Call to Order and Pledge of Allegiance The regular meeting of the President and Board of Trustees of the Village of Lombard held on Thursday, August 17, 2017 in the Board Room of the Lombard Village Hall was called to order by Village President Keith Giagnorio at 7:00 pm. Chief of Police Roy Newton ledge the Pledge of Allegiance. II. Roll Call President Giagnorio welcomed newly appointed Chief of Police Roy Newton. 7 - Keith Giagnorio, Sharon Kuderna, Mike Fugiel, Reid Foltyniewicz, Bill Johnston, Robyn Pike, and Bill Ware 1 - Dan Whittington Staff Present: Village Manager Scott Niehaus Director of Finance Tim Sexton Director of Community Development Bill Heniff Director of Public Works Carl Goldsmith Chief of Police Roy Newton Fire Chief Richard Sander Assistant Village Manager Nicole Aranas Executive Coordinator Carol Bauer III. Public Hearings IV. Public Participation John Smolak, 25-year resident, spoke about traffic concerns and speeders in the 500 block of S. Fairfield. He requested that the Village consider lowering the speed limit on Fairfield to 25 miles-per-hour. President Giagnorio stated that Trustee Whittington, Chairperson of the Public Safety & Transportation Committee, was absent due to illness and that this request would be forwarded to the committee for review. V. Approval of Minutes A motion was made by Trustee Mike Fugiel, seconded by Trustee Bill Johnston, that the minutes of the Regular Meeting of July 20, 2017 and the minutes of the Special Meeting of July 25, 2017 be approved. Committee Reports Community Promotion & Tourism - Trustee Mike Fugiel, Chairperson No report Community Relations Committee - Trustee Robyn Pike, Chairperson Trustee Robyn Pike, Chairperson of the Community Relations Committee, reported the committee is working on the Senior Fair and encouraged residents to nominate a senior man and senior woman for Senior of the Year awards. Economic/Community Development Committee - Trustee Bill Johnston, Chairperson Trustee Bill Johnston, Chairperson of the ECDC, reported the committee met noted the following: At last Monday’s Economic and Community Development Committee meeting, the following actions were taken: Tim Sexton, Finance Director, provided the Committee with an update regarding the actions taken by the Village Board relative to the LPFC Restructuring Agreement. The ECDC unanimously approved a Downtown Renovation and Improvement Grant for the Brick’s Wood Fired Pizza Restaurant tenant space at 130-132 W. St. Charles Road in the amount of $1,200. The ECDC heard the request and presentation from the Lombard Town Centre regarding their Strategic Plan Activities as well as their funding request to the Village for their 2018 activities in the amount of $50,000 which is $5,000 less than last year. The ECDC unanimously recommended approval of their funding request. Staff provided an update regarding the 101-109 S. Main Street Request for Proposals (RFP) process. Staff presented an update regarding the proposed Butterfield /Yorktown Tax Increment Financing (TIF) District including an overview of the presentation made to the Joint Review Board. This presentation was offered for informational purposes. The Joint Review Board will be forwarding its recommendation and support for the creation of the TIF District. Lombard Town Centre reported on their efforts, with a focus upon their Village of Lombard Page 2 Village Board of Trustees Minutes August 17, 2017 Spooktacular Event slated for Saturday, October 14. Village staff also provided an update regarding the status of projects with a companion Economic Incentive Agreement from the Village. The next ECDC meeting will be on September 11. Finance & Administration Committee, Trustee Reid Foltyniewicz, Chairperson No report Public Safety & Transportation Committee - Trustee Dan Whittington, Chairperson No report Public Works & Environmental Concerns Committee - Trustee Bill Ware, Chairperson Trustee Ware, Chairperson of the Public Works Committee, reported he was out of town for the last meeting, and thanked Trustee Whittington for chairing the meeting. The committee reviewed the Westmore-Meyers Road proposed improvements. This matter will be further discussed by the Public Works and Environmental Concerns Committee as well as the Public Safety and Transportation Committee. Board of Local Improvements - Trustee Bill Ware, President No report Lombard Historic Preservation Commission - Village Clerk Sharon Kuderna No report VII. Village Manager/Village Board Comments Village President Keith Giagnorio welcomed newly-appointed Chief of Police Roy Newton and wished Trustee Reid Foltyniewicz a happy early birthday. Trustee Foltyniewicz indicated there are a lot of good things happening on his birthday Monday including budget meetings, the solar eclipse, the grand opening of Mariano's. Village Clerk Sharon Kuderna noted the following: Summer fun continues in downtown Lombard with Cruise Nights! There are only two weeks left of the classic car show and live summer concert series event. This week’s entertainment is provided by Fool House, playing 1990’s pop and Village of Lombard Page 3 Village Board of Trustees Minutes August 17, 2017 dance hits and then on August 26th join us for the local favorite 7DEEZ band. It all begins at 6pm. More information can be found at www.villageoflombard.org/cruisenights. The Village of Lombard is seeking nominations for its 12th Annual Senior of the Year Awards, which recognizes outstanding seniors who volunteer and go above and beyond to positively benefit Lombard. The Senior Man and Senior Woman of the Year Awards will be presented at the Village’s Senior Fair scheduled for Wednesday, October 4th from 9 am until 1pm at the Lombard Community Building at Lombard Commons Park, Grace and St. Charles. The Village Board and Public Works and Environmental Concerns Committee will host a joint special meeting relative to the Village’s Capital Improvement Plan on Monday, August 21 beginning at 6pm in the Community Room. This will be followed by a Special Meeting of the Village Board relative to review of the Water and Sewer Fund and proposed Public Works Department FY 2018 budget. VIII Consent Agenda . (DISTRICT #3) This Ordinance was waived of first reading and passed on second reading with suspension of the rules on the Consent Agenda Enactment No: Ordinance 7405 H. 170307 ZBA 17-01, 54 S Highland Avenue The petitioner requests that the Village grant a variation from the Lombard Zoning Ordinance to provide for a front yard setback of thirty-five (35) feet in lieu of the formulated front yard setback requirements set forth within Section 155.407 (F)(1) for a principal structure located within in the R2 Single-Family Residence District. (DISTRICT #5) This Ordinance was waived of first reading and passed on second reading with suspension of the rules on the Consent Agenda Enactment No: Ordinance 7406 I. 170334 Title 11, Chapter 121, Section 121.03(A)(2) - Number of Taxicab Business Licenses Amending Title 11, Chapter 121, Section 121.03(A)(2) decreasing the number of Taxicab Business Licenses from eleven (11) to six (6) to reflect the voluntary non-renewal of taxicab licenses by Oak Brook Taxi & Limo Company, MTP - My Personal Taxi & Livery, The One Taxi, Center Ice Taxi and Metro Yellow Cab. (DISTRICT #2) This Resolution was adopted on the Consent Agenda Enactment No: R 50-17 L. 170326 Intergovernmental Agreement - DuPage Judicial Information System (DuJIS) Resolution approving an Intergovernmental Agreement between the Village of Lombard, County of DuPage and the Emergency Telephone Safety Board approving participation in the countywide CAD/RMS DuPage Judicial Information System (DuJIS). This Resolution was adopted on the Consent Agenda Enactment No: R 51-17 M. 170340 Extension of Temporary Fire Marshal Agreement Resolution authorizing the signatures of the Village President and Village Clerk on the extension of the Agreement with James French to provide Temporary Fire Marshal services for two months. This Resolution was adopted on the Consent Agenda Enactment No: R 52-17 N. Sale of Village-Owned Property - 115 W. Crystal (This item has been moved to Separate Action IX-D) N-2. 170348 Roosevelt and Finley Intersection Improvements, Change Order #1 Reflecting an increase to the contract with Alliance Contractors in the Village of Lombard Page 6 Village Board of Trustees Minutes August 17, 2017 amount of $34,545.00. (DISTRICT #2) This Resolution was adopted on the Consent Agenda Other Matters O. 170344 FY2017 Water Meter Replacement Project PWU-17-15 Award of a contract to Water Resources, Inc., in an amount not to exceed $3,742,552.25. Bid in compliance with Public Act 85-1295. (DISTRICTS - ALL) This Bid was approved on the Consent Agenda P. 170311 2016 Comprehensive Annual Financial Report (CAFR) Motion to accept and file with the Village Clerk the 2016 Comprehensive Annual Financial Report (CAFR), Management Letter and Recommendations regarding the Management Letter Comments. This Request was approved on the Consent Agenda Q. 170317 PC 17-23: Text Amendments to the Sign Ordinance - Off-Premise Interstate Signs The Village of Lombard and the Lamar Companies, request the following actions be taken: A. Add definitions to Section 153.602 for the following terms: Federal Interstate Highway, NIT and SIGN, Off-Premise Interstate; and any other definitional edits for clarity. B. Add a new Section 153.244 Off-Premise Interstate Signs, with renumbering of existing Section 153.244 accordingly. C. Add the following text to the new Section 153.244: Off-Premise Interstate Signs, establishing regulations and provisions for placement of such signs, in the following respects: 1) Deeming such signs to be a principal structure on a lot and regulate such signs as a conditional use per Sections 155.103(F) and 155.208(C) of the Zoning Ordinance. 2) Limiting such signs to placement on a lot within the I Limited Industrial Zoning District and abutting a Federal Interstate Highway right-of-way. In addition, the amendments are intended to establish: a) Distance regulations pertaining to the placement of any such signs from a Federal Interstate Highway right-of-way, maximum height provisions, maximum sign face requirements, the maximum number of faces per sign structure, the orientation and visibility of such structures, limitations on sign projections over structures, limitations on the number of permitted display panels, permitted distance between such signs and non-conforming sign provisions; Village of Lombard Page 7 Village Board of Trustees Minutes August 17, 2017 also b) Operational requirements for off-premise interstate signs that include an automatic changeable copy sign component, which limit the frequency of changing message, other operational messaging aspects, default provisions for malfunctions, light intensity requirements for daytime and nighttime periods based upon nits and foot candles and contact requirements. D. Include the following regulations in a new Section 153.507(C) and 153.507(C) (1) to establish Off-Premise Interstate Signs, as a conditional use in the I Limited Industrial District. E. Approve any other related amendments to the Sign Ordinance, as it pertains to off-premise interstate signs, for clarity purposes. (DISTRICTS - ALL) This Ordinance was continued on the Consent Agenda R. 170318 PC 17-24: Text Amendments to the Zoning Ordinance - Off-Premise Interstate Signs The Village of Lombard and the Lamar Companies, request the following actions be taken: A. Establishing definitions for the following terms: Federal Interstate Highway, NIT and sign, Off-Premise Interstate; and any other definitional edits for clarity. B. Include the following regulations in Section 155.420 (C), as follows: (42) Off-Premise Interstate Signs, as a principal structure on a lot and as a conditional use, pursuant to this Sub-section as well as Sections 155.103(F) and 155.208(C) of the Zoning Ordinance. C. Include the following regulations in Section 155.420 (F), as follows: (5) In lieu of the required front yard setback requirements set forth within Section 155.420(F) (1) or (2), off-premise interstate signs may be located up to the applicable front or corner side yard lot line abutting a Federal Interstate Highway. D. Approve any other related amendments to the Zoning Ordinance, as it pertains to off-premise interstate signs, for clarity. (DISTRICTS - ALL) This Ordinance was continued on the Consent Agenda S. 170319 PC 17-25: 630 Crescent Boulevard (Petitioner Requests to Withdraw Their Petition) The Village of Lombard and the Lamar Companies, request to approve the following actions for the property at 630 Crescent Boulevard: A. Approve a map amendment to rezone the subject property from the Conservation/Recreational (C/R) District to the I Limited Industrial Zoning District; and Village of Lombard Page 8 Village Board of Trustees Minutes August 17, 2017 B. Grant conditional uses, pursuant to Sections 155.208(C) and proposed Section 155.420(C) (42) of the Zoning Ordinance allow for an off-premise interstate sign on the subject property. (DISTRICT #1) This Ordinance was continued on the Consent Agenda T. 170320 PC 17-26: 625 W. Glen Oak Road (Glenbard Wastewater Authority (GWA facility) The Village of Lombard and the Lamar Companies, request to approve the following actions for the property at 625 W. Glen Oak Road (Glenbard Wastewater Authority (GWA) facility): A. Approve a map amendment to rezone the subject property from the Conservation/Recreational (C/R) District to the I Limited Industrial Zoning District; and B. Grant conditional uses, pursuant to Sections 155.208(C) and proposed Section 155.420(C) (42) of the Zoning Ordinance allow for up to two off-premise interstate signs on the subject property. The motion carried by the following vote: Aye: 5- Mike Fugiel, Reid Foltyniewicz, Bill Johnston, Robyn Pike, and Bill Ware Absent: 1- Dan Whittington Enactment No: Ordinance 7410 C. 170333 Amending Title 11, Chapter 112, of the Lombard Village Code - Alcoholic Beverages Amending Title 11, Chapter 112, Section 112.12(A) of the Lombard Village of Lombard Page 10 Village Board of Trustees Minutes August 17, 2017 Village Code relative to the Class "S" liquor license category description by allowing the sale and consumption of beer, cider and wine products (including tastings) not manufactured on the licensed premises, with sales for off-site consumption limited to only beer manufactured on the licenses premises, and increases the licensing fee from $625.00 to $750.00. St. Charles Road. (DISTRICT #4) (3/4 Vote of the Trustees Required - 5 of 6) A motion was made by Trustee Bill Johnston, seconded by Trustee Robyn Pike, that the Ordinance vacating a portion of the Stewart Avenue Right-of-Way north of St. Charles Road be waived of first reading and passed on second reading with suspension of the rules. In addition, the amendments are intended to establish: a) Distance regulations pertaining to the placement of any such signs from a Federal Interstate Highway right-of-way, maximum height provisions, maximum sign face requirements, the maximum number of faces per sign structure, the orientation and visibility of such structures, limitations on sign projections over structures, limitations on the number of permitted display panels, permitted distance between such signs and non-conforming sign provisions; also b) Operational requirements for off-premise interstate signs that include an automatic changeable copy sign component, which limit the frequency of changing message, other operational messaging aspects, default provisions for malfunctions, light intensity requirements for daytime and nighttime periods based upon nits and foot candles and contact requirements.
