Call to Order and Pledge of Allegiance The regular meeting of the President and Board of Trustees of the Village of Lombard held on Thursday, June 16, 2016 in the Board Room of the Lombard Village Hall was called to order by Village President Keith Giagnorio at 7:30 p.m. Fire Chief Paul DiRienzo led the Pledge of Allegiance. II. Public Hearings 160266 Public Hearing A Public Hearing regarding the proposed issuance by the Village of Lombard, Illinois of its proposed revenue refunding bonds in an aggregate principal amount not to exceed $5,600,000, for the National University of Health Sciences. Village Attorney Tom Bayer called the Public Hearing relative to the proposed issuance by the Village of Lombard, Illinois of its proposed revenue refunding bonds in an aggregate principal amount not to exceed $5,600,000 for the National University of Health Sciences to order at 7:31 p.m. Attorney Bayer provided an overview of the purpose of the Public Hearing. Being that no one spoke for or against the matter, the Public Hearing was closed at 7:35 p.m. 160278 Proclamation - Honoring Fire Chief Paul DiRienzo Village President Keith Giagnorio called Fire Chief Paul DiRienzo to the front. Village Clerk Sharon Kuderna read a proclamation honoring Fire Chief Paul DiRienzo for his years of service to the community, the residents, Village of Lombard Page 1 Village Board of Trustees Minutes June 16, 2016 the Village of Lombard and the Lombard Fire Department. Paul DiRienzo thanked the Village and introduced his family. Village President Giagnorio introduced Erik Lanphier, Executive Director of the Glenbard Wastewater Authority. Erik Lanphier asked Trustee Bill Ware to come to the front. He thanked Trustee Ware for his service to the GWWA and presented him with a plaque for his years of service. Trustee Bill Ware tanked Erik for the recognition and the plaque. IV. Public Participation Chuck Bohl, Christian Church of Vila Park, spoke relative to a program called "Love Your Neighbor". The parishioners have done this program previously offering assistance to residents, seniors, Veterans who may not be able to do certain household chores at their homes. A lot of their parishioners live in Lombard and he wanted to begin an outreach early. He explained the program and will work with Code Enforcement as well to see if they can provide assistance to residents in need. Village Manager Scott Niehaus spoke of the Code Enforcement Division and how staff strives to assist residents with code violations to resolve the issues rather than staff issuing citations. President Giagnorio congratulated Sgt. Bud Marks of the Lombard Police Department for his 28 years of service to the community and noted that Bud would be retiring on June 20th. President Giagnorio wished Trustee Ware, Village Manager Scott Niehaus and Assistant Village Manager Nicole Aranas a happy birthday. President Giagnorio wished everyone a Happy Father's Day. Village Clerk Sharon Kuderna read the following announcements: The July 7th Village Board meeting has been cancelled. The next regularly scheduled meeting is July 21st. Cruise Nights has returned to downtown Lombard and will run every Saturday from 6-10 pm through the end of August. Fireworks will be held at dusk on July 4th at Madison Meadows Park. The Summer Blood Drive is scheduled for Wednesday, July 13 from 9:30 am to 1 pm at Yorktown and from 1:30 pm to 7 pm at the Village Hall. All donors will receive a coupon for a pint of Culver’s frozen yogurt, a coupon for a pint of Baskin Robbins ice cream and be Village of Lombard Page 2 Village Board of Trustees Minutes June 16, 2016 entered into drawings for Yorktown gift cards. Approval of Minutes A motion was made by Trustee Dan Whittington, seconded by Trustee Mike Fugiel, that the minutes of the Regular Meeting of May 19, 2016 be approved. Committee Reports Community Promotion & Tourism - Trustee Mike Fugiel, Chairperson No report Community Relations Committee - Trustee Robyn Pike, Chairperson Trustee Robyn Pike, Chairperson of the Community Relations Committee, reported the committee had met and reviewed the National Citizens Survey. This matter will be on the July agenda for approval. The Senior Fair is scheduled for October 5th. Economic/Community Development Committee - Trustee Bill Johnston, Chairperson Trustee Bill Johnston, Chairperson of the Economic & Community Development Committee, reported ECDC met last Monday to review the existing TIF grant programs pertaining to timing requirements. The ECDC recommended changes to memorialize that in order to receive grant funding, projects receiving grants must start construction within 12 months from the date of approval of the grant and must complete the project within 18 months from the original approval date. The ECDC also considered an amendment to repeal the Electrical Commission Ordinances in the Village Code, with the roles and responsibilities of the Electrical Commission to be solely given to the Village of Lombard Page 3 Village Board of Trustees Minutes June 16, 2016 Village’s Board of Building Appeals. This item will be brought to the Village Board for final consideration at its July 21 Village Board meeting. Finance & Administration Committee, Trustee Reid Foltyniewicz, Chairperson No report Public Safety & Transportation Committee - Trustee Dan Whittington, Chairperson Trustee Dan Whittington, Chairperson of the Public Safety and Transportation Committee, reported the committee met. Two recommendations from the committee are on the agenda for consideration. The Committee also reviewed the immobilization of vehicles and has recommended allowing 72 hours for payment to be made. The July meeting has been cancelled. Public Works & Environmental Concerns Committee - Trustee Bill Ware, Chairperson Trustee Bill Ware, Chairperson of the Public Works & Environmental Concerns Committee, reported the committee met. The committee reviewed the 2017-2026 Capital Improvement Plan which includes street and water upgrades. He thanked the staff for their hard work in preparing the CIP. The recommendation to approve the proposed CIP will be coming to the Village Board in the fall. Finley Road, Single Family Subdivision (Request to remand back to the Plan Commission for the July 18, 2016 meeting) Recommendation from the Plan Commission for the Village take the following actions on the subject property located within the R1 Single-Family Residence District: 1. Repeal Ordinance 6099 in its entirety, which established a conditional use for a planned development with companion conditional uses for motor vehicle repair and outdoor display and sales of materials along with deviations for wall signage; 2. (DISTRICT #3) This Request was approved on the Consent Agenda EE. 160261 Yorktown Temporary Event - Dick’s Sporting Goods Tent Sale Request for a time extension regarding a temporary special event permit for Dick's Sporting Goods to take place at Yorktown Center from June 24 to July 10, 2016. (DISTRICT #3) FF. 160269 Annual Financial Commitment Letter to the DuPage Convention & Visitors Bureau Letter memorializing the Village of Lombard's membership and annual commitment of financial support to the DuPage Convention & Visitors Bureau. This Request was approved on the Consent Agenda GG. 160271 Settlement Agreement - Kapron vs. Village of Lombard Request for concurrence in the approval of a Settlement Agreement relative to Kapron v. Village of Lombard in the amount of $133,000. Items for Separate Action Ordinances on First Reading (Waiver of First Requested) A. 160224 FYE2015 Final Budget Amendment Ordinance approving the final FYE 2015 Budget Amendment. (2/3 vote of Corporate Authorities required) A motion was made by Trustee Bill Johnston, seconded by Trustee Mike Fugiel, that the Ordinance approving the FYE 2015 final Budget Amendment be waived of first reading and passed on second reading with suspension of the Village of Lombard Page 11 Village Board of Trustees Minutes June 16, 2016 rules. The motion carried by the following vote: Aye: 7- Keith Giagnorio, Dan Whittington, Mike Fugiel, Reid Foltyniewicz, Bill Johnston, Robyn Pike, and Bill Ware Enactment No: Ordinance 7237 B. 160254 Amending the Budget Ordinance Recommendation that the Village Board not adopt an Ordinance amending the Budget Ordinance to appropriate for the Debt Service for the Series 2005-A Bonds and the Series 2005-B Bonds for the Hotel and Conference Center, in response to the request from the Lombard Public Facilities Corporation to do so. (2/3 Vote Required) A motion was made by Trustee Reid Foltyniewicz, seconded by Trustee Bill Johnston, to not adopt the Ordinance amending the Budget Ordinance to appropriate for the Debt Service for the Series 2005-A Bonds and the Series 2005-B Bonds for the Hotel and Conference Center, in response to the request from the Lombard Public Facilities Corporation. The motion carried by the following vote: Aye: 7- Keith Giagnorio, Dan Whittington, Mike Fugiel, Reid Foltyniewicz, Bill Johnston, Robyn Pike, and Bill Ware C. 160264 Ordinance Amending Title II, Chapter 112, Section 112.18(A)(13) of the Lombard Village Code - Alcoholic Beverages Ordinance amending Title II, Chapter 112, Section 112.18(A)(13) of the Lombard Village Code relative to alcoholic beverages and prohibited interests in liquor licenses. Trustee Dan Whittington noted that he will be abstaining from voting on this matter. He stated that his wife has been the General Manager of the Vino Cellar to assist the owners. He stated that he works there, but does not receive a salary. Approximately six months ago, the owners indicated they wanted to sell the business. He and his wife would prefer to be allowed to purchase the business instead of the business closing. This matter has been carefully reviewed by legal counsel. Village Manager Scott Niehaus stated originally the State of Illinois prohibited any elected officials from holding a liquor license. The State has since changed the Code and the Village has mirrored the State Code relative to liquor licensing. The amendment to Village Code would allow an elected official to have a liquor license. Village Attorney Tom Bayer stated that the Village is amending its Code to be in compliance with the State Code. Any elected official holding a liquor license is not allowed to vote on any liquor license matters or participate in any discussions relative to liquor licenses. President Giagnorio stated this is more of a clerical matter to reflect the State Code. He also felt that the current Code restricted the pool of candidates who might consider running for office in the Village. Trustee Bill Ware concurred with the recommendation and did not feel an elected official should be discriminated against relative to liquor Village of Lombard Page 12 Village Board of Trustees Minutes June 16, 2016 licensing. He felt all elected officials should be allowed to have a liquor license. A motion was made by Trustee Bill Ware, seconded by Trustee Robyn Pike, that the Ordinance amending Title II, Chapter 112, Section 112.18(A)(13) of the Lombard Village Code relative to alcoholic beverages be waived of first reading and passed on second reading with suspension of the rules. The motion carried by the following vote: Aye: 5- Mike Fugiel, Reid Foltyniewicz, Bill Johnston, Robyn Pike, and Bill Ware Abstain: 1- Dan Whittington Enactment No: Ordinance 7239 D. 160270 Removal of Property from Downtown Lombard TIF District - 141 W. St. Charles Road Ordinance deleting certain property from the redevelopment project area for the Downtown Tax Increment Financing District. (DISTRICT #1) Village Manager Scott Niehaus spoke of the Village being open and transparent and noted that this request is to remove the property located at 141 W. St. Charles Road from the TIF. This relates to the purchase of the business located at that address by Trustee Whittington. The owner of the property has submitted a request to have the property removed from the TIF. A motion was made by Trustee Bill Johnston, seconded by Trustee Robyn Pike, that the Ordinance approving the removal of the property located at 141 W. St. Charles Road from the TIF District be waived of first reading and passed on second reading with suspension of the rules.
