I. Call to Order and Pledge of Allegiance
The regular meeting of the President and Board of Trustees of the
Village of Lombard held on Thursday, July 21, 2016 in the Board
Room of the Lombard Village Hall was called to order by Village
President Keith Giagnorio at 7:30 pm. Chief of Police Ray Byrne led
the Pledge of Allegiance.

160313 Recognition - Glenbard East Girls' Soccer Team
Village President Giagnorio called Kent Overby, the Glenbard East
Varsity Girls' Soccer Coach, to the front. President Giagnorio
presented a Certificate to the coach and team for their
accomplishments.
Kent Overby noted that the Glenbard East High School Varsity Girls
Soccer Team had competed and won third place in the State
Championship Competition. He asked the team to come forward.
Dana Plakey spoke about the soccer team and thanked the Village.

A motion was made by Trustee Bill Johnston, seconded by Trustee Dan
Whittington, that the minutes of the Special Meeting of April 25, 2016; the

Economic/Community Development Committee - Trustee Bill Johnston,
Chairperson
Trustee Bill Johnston, Chairperson of the Economic and Community
Development Committee, reported the committee had met. At the
July ECDC meeting the Committee discussed the Lombard Town
Centre Strategic Plan. He noted that he was pleased that LTC was
taking time to plan for their future and the important role they have
with downtown. Downtown Lombard is thriving thanks to the hard
work of our businesses, Village staff and LTC. The ECDC will
consider their 2017 funding request at the August 8 meeting. The
ECDC also began a review of perimeter window lighting for
commercial businesses and discussed various options the Committee
may want to consider. This will be discussed at further meetings.

Trustee Bill Ware, Chairperson of the Public Works and
Environmental Concerns Committee, reported the committee met. He
noted that staff will be adding signage and striping in accordance with

the Bike and Pedestrian Master Plan and wanted residents to be
alerted to the changes.

VII. Village Manager/Village Board Comments
Trustee Reid Foltyniewicz thanked Officer Sohr and canine partner
Chico for recently visiting the First Church. He expressed appreciation
to all of the men and women who wear the uniform and protect our
communities every day of every year. He spoke of perception with
recent incidents in other towns and other states and praised our local
Police Officers. He read the Police Officer's Prayer.
President Giagnorio spoke of the ceremony prior to the Board meeting
where three new Police Officers and four new Firefighters were sworn
in and three Police Officers were promoted. He expressed
appreciation to our Police Officers, Firefighters and our Public Works
employees and encouraged everyone to respect these individuals who
serve and protect the community every day and provide so many
services to the residents.

the B3PD Community Shopping Planned Development District. The
petition amends the relief granted as part of the original planned
development approval and consisting of:
a. Pursuant to Section 155.504(A)(4), approve a site plan modification
to relocate the building approximately sixteen (16) feet to the north of
the previously approved location, with an alternate configuration for the
proposed truck dock;
b. To provide for an overhead customer loading canopy, a deviation

containers on the property during the construction period; and
f. Approve the submitted site plans and exhibits as the approved site
plan for the proposed development, as amended and as applicable.

President Giagnorio noted that this is the only Target store in the area
that did not offer the sale of alcohol.

D. 160085 Ordinance Amending Title IX, Chapter 98, Section 98.1(B)(1) of the
Lombard Village Code in Regard to the Tax on the Gross Receipts
of Places for Eating
Recommendation of the Finance & Administration Committee to
approve an ordinance amending Title IX, Chapter 98, Section 98.1(B)
(1) of the Lombard Village Code relative to a proposed 1% increase in
the Places for Eating Tax.
Trustee Foltyniewicz, Chairperson of the Finance and Administration
Committee, spoke about the Village's Standing Committees. He noted
that the six committees are comprised of eight Village residents who
volunteer their time and talent, make some difficult decisions and then
forward recommendations to the Village Board for review. Each
standing committee is chaired by a Village Trustee. The Finance and
Administration Committee members have dedicated a lot of time and
made some difficult decisions in an attempt to balance the proposed
budget for FY 2017. He thanked the members, the staff and the
Village Board for their hard work focusing on balancing the budget for
FY 2017. He noted the Finance and Administration Committee has
been working on the FY 2017 budget since November of 2015 and
wanted to take a pro-active approach knowing in advance that there
was a proposed budget deficit that they needed to address. They
wanted to face the challenges, find ways to cut expenses as well as
increase revenues. He spoke of unfunded State mandates affecting
the Village budget, worker's compensation claims and discretionary
versus non-discretionary expenses. He noted the State is still
operating without an approved budget. The committee members
wanted to make solid decisions for the future of the Village and
wanted to make the correct recommendations to the Village Board.
The committee members did not want to just make budget cuts
including jobs, but wanted to take a 50-50 approach - reduce spending
by 50% and increase revenues by 50%. They reviewed a lot of
options including raising taxes, even though the Village Board did not
want to raise taxes. The committee did not want to recommend a
forced tax on residents; did not want to re-instate Village vehicle
stickers; did not want to recommend allowing video gaming in the
community as that was not received well by residents when discussed
two years ago; did not want to add an entertainment tax on television
and the Internet. The committee recommended increasing the Places
for Eating Tax by 1% for the following reasons: this is not a mandatory
tax on residents; the majority of this tax is paid by non-residents who
dine in the community; approximately 65% of this tax is paid by
non-residents with the large number of restaurant options along
Roosevelt Road and Butterfield Road; people traveling through
Lombard would pay the tax; this is not a forced tax, but more of a
luxury tax based on the fact that people choose to dine out, but are
not forced to do so; the funds generated would help offset the budget

deficit and part of the monies generated would be saved for a rainy
day; people would not opt to eat in another community for the
additional 1% or one penny on each dollar; no one likes to raise taxes
or see taxes raised; a tough decision had to be made. The Finance
and Administration Committee and Village Board held a special
meeting in April to review the suggested recommendations. The
recommendations were also sent to other Standing Committees so
that those resident members of those committees could also review
the proposed suggestions and make recommendations to the Finance
Committee and Village Board. Staff also provided presentations to
various organizations such as the Chamber of Commerce, Lombard
Town Centre, the Kiwanis, the Lions Club, and the Rotary. He noted
this has been a long and diligent process; one that has not just been
rushed through, but one that was thoroughly reviewed and one that
was clearly open and transparent. The Committee stressed that they
wanted to make sure before making any recommendations that
nothing had been overlooked and that all options have been
thoroughly reviewed based on the non-home rule status of the Village.
Village Manager Scott Niehaus felt the Finance Committee had done
an exceptional job; that the proposed ordinance is on first reading; that
second reading of the ordinance would be scheduled for August 18th;
that communication has been open and transparent; that the tax
would not take affect until January 1, 2017; that a meeting with all
restaurant owners has been scheduled for August 1st.
Trustee Mike Fugiel noted that Lombard was not the only town with a
Places for Eating Tax; that tax has been in place and not raised since
it was adopted; that there are towns with a higher Places for Eating
Tax than Lombard; Villa Park has a 1.5% Places for Eating Tax and
Hanover Park has a 3% Places for Eating Tax; spoke of unfunded
mandates on communities, non-home rule status and that the
Hotel/Motel tax cannot be used for General Fund purposes; felt this
tax would not need to be increased in the near future.
Trustee Reid Foltyniewicz spoke of the various choices of .5% versus
1%, etc. and the costs incurred by restaurants relative to changing
their equipment and cash registers to reflect the increase. The
committee felt the 1% was the best option.
Trustee Whittington noted the Village would not look at raising the tax
again in the near future.
Trustee Bill Johnston stated that no one likes additional taxes, and
that every time there is an increase, the restaurant owners need to
update their software accordingly. He felt this was the best option and
thanked the Committee, Board and staff.
President Keith Giagnorio thanked Trustee Foltyniewicz, the
Committee and staff for the long and arduous task of focusing on the
deficit and how to best address it. He felt this recommendation was
the best of the worst in that no increase is good, but this
recommendation appeared to be be the best based on the fact that it

is not a forced tax, but one of choice. He noted the Village Board
would not be acting on this matter on second reading until August. He
thanked the Committee for focusing on a balanced budget for FY
2017.

Foltyniewicz, that the ordinance amending Title IX, Chapter 98, Section 98.1(B)
(1) of the Lombard Village Code in regard to the Tax on Gross Receipts of

D-2. 160314 Ordinance Amending Title XI, Chapter 121, Section 121.08 of the
Lombard Village Code - Taxi Subsidy Program
Ordinance amending the Lombard Village Code implementing a
phased elimination of the Taxi Subsidy Program.
Trustee Reid Foltyniewicz, Chairperson of the Finance and
Administration Committee, spoke about the Finance and
Administration Committee members reviewing various options and
services and ways of cutting expenses to help balance the proposed
FY 2017 budget. He noted the Committee did not want to just raise
taxes and felt a dollar-for-dollar approach was the best; that the
Village needed to focus on core services; that nothing was too big or
too small; that all items should be reviewed; some positions had been
frozen since January; delaying hiring and filling positions resulted in
savings to the Village; when an employee retires, the position will be
reviewed to see if the position will be filled or eliminated; what are the
core services of the Village - Police, Fire, Public Works and
Community Development; the core services were all funded. He
spoke of the Taxi Subsidy Program: $5 would purchase $26 worth of
taxi coupons; is susidizing transportation a core service; many other
agencies also provide transportation options to seniors and disabled
individuals including York Township, Beacon Hill, Lexington as well as
friends, neighbors and relatives; met with residents at Beacon Hill
relative to the Taxi Subsidy Program; no one likes to cut programs or
raise taxes; recommendation of Finance Committee to cut the Taxi
Subsidy Program.
Trustee Bill Johnston indicated that there is overlap in this service that
is provided to seniors and disabled individuals; in tightening purse
strings, this was recommended; Village can provide list of other
agencies that provide services.

President Keith Giagnorio felt the Finance Committee, staff and
Village Board looked at a lot of options and tried to find the least
intrusive way to make cuts.
Village Manager Scott Niehaus indicated that this item is on first
reading with second reading of the ordinance on August 18th. The
program costs $40,000 or 5% of the $800,000 deficit; the taxi cab
coupon books would be sold through the end of the year; the coupon
books would be honored through 2017; the 50-50 proposal is a dollar
raised in revenues also means a dollar cut in expenses; this program
is one of many the Finance Committee reviewed.
Trustee Bill Ware indicated his mother is a Lexington and they provide
transportation for residents for shopping, outings and other events.
Trustee Dan Whittington suggested that this information be published
in the Pride newsletter.
Trustee Reid Foltyniewicz noted that when staff is selling coupons
books, residents will be informed of the elimination of the program and
be provided information on alternate transportation opportunities. The
outreach process has already begun.

that the Ordinance amending Title XI, Chapter 121, Section 121.08 of the
