuliano asked if any person would like to cross examine
or speak in favor or against this petition, or for public comment.
Hearing none, she asked for the staff report.
Ms. Papke presented the staff report, which was submitted to the public
record in its entirety. The subject property is located in the North
Avenue industrial area, which is in the Industrial District. The petitioner
operates a pallet manufacturing business on the subject property. The
petitioner proposes to construct a parking lot to the north of the
building, with a 12,000-square-foot area to be used for storage of
materials. Outdoor material storage areas are conditional uses in the I
District.
Staff has reviewed the submitted plans and finds the petition is
consistent with the standards for conditional uses. Outdoor materials
storage yards are common in the North Avenue industrial area. The
storage area will be screened by a combination of a solid fence and the
building on the property. Staff found the petition met the standards for
conditional uses and recommended approval of the petition subject to
the conditions noted in the staff report.
Chairperson Giuliano asked if there were any questions or comments
on the staff report.
Commissioner Spreenberg asked for clarification if the fence around
the storage area would be eight feet tall or six feet tall. Mr. Richards
said it will be eight feet tall.
Commissioner Spreenberg asked if an eight-foot-high fence is
permitted. Ms. Papke said it is.
Chairperson Giuliano asked if there were any questions or comments
on the staff report. Hearing none, she opened the meeting to
comments from the Commissioners.
On a motion by Commissioner Spreenberg, and a second by Commissioner
Invergo, the Plan Commission voted 6-0 to recommend that the Village Board

approve the petition associated with PC 24-11 subject to the seven (7)
conditions in the staff report:
1. That the petitioner shall satisfactorily address all comments noted within
the Inter-Departmental Review Committee Report;
2. That the petitioner shall develop the site in accordance with the plans
submitted as part of this petition and referenced in the Inter-Departmental
Review Committee Report;
3. That the materials stored outside shall be effectively screened by and not
visible above the level of the fence around the storage area;
4. That the east and west perimeters of the parking lot shall be landscaped in

The petitioner requests a conditional use pursuant to Section 155.416
(C)(4) of the Lombard Village Code to allow for a building material and
products sales and storage establishment on the subject property located
within the B4 Corridor Commercial District. (DISTRICT #4)
Sworn in to present the petition were Ricardo Talavera and Alfredo
Esparza, petitioners; Alisa Volpe and Chloe Volpe, property owner;

Chairperson Giuliano read the Plan Commission procedures and
asked if anyone other than the petitioner intended to cross examine,
and hearing none, she proceeded with the petition.
Mr. Talavera stated that he is requesting a conditional use for the sale
and storage of building materials, more specifically steel, hobby size,
angle iron, tube, etc. The primary business is to provide material

purchased in Chicago to customers at job sites. Occasionally, there are
remnants that will be stored at the 11 N. Chase location. Purchases of
the remnant steel is by appointment.
The building has a commercial overhead door at the back. There are
residents that live on the second floor. There are no common areas
shared with the residents. The business would be assigned four parking
spaces. One of the spaces is for a trailer to transport the materials.
Chairperson Giuliano asked if any person would like to cross examine
or speak in favor or against this petition, or for public comment.
Hearing none, she asked for the staff report.
Ms. Urish presented the IDRC report for PC 24-12, which was entered
into the public record in its entirety. The petitioner proposes to operate
a building material and products sales and storage establishment at 11
N. Chase Avenue and 734 E. St. Charles Road as noted on the
submitted floor plans. The property is an existing mixed-use building
with retail/office space on the first floor and residences on the second
floor. There is a surface parking lot behind the building. The proposed
building material sales office and storage will occupy the majority of the
first floor. No exterior site improvements are proposed.
As explained in the staff report, the use is listed as a conditional use.
The character of the neighborhood along E. St. Charles Road is an
eclectic mix of uses that include a storage center, auto parts, auto
sales, dog kennel, etc. Two properties to the west is the beginning of a
small industrial district. Also, the building was originally developed for
an HVAC contractor’s shop. The proposed use of reclaiming steel
remnants at construction sites and reselling them is compatible with the
corridor development. Any manipulation of the materials will be
conducted within the interior of the building. No activities other than
loading and unloading will take place on the parking lot. Staff
recommends approval of the petition subject to the conditions in the
staff report.
Chairperson Giuliano asked the Commissioners if they had any
questions.
Commissioner Spreenberg asked if the materials are to be stored
indoors. Mr. Talavera confirmed that the materials will be stored inside.
Chairperson Giuliano asked that this was storage only and there will not

be any cutting, etc. on site. Mr. Talavera responded that while inside
there will be occasions where a piece will need to be cut for example
from twelve feet to six feet. The activity is cold saw cutting only and
does not involve torches.
Chairperson Giuliano asked if this activity would be done during regular
hours. Mr. Esparza responded that the request for a specific size would
be by appointment only.
Chairperson Giuliano asked staff if there was an issue with parking.
Ms. Urish responded that the property met the minimum requirements
per the parking code.
Commissioner Flanigan asked the petitioner if they are doing
processing of the larger deliveries. Mr. Talavera responded that no,
the tenant space is not large enough to handle the standard size. Mr.
Esparza responded that the distributor cuts down the units that are
twenty four feet.
Commissioner Invergo asked how the remnants would be stored. Mr.
Talavera responded that the remnants will be stored in racks that are
six feet in height. The average size is between ten to twelve feet and
like a two by four piece of wood for example. The typical customer is
someone looking to fix their lawn mower.
Commissioner Invergo asked if their supply included ornamental steel.
Mr. Talavera responded that they do have some ornamental steel that
is one half inch size.
Chairperson Giuliano asked if there were any additional comments.
Hearing none, she asked for a motion from the Commissioners.
On a motion by Commissioner Verson, and a second by Commissioner Invergo,
the Plan Commission voted 6-0 to recommend that the Village Board approve
the petition associated with PC 24-12, subject to the following five (5)
conditions:
1. That the petitioner shall develop the site in accordance with plans
submitted as part of this request;
2. That the petitioner shall satisfactorily address all comments noted within
the Inter-Departmental Review Committee Report
3. Outdoor storage of materials is not allowed
4. The conditional use is for 11 N. Chase Avenue and 734 E St Charles Road

The petitioner requests a conditional use pursuant to Section 155.412(C)
(18) of the Lombard Village Code to allow for a school, private, full-time:
elementary, middle, and high, on the subject property located within the
OPD Office Planned Development District. (DISTRICT# 2)
Sworn in to present the petition was Anna Papke, Planning and Zoning
Manager, and Ruby Ramirez, petitioner.
Chairperson Giuliano read the Plan Commission procedures and
asked if anyone other than the petitioner intended to cross examine
and, hearing none, she proceeded with the petition.
Ms. Ramirez presented the petition. She is the principal of a school for
students with special needs, and is requesting a conditional use to
allow a private elementary school on Parkview Blvd. Ms. Ramirez
described the student population the proposed school would serve, and
the curriculum. She said there would be 15 students and three
teachers. There will be additional therapists on staff. Ms. Ramirez said
there will not be any outdoor play areas; there will be two play areas
indoors. There are 20 outdoor spaces included in the lease. She
described the student pickup and drop off patterns, noting that parents
would park in parking spaces as needed to avoid creating congestion
in the parking lot. She said drop off should last no longer than 15
minutes each day.

or speak in favor or against this petition, or for public comment.
Hearing none, she asked for the staff report.
Ms. Papke presented the staff report, which was submitted to the public
record in its entirety. The petitioner proposes to operate a private
school in an office suite within the Woodlake Corporate Park. The

school will be one tenant in a multi-tenant building. The subject
property is part of a planned development in the Office District. Schools
are conditional uses in the Office District.
Staff has reviewed the submitted plans and finds the petition is
consistent with the standards for conditional uses. The school will serve
15 students and will have five employees. The petitioner will make
interior modifications to provide classroom space and play areas in the
tenant space. No exterior alterations are proposed. Ms. Papke said the
petitioner had indicated student drop off and pickup activities will occur
in the parking lot outside the door into the office suite. Given the small
number of students, staff does not anticipate the school will create any
circulation impacts for other tenants of the building or for Parkview
Boulevard. Staff and the petitioner have discussed that drivers should
be instructed to pull into parking stalls for loading and unloading to
avoid blocking the parking lot drive aisle. Staff proposes that a
condition of approval for this petition state that loading and unloading
activities shall not block parking lot drive aisles.
Staff found the petition met the standards for conditional uses and
recommended approval of the petition subject to the conditions noted
in the staff report.
Chairperson Giuliano asked if there were any questions or comments
on the staff report. Hearing none, she opened the meeting to
comments from the Commissioners.
Commissioner Spreenberg asked how much of the building would be
occupied by the school. Ms. Ramirez said less than half.
Commissioner Sweetser asked about the approval process for schools.
Ms. Ramirez said the school also requires approval by the Illinois State
Board of Education (ISBE) in addition to the Village approval of the
conditional use.
Commissioner Spreenberg asked if there would be any outside play
activities for the students. Ms. Ramirez said ISBE does not require
outdoor play space for special needs schools. She said there would be
several locations for play inside the tenant space.
Commissioner Spreenberg asked if the petitioner operates other
schools. Ms. Ramirez said the petitioner operates three other schools.

Commissioner Verson asked about security plans to make sure
students do not leave the school without permission. Ms. Ramirez said
the doors will have security locks to control access to and from the
school.
Commissioner Sweetser asked if the school would be partnering with
other organizations for resources. Ms. Ramirez said the school would
partner with several organizations, including YMCA and Ray Graham.
Commissioner Invergo asked if Ms. Ramirez’s school would work with
Soaring Eagle School [also located on Parkview Blvd]. Ms. Ramirez
said Soaring Eagle has a different approach to education than the
proposed school.
Commissioner Spreenberg asked if there would be any concerns about
noise impacts on other tenants. Ms. Ramirez said she does not expect
to the students to disrupt other tenants.
On a motion by Commissioner Spreenberg, and a second by Commissioner
Invergo, the Plan Commission voted 6-0 to recommend that the Village Board
approve the petition associated with PC 24-13 subject to the five (5) conditions
in the staff report:
1. That the petitioner shall satisfactorily address all comments noted within
the Inter-Departmental Review Committee Report;
2. That the petitioner shall develop the site in accordance with the plans
submitted as part of this petition and referenced in the Inter-Departmental
Review Committee Report;
3. That student loading and unloading activities shall not block drive aisles in
the parking lot on the subject property;
4. That the petitioner shall apply for and receive building permits for the
proposed improvements; and
5. That this approval shall be subject to the commencement time provisions
as set forth within Section 155.103(F)(11).

setbacks for four single-family residential lots in the Suraiya
Subdivision
The petitioner, the Village of Lombard, requests that the Village take the
following action on the subject property located within the R2
Single-Family Residential District: Pursuant to Section 155.407(F)(1) of
Village Code, approve a variation to allow a minimum front yard setback
of 30 feet for Lots 1 through 4 of the Suraiya Subdivision, irrespective of
the front yard setback of existing single-family dwellings on abutting lots.

Chairperson Giuliano read the Plan Commission procedures and
asked if anyone other than the petitioner intended to cross examine
and, hearing none, she proceeded with the petition.
Ms. Papke presented the petition in the form of the staff report, which
was submitted to the public record in its entirety. The subject property is
the Suraiya Subdivision, a five-lot subdivision on West Meadow
Avenue platted in 2017. The subdivision includes four single-family
residential lots (Lots 1-4) and one stormwater outlot (Lot 5). Three of the
four single-family residential lots are vacant. Lot 3, at 622 W. Meadow,
is developed with a single-family residence that was built prior to the
2017 subdivision.
The subject property is in the R2 Single-Family Residential District.

Per the Lombard Zoning Ordinance, required front setbacks for new
single-family residences in the R2 District are determined using a
formula based on the front setbacks of single-family dwellings on
abutting lots, with the front setback to be no less than 30 feet in any
case. The existing single-family residence at 622 W. Meadow was built
in 1999 when that property was configured as a long narrow lot in
unincorporated DuPage County. Subsequent annexation, subdivision,
and development of the Buckingham Orchard townhomes to the north
reduced the depth of 622 W. Meadow, resulting in a single-family home
on a standard-sized residential lot with a deep front yard setback and a
shallow, nonconforming rear yard setback. The nonconforming rear
setback and deep front setback of this house affects the formulated
front setback of the adjacent lots to an extent that was not intended
when the Suraiya Subdivision was platted. To address this concern,
staff proposes a variance to establish a minimum 30-foot front yard
setback for all the buildable lots in the subdivision.
Staff reviewed the potential variation against the standards for
variations in the Village Code. Staff found that there is a hardship
based on the sequence of events and development activities on the
subject property in the last 25 years. An earlier version of the five-lot
subdivision was platted in 2006, when the second phase of the
Buckingham Orchard townhome development was built to the north. At
that time, the subdivision was platted as a five-lot single-family
subdivision. Required setbacks in the R2 District were 30 feet. The
2006 subdivision was consolidated into one lot in 2013, and
resubdivided into its current form in 2017. While the widths of the five
lots in the 2017 subdivision vary somewhat from the width of the lots in
the 2006 subdivision, the depth of the lots is unchanged between 2006
and 2017. However, in the intervening time between the two
subdivisions, the front yard setback requirement in Residential Districts
was amended from an absolute minimum of 30 feet to a formulated
setback based on setbacks on abutting properties. The formulated
setback combined with the presence of the existing house with the deep
front setback at 622 W. Meadow altered the development potential for
the remaining lots in the subdivision in a way that was not anticipated
when the lot depths were established in 2006. Ms. Papke noted that
there is a diagram in the staff report that shows the formulated setback
on the lots within the subdivision along with the proposed 30-foot
setback, and noted that staff did not find any appreciable difference
between the formulated setback and the proposed 30-foot setback in
terms of neighborhood compatibility.

Staff found the petition met the standards for variations and
recommended approval of the petition.
Chairperson Giuliano asked if any person would like to cross examine
or speak in favor or against this petition, or for public comment.
Hearing none, she opened the meeting to comments from the
Commissioners.
Commissioner Flanigan asked if there was any development ongoing
around the subdivision. Ms. Papke said that a permit had been
submitted for one of the lots in the subdivision within the last couple of
months, and the review of that permit had brought the front setback
issue to the attention of staff.
Commissioner Spreenberg asked how the proposed 30-foot setback
fits within the front setback requirement for Residential Districts in
general. Ms. Papke said that prior to 2008, the front setback
requirement for single-family residences in Residential Districts was a
minimum of 30 feet. The formulated setback was introduced in 2008 to
address concerns related to new houses with 30-foot setbacks being
constructed next to older houses with deep front setbacks. However, the
formulated setback still sets an absolute minimum front setback of 30
feet.
Commissioner Spreenberg asked if 30 feet would be the required
setback for a house built next to a vacant lot. Ms. Papke said the
formulated setback does account for properties where adjacent lots are
undeveloped; in those cases, the formula assumes a front setback of
30 feet on the adjacent lot.
On a motion by Commissioner Spreenberg, and a second by Commissioner
Invergo, the Plan Commission voted 6-0 to recommend that the Village Board
approve the petition associated with PC 24-14.
